10-20-1959 Regular Meeting ADJOURNED MEETING An adjourned meeting of the City Council of the City of Clermont was held in the office of the City Clerk on Tuesday - October 20, 1959. The meeting was called to order at 7:30 P.M. by Chr. Fro-Tem G. Y. Middleton. The following Council members were present: Oswalt, Christenson and Boyd. Councilman and Mayor Pro-Tem Charles B. Roe, was also present. Other officials present were: Clerk JOhnson, City Attny. Morse, Inspector Snyder, City Sup't. Sheldon, Chief of Police Tyndal and Patrolman J.B. Fullwood. Others present were: Messrs. Albert Nolze, Gene Lucas, and lir. Birschall representative of Smith & Gillespie - Engineers. Representative of the local press was also present. The minutes of the Regular meeting held October 6, 1959 and of the Special meeting held October 12, 1959, were read and approved. Mr. Albert Nolze advised the Council that a drainage situation existed on Prince Edward Street near his property, which should be corrected. Mr. Nolze was advised that the matter would be given immediate attention, and said matter was referred to the Streets Committee, V.A.Oswalt, Chr. }~. Gene Lucas protested to the Council the manner of business which was being conducted by the William Elliott Construction Co. adjacent to his property on Highway # 27, and further pro- tested the unsightly conditions in which the business'was being allowed to operate. Mr. Lucas was advised that under present zoning, the business in question did not appear to be prohibited and therefore nothing could be done as to its location, but, that Mr. Elliott would be requested to operate his business in as neat and clean a manner as possible. v~. Birschall of Smith & Gillespie - Engineers, spoke to the Council regarding a sewerage disposal plant for Clermont and submitted to them a proposal from Smith & Gillespie for enginee- ring services regarding this matter. Motion was made by Mr. Oswalt, seconded by Mr. Roe and carried, that proper City offi- cials be authorized to execute the proposal submitted by Smith and Gillespie and to enter into a contract with said Smith & Gillespie for their engineering services,and,that the City Finance Officer be authorized to borrow from the Citizens Bank of Clermont an amount not to exceed $2,000.00,if,and when,it was necessary,to defray the cost of these services. Mayor Pro-Tem Roe spoke briefly to the Council regarding the Lake Apopka Gas District and advised them that he would like an Ordinance passed at the next meeting granting said Lake Apopka Gas District, a franchise from the City of Clermont. Mayor Pro-Tem Roe further recommended that the City of Clermont write a letter of thanks to the State Road Department - the Lake County Board of Commissioners (with a copy to rtr. Jake Bishop) - and Representative Welborn Daniel, for their help and splendid cooperation in re-surfacing of both old and new State Road # 561 through the City of Clermont. Motion was made by Mr. Boyd that the Clerk be requested to draft such letters. Mr. Oswalt stated that he would like to amend the motion to the effect that such letters not only be signed by the Clerk and Mayor, but also by all Council members, and, that if such an amendment were accepted, he would second the motion. lir. Boyd agreed to the amendment and the motion was unanimously carried. Mayor Pro-Tem Roe discussed with the Council, the possibility of securing the services of local civic organizations in an effort to promote a program of re-surfacing various City streets) such program being,that on a voluntary basis the owners of property abutting streets to be re-surfaced agree to pay their share, or, one-third of the cost. All members of the Council were in perfedt agreement with Mr. Roe's suggestion, and he was authorized to proceed with the matter. . Chief Tyndal reported that he had engaged Mrs. Dorothy Koester on a tentative basis with a salary of $45.00 weekly, as a daytime radio operator and requested that the Council confirm such action if it met with their approval. Motion was made by Mr. Roe, seconded by Mr. Christenson and carried, that in line with Chief Tyndal's recommendation, Mrs. Koester be engaged as a daytime radio operator at a salary of $45.00 per week. Inspector Snyder submitted a list of proposals covering Occupational Licenses and Inspections, which he recommended be included in the new codification of city ordinances. This matter was referred to the Laws and Auditing Committee. Inspector Snyder advised the Council that Mr. Kenneth Mavis, agent for Mr. William Kern, had applied for a permit to make certain repairs on a residence located in Block 114 - Lots 3 & 4; that inasmuch as the City had considered the condemnation of_this property, he had advised Mr. Mavis that the matter would have to be brought before the Council for their consideration. Insp. Snyder was instructed to advise f1r. Mavis that a permit for repairs to this property would be issued provided that such permit covered all repairs necessary to bring the building in question to miniwum requirements of R 2 zone. Mr. Oswalt, Chr. of the Streets Committee, reported that work was progressing on the construction of Disston Avenue. Mr. Boyd, Chr. of the Water Committee, reported that laying of water mains along Lake Shore Drive as far as 4th street, had been completed. Sup't. Sheldon was authorized to furnish the purchasing agent with the necessary specifications for a ditching machine and the purchasing agent was authorized to invite bids on such specifications. Mr. Boyd discussed with City Attorney Morse, certain provisions of revised general ordinances which appeared to be in conflict with the City Charter. City Attorney Morse advised f1r. Boyd that in matters of this kind the conditions of the Charter would take precedence over the ordinances. Clerk Johnson read a letter from Mr. Irving Morse, stating that William Gross had requested the closing of Division Street be- tween Clermont and Minneola, and, Bloxam Avenue north of Grand Highway and south of Division Street. The letter further stated that the only interested party other than Mr. Gross was Mrs. Mary Taylor, who owns Tract 61, and that she had been invited to participate in the request for closing of the streets in question. It was concensus of opinion of the Council members that if Mrs. Taylor also requested the closing of the streets in question, that the Council would have no objection, but, until such time as they were advised of Mrs. Taylor's desire in this matter, they did not feel inclined to take official action. . Clerk Johnson read a copy of a letter from Mr. Fred Wolfe to Mr. Jake Bishop, County Commissioner, regarding the possibility of the County participating in the cost of paving West Avenue and Carroll Street. Clerk Johnson read a letter from the Lake Minnehaha Estates Association - Chain-o-Lakes, wherein Mr. Ray Frechette, their Chr. advised the Council that the management of the Clervue Drive-In Theatre had extended them every cooperation when they had objected to him as to the amount of noise created by the theatre and that they were happy to advise that at this time, all noise and distrubance had been almost entirely eliminated and that they certainly were not offering further complaint. Clerk Johnson read a letter from r~. A. P. McIntosh, Chief of the Departnent of Industrial Safety of the State of FIChrida, to the effect it would be necessary to install fire extinguishers adjacent to the gas pumps at the City barn; install fire ex- tinguishers in all city trucks; place first aid kits with all city crews. I'lotion by Mr. Roe, seconded by Hr. Boyd and carried, that the recommendations outlined above be complied with and the necessary fire extinguishers and first aid kits, be purchased. Clerk Johnson read a petition from owners of property abutting Bloxam Avenue (from Pitt Street to DeSoto Street) requesting the paving of said atreet and agreeing to escrow their share of the cost of such paving when notified to do so. Motion by l'1r. Oswalt, seconded by Mr. Christenson and carried, that if the petition represented 51% of the appraised value of the properties abutting the street in question, that the necessary resolution be drawn for the paving of such street. Clerk Johnson was requested to open bids on cement drain tile, which were as follows: Lakeland Cement Company Vulcan Materials Company Florida Concrete Pipe Co. Elliott Construction Co. Motion by Mr. Roe, seconded by I1r. bid of Elliott Construction Co., a the purchasing agent be authorized for the necessary drain tile. 12" $1.25 15" 1.75 18" 2.20 24" 3.10 12" $1.25 15" 1.75 18" 2 . 20 24" 3.10 12" $1.12 15" 1.55 18" 1.97 24" 2.77 12" $1.25 15" 1.75 18" 2.20 24" 3.10 less 10% of above prides Boyd and carried, that the local firm, be accepted and to issue a purchase order -e It was brought to the attention of the Council that a part of the program for the construction of a high school in the Lincoln ~ark area called for the moving of five existing residences from one location to another (both locations being an R 2 Zone) and that the Lake County School Board desired to know if the City would waive certain restrictions of the Electrical Code - the Building Code - and Zoning; such restrictions being minimum requirements for house wiring - minimum size of buildings - and solid house foundations. It was concensus of opinion that all electrical and sanitary requirements of existing codes must be complied with, but, that the matter of solid foundations and minimum size requirements be referred to the Zoning Board of Appeals. Motion by Mr. Boyd, seconded by Mr. Christenson, that the Lake County School Board, or, any party or parties making application for moving of houses in question, be advised that their case should be taken before the Zoning Board of Appeals and that such Zoning Board of Appeals be requested to render a decision as to whether or not minimum residence size requirements and solid house foundations would be waived, but that all sani- tary and electrical requirements of existing local codes be complied with. Motion carried with Mr. Oswalt voting Naye. Clerk Johnson again called to the Council's attention whether or not City owned real property appraisal records would be made available to Hunnicutt & Associates for their appraisal of real property in Lake County. Motion by ~~. Oswalt, seconded by Mr. Christenson and carried, that the appraisal records in question be made available to Hunnicutt & Associates, and, that Mr. Frank E. Owen, County Clerk, be so advised, with a copy of the letter to be sent to Mr. Jake Bishop, County Commissioner. Clerk Johnson advised the Council that Mr. Frank B. Innis had advised he would be unable to serve on the Zoning Board of the City of Clermont. Motion by Mr. Roe, seconded by Mr. Oswalt and carried, that Mr. Clem Wolstencroft be appointed to membership on the Zoning Board to fill the unexpired term of Gary Viti, re cently resigned, and, that Clerk Johnson contact Mr. Wolstencroft and deter:nine if he will take the appointment. Clerk Johnson advised the Council that Amos Thomas had applied for an Occupational License to sell cold drinks and sandwiches in an R 2 zone in the Lincoln Park area. The Council advised Clerk Johmson that the Occupational License in question could not be issued as it was in violation of existing zoning ordi- nances. ORDINANCES :. ... BOX 1048 ..JACKSONVILLE I, FLORIDA October 13, 1959 Honorable Mayor and City Council City of Clermont Clermont, Florida -J t."<:' Subject: Proposal for Profe ssional Service s Gentlemen: This letter proposal is offered in accordance with conversations during your regular meeting of October 6, 1959 with our repre sentative, A. J. Birchall. We hereby propose to furnish the necessary personnel and facilities to review the engineering report of September, 1957 entitled l'Engineering Feasibility Report on Sanitary Sewerage Facilities for Clermont, Floridall, to bring the cost estimates up-to-date and to expand the scope of sanitary sewerage studies to include the entire area within the corporate limits of the City. A new report will be prepared in adequate detail to provide the information required by your fiscal advisors, including estimates of cost, estimates of reyenue, and estimate s of operating costs for each of the various topographic areas into which the City is divided. Our fee for the services outlined above will be actual payroll cost of prepar- ing the report plus 200% thereof, plus actual out-of-pocket expense. The estimated total fee for preparation of the report is $2,000.00, which amount will not be exceeded without specific further authorization. Our fee will be due and payable upon pre sentation of the report. This proposal is made to provide the above outlined services and all other engineering service s required throughout the program. We agree to perform all other engineering service s in accordance with the procedure s and terms recommended and published by the American Society of Civil Engineers, a copy of which is attached. A formal contract covering these complete engineering services and embodying these fees, procedures and terms will be prepared in form subject to approval of your City Attorney. This formal contract will contain provision for a credit to the City on account of payment made by the . City to this firm for the report authorized by this proposal at the rate of One- Half of One Per Cent (0.5%) of the estimated construction cost of the improve- ments for which the City authorize s this firm to prepare final plans and spe cifications. .SMITH AND GILLESPIE ENGINEERS - 2 - City of Clermont October 13, 1959 Also the formal contract will contain provision for a credit to the City for por- tions of plans prepared by this firm in 1947 which can be used to the City's ad- vantage in the progratn of construction now contemplated. However, the amount of such credit will be arrived at by mutual agreement of the parties hereto. Services stipulated to be performed and fees to be paid therefor, under the above referenced formal contract and after the report has been prepared, shall be predicated upon the conclusion of satisfactory arrangements Jor financing the proposed program of construction; and neither the City nor the firm shall be obligated for said fees or services until satisfactory financing arrangements have been successfully concluded. We further propose, and by acceptance below the City does hereby agree, that if financing of the proposed sanitary sewerage progratn is not successfully con- cluded within two years after date of this letter proposal, this agreement will expire.
