04-06-1958 Regular Meeting REGULAR MEETING ~ ~ A regular meeting of the City Council of the City fif was ~eld at the City hall on Tuesday, April 6, 1958. The meeting was called to order by Council President Charles Roe at 7:30 P. M. with all Council members present with the exception of Mrs. Carringtoh. Other officials present were Mayor Keene, City attorney Morse, Supt. Sheldon, Fireman Fullwood. Visitors present were Mr. Comyon of Motorola Compa~, Mr. Brannan, and Mr. Langford of Municipal Code Corp or at ion. The minutes of the meetings held on ~l 15, 1958 and ~~l 22, 1958, were read and approved. ite...tf Mr. Comyon made the request that Cash Fruit Company be allowed permission to 19cate an aerial for a two-way radio on the water tower in the East part of the City. Mr. Comyon stated that Cash Fruit Company agreed to purchase the necessary insurance to fully protect the city and that he would pay the city a rental fee of fifty dollars per year. Motion was made by Boyd, seconded by Oswalt and carried that Cash Fruit Company be grante~ permission to locate an aerial for a two way radio. on the water tower in question for a rental fee of fifty dollars per year, and further provided that said Cash Fruit Company purchase the necessary Insurance to fully protect the city of Clermont; that such insurance meet with the approval of the city's insurance agent, and that the city be provided with a copy of the insurance policy. Mr. Brannon requested that the City Council give consideration to the possibility of eliminating all parking meters in Clermont, and more part ictular to the posSibility of eliminating the enforcement of the parking meters d.uring the summer months. Considerable discussion took place regarding this matter and it appeared to be the consensus of opinion that such act ion would not bet 0 the best interest of the city at large, and, furthermore, that that such action would not be possible under the contract with Dual Parkin8 i'leter Company unt il the payment for the meters was completed. Mr. Brannan also reque sted that the city have one, or more, lites installed along the alley through block 81. This metter was referred to the Street Light ing Committee for inve st igat ion and act ion. ~ ~ Mr. LRngford spoke to the Council with regards to the codffic~tion of all city Ordances. A price was quoted as follows: Editorial work (excluding charter) $2,000.00) with the charter $200.00 additional. 100 copies at $6.50 per page (price based on single copy) with an estimate of approximately 300 pages. Binders at $4.95 each. Supplementary service at :;~8.50 per page. Mr. Langford was informed that the Counc il was definately intere sted in this matter, but that it appeared to be impossible under this years budget. He was assured, however, t~)at the matter lil{ould be given serious consideration and that in all probability he would hear from the Council before November 1st. Mr. Langford agreed to maim the city his proposal in writ ing at an early date. Mr. Bishop, of the Streets Committee, reported that certain difficulties were being experienced in regard. to obtaining the necessary rightofway for Chestnut street, between city blocks 88 & 89. It was agreed that the Streets Committee should continue wit" their efforts to secure the needed r ig,ht of way. ~ ~ IV.:r. DJ.shop further reported that a point had now been reached where the paving of Settle street was necessary and that he recommended that work start on this project as soon as possible. This matter was referred to the Street s Committee with instructions to :\Tork out the necessary details with fvIr. Boyd and to report back to the Council. Mr. Bishop requested that clerk Johnson submit a petetion for the paving of Prince Edward Street, from Pitt to DeSoti streets, by a large maj ority of the interested property owners. l'his matter was also referred to the Streets Committee for investigation, study and recommendations. Mr. Bishop further reported that heavy truck traffic was again passing over Anderson Street. This matter was referred to Iv,ayor Keene with instructions to have the Poiliice Department take the necessary steps to see that it cease. fvIr. Boyd, chairman of the Water Dept. stated that he did not have any report to make. !\Ir. Oswalt of the Parks Committee, stated that he did not have any report to make. Boyd then moved tnat the Ordinance be read the second time by title only. 'rhe motion was seconded by Mr. Oswalt and unanamously carried. After the second reading of the Ordinance, by title only, Mr. Bishop moved that the rules be further waived and that tile Ordinance be placed upon its passage. The motion was seconded by Mr. OSilofalt and unanamo'." sly carried. Thereupon the Ordinance was read in full for the third time and upon roll call vote ,the ayes were Bishop, Oswalt, Boyd and Roe. Naye s: none. Absent: Carrington. The Ordinance passed, title as stated, and was ordered recorded in the Ordinance book and numbered 168 Mr. Bishop read a note from Mrs. Carring, chairman of the Building Committee, recommending certain changes in the Building Code. The matter was referred to City attorney !\:torse with instruct ions' to make the rec ommended change s in the buL.ding code by Ordinance of amendment. ~ ~ Clerk Johnson Wi1S directed to write to the L.oning Commission and request that theyconsider a change in L.oning of the abutting property on highway "50" from We st Avenue to 12th street and that they give s?rious consideration to the rezoning of this !-,~-,~,J:.'~'- to a T-C zone; that the further consider a c ange in the zoning of that property lyong South \<Jest of the intersect ion of 12th and Highway "50 lI, such suggested change being from an M-l to Some form of residental zoning. j,\~yor Keene reported that he r~l3.d_;!lece"ived a reqt:est from the colored citizens for permission to use the baSE ball park. The Council agreed with his opinion. ~ .., r'l;?J.:ylor Keene further reported that hewas receiving complaints of dogs and roosters disturbing, and creating a nuisance,to the general public. 0upt. Sheldon reported that work was progressing on Grand highway, and that he had received the curbing machine recently purchased by the city. Clerk Johnson read the Deport of the Chief of Police. The report was accepted and ordered filed. In the report recommendations were made as follows: That ~r. Tyndal receive permanent appointment to the Police Dept.; that Mr. Varket be appointed on a permanent basis a nd his salary raied to "~275. OC per month, and. that he ( the chief of Police) be authorized to attend the Florida Police Chief's Association annual convention at Jacksonville on ~ay 16, and ~;ay 17. All recommendatlhons were referred to Hayor Keene for ehatever action he deems to the best interest of the city. I'Jr. Sheldon reported that he was in need of a drying mgchine for sand in order to make his own hot miX for street repairs and curbing. Inasmuch as ~1r. Sheldon was unable to present any definate estimate of the cost for such equipment the matter w: s referred to the Streets Committee for ConsideratQon and recommendation. Mr. Oswalt, of the Streets Committee, requested that Mr. Sheldon prepare a written est imate of .the ent ire cost of the equipment in que st ion, and that such estimate be a~emized as to Materials, labor, wiring and any other expenses. Clerk Johnson was directed to obtain bids for the control of termites in the building occupied by Mr. William Boyd. It was sug~ested that bids be obtained from Orkin, Walker Exterminating Co., and Clements Pest control. Clerk Johnson was requ&sted to ask Mrs. Stanley to please submit a statement for her services in typing the preliminary tax roll. Clerk Johnson read a letter from !'Irs. Jeese ivhitney complaining of flies in her neighbortjLood caused by the spreading of manure on groves close by. Clerk Johnson was requested to advise Mrs. Whitney that the Council was very sorry and it was their opinion that the situation had now been corrected, but if had not to kindly advise them. A request to the Council by Nr. Henry Czech to overrule the L.oning Board of Adjustment in regards to the location of a guest house was refused. gotion by Boyd, seconded by Bishop and carried that bilils, be'p$,td;;,Y1. Motion by Bishop, seconded by Oswalt and carried, that the preliminary tax rr)ll, as presented by tax assessor Stanley, be accepted subject to the B')ard of Equalization meeting which shall be held on June 2;rd, 1951, at 7:30 P.
