ADJOURNED MEETING

An adjourned meeting of the City Council of the City of
Clermont was held at the City Hall on Tuesday, September
16, 1958. The meeting was called to order by Council
President Charles Roe at 7:30 P. M. with the following
Council members present: Roe, Oswalt, Boyd, Bishop. Ab-
sent: Carrington. Others present were Mayor Keene, City
Attorney Morse, Suptt. Sheldon, Fireman Fullwood, Captt.,
Brockway, Mr. E. D. Mullis and Robert A. Comegy, Jr.
The minutes of the meeting held on September 2nd were
read and approved.
Captain Brockway informed the Council that he was in a
position to offer the City of Clermont the building at
the corner of Seventh and Montrose streets, formerly
occupied by Citizen's Bank, at a price of $13,500.00,
payable $1,500.00 in cash and the remainder in equal an-
nual payments over a ten year period with interest at 5%.
After considerable discussion concerning the purchase of
the old bank building, and more particularly as to means
of financing same, motion was made by Mr. Boyd that the
City accept the offer of $5,200.00 for that part of Block
110, Sunset Park, lying south of Highway #50, and lots 1
and 2, Block 109, Sunset Park, and that the proceeds from
such sale be applied toward the purchase price of the old
bank building. The motion was seconded by Mr. Oswalt and
a roll call vote requested. The Clerk called the roll and
the vote was as follows: Yeas - Boyd. Nays: Bishop and Roe.
Mr. Oswalt abstained from voting and Mrs. Carrington was
not present. The motion failed to pass.
Motion was made by Bishop, seconded by Oswalt, that the
City Clerk is directed to advertise, in the local paper,
that fractional part of Block 110, Sunset Park, south of
highway #50, and lots 1 and 2, less south ten feet in Blk.
109, Sunset Park, and alley lying North of and adjacent to
said lots 1 and 2, Blk. 109, Sunset Park, will be sold for
cash on October 7, 1958, at the regular Council meeting to
the person making the best offer, subject to Council re-
fusal or rejection. All offers must be accompanied by cash-
iers check for 10% of the offer. That the proceeds from
such sale shall be used solely by the City for the purchase
and improvement of the old bank building which is to be used
for administrative offices by the City. A roll call vote
was requested with the following results: Yeas - Oswalt,
Roe, Bishop. Nay - Boyd. Absent - Carrington. The motion
carried.

Motion by Oswalt, seconded by Bishop, that the City of Clermont
purchase the old Citizen's Bank building at Seventh and
Montrose streets for administrative offices of the following
terms: Selling price $13,500.00; $500.00 in cash on sign-
ing of contract of purchase; $1,000.00 on or before October
8,1958; balance of $12,000.00 on or before ten years from
contract date together with interest at 5% per annum, payable
annually together with principal payments of not less than
$1,200.00. Said purchase to include all furnishings, fixtures
(exclusive of vault doors) air conditioning plant, gas heating
uni ts with fixtures and tanks. Sellert to~.furilish complete
abstract of title disclosing marketable title free of all
incumbrances and all 1958 taxes to be paid by Seller. Pur-
chaser and Seller to pro-rate hazzard insurance as of October
1, 1958. Purchaser to have possession on October 8, 1958. It
is understood by the City that septic tank is on Castner pro-
perty. Upon roll call vote the ayes were: Roe, Oswalt, Bishop,
Boyd. Nayes: None. Absent: Carrington.

Motion by Boyd that the fractional part of lots 12 and
13, Block 99, lying South of State Road #50 be advertised
by the City Clerk for sale, and bids subject to Council's
approval or rejection, with cashiers check in the amount
of 10% of offer to accompany each offer or bid, on October
8, 1958. There was no second to the motion.
Mayor Keene requested that the Clerk read letters of app-
lication for the position of Chief of Police of the City
of Clermont from Robert A. Comegys ,Jr. and E. D. Mullis.
Both gentlemen were present and were presented to the Council.
They were informed that their applications would be given
consideration.
Mr. Bishop, Chairman of the Streets Committee, stated that
he had no report to make regarding city streets, but, that
he would like to bring to the Council's attention the fact
that Parathion Spray was being used within the City limits
without complying with the provisions of an existing Ordi-
nance covering its use. Clerk Johnson was requested to ad-
vise those firms doing local spraying,of the existing Ordi-
nance and to send them copies of same.
Mr. Boyd, Chairman of the Water Committee, reported that
some two inch connecting water mains had been laid.
Clerk Johnson was requested to endeavor to arrange a meet-
ing between the Groveland City Council and the Clermont
City Council at an early date.
Chairman Roe reported on the meeting of himself, lir. Oswalt,
and Mr. Boyd with representatiy,es of the State Road Dep't.
at Deland.

Mr. Bishop offered, and moved that it be passed, AN ORDINANCE
PROVIDING A BUDGET OF EXPENSES FOR THE FISCAL YEAR OF 1958-59
AND MAKING APPROPRIATIONS THEREFOR: AND PROVIDING A TAX LEVY
ON ALL PROPhRTY IN THE CITY OF CLERMONT, LAKE COUNTY, FLORIDA,
FOR THE YEAR 1958. The motion was seconded by Mr. Oswalt and
unanimously carried. Mr. Oswalt then moved the Ordinance be
read the second time by title only. The motion was seconded
by Mr. Bishop and unanimously carried. After the second read-
ing of the Ordinance, by title only, Mr. Boyd moved that "the
rules be further waived and that the Ordinance be placed upon
its passage. The motion was seconded by Mr. Oswalt and unani-
mously carried. Thereupon the Ordinance was read for the third
time and upon roll call vote, the vote was as follows: Ayes -
Oswalt, Boyd, Bishop, and Roe. Nayes: None. Absent: Carrington.
The Ordinance passed, title as stated, and was recorded in the
Ordinance book and numbered 169. A copy of the Ordinance in
full appears immediately following these minutes.

that the City of Clermont contribute the amount of $100.00
to the Retail Merchants Association for use in their Xmas
Lighting Program, it being understood that such amount is to
be paid from the 1958-59 budget and therefore will not be avail-
able until after November 1, 1958.
Motion by Oswalt, seconded by Bishop, and carried that in
order for the City to avail themselves of the one hundred
dollar discount offered by Municipal Code Corporation, that
the City execute the contract, previously considered and
endorsed by the Council, with Municipal Code Corporation for
the codifying of City of Clermont Ordinances and Charter.
Motion by Boyd, seconded by Oswalt, and carried, that Tax
Collector, Johnson, be authorized to cancel 1957 Personal
Property Tax Statement # 1814, in the amount of $1.80, as
same had been assessed through error, and that tax statements

numbered 1656 to Carroll Electric Company in the amount of
$3.00 for personal property tax, and statement numbered 1758
to Shop Petite in the amount of $42.00, for personal property
Tax, and statement numbered 1755 to Seavars Garage in the a-
mount of $26.40 for personal property tax, and statement num-
bered 1770 to Sunbeam Grocery in the amount of $13.20 for per-
sonal property tax, be canceled,as aforementioned firms are
no longer in business and the taxes assessed against eacll are
now uncollectable.
Chairman Roe read a letter from Mr. Allan S. Boyd. Chairman
of the Florida Railroad and Public Utilities Commission, to
the effect that representatives of the engineering department
would make an investigation of the telephone situation in the
Clermont area.
Motion by Oswalt, seconded by Bishop, and carried, that
meeting be adjourned,at approximately 11 P. M.

NOTICE
The City of Clermont, through its City Clerk, will accept written
offers to buy the following described Real Property, owned by the City:
Fractional Block 110, lying South of State Road 50, Sunset
Park; Lots 1 and 2, Less the South 10 feet thereof, Block 109,
Sunset Park (the City will subsequently close and convey to the
purchaser the 10 foot alley lying North of and adjacent to said
Lots 1 and 2, Block 109, Sunset Park).
The terms of the sale are: Cash with accompanying Cashier's Check
for 10% of offer, and balance of offer accepted to be paid in cash on October
8, 1958. City will pay all taxes prior to and including 1958. Purchaser will
pay for own Abstract or Title Insurance and accept title as owned by City.
All offers must be on whole of above described property. City Council
reserves right to reject any and all offers and thereafter sell said property
at private sale on the same terms.
