05-21-1959 Regular Meeting ADJOURNED MEETING ~ An adjourned meeting of the City Council of the City of Clermont was held in the office of the City Clerk on Thursday - May 21, 1959. The meeting was called to order by the Chairman, Chas. Roe, at 7:30 P.M. with all Council members present. Other officials present were: Mayor Hullinger, Clerk Johnson, Deputy Clerk Dolores Williams, Sup't. Sheldon, City Inspector Snyder and City Attorney Morse. Others present were: Mrs. Alvin Richards, Mr. Harry Ralph ' and representative of the local press. The minutes of the regular meeting held May 5, 1959, were read and approved. Chairman Roe stated at this time that the first order of business was to determine whether or not that area in Sunset Heights and Crestview Subdivisions recently re-zoned from an Rl area to an R2 area, be re-zoned to RI or remain R2. Mr. Oswalt reported that according to his survey, the majority of interested people were in favor of the zoning in that area in question, remaining as an R2 area. Mr. Middleton reported that according to his survey, the majority of people in the affected area were in favor of re- zoning the area back to an Rl area, such as had been rec- ommended by the Zoning Commission. Mr. Christenson reported that results of his survey were in agreement with those of Mr. Middleton's and that he favored the re-zoning back to an Rl area. Motion was made by Mr. Oswalt, seconded by Mr.Boyd, that that area in Sunset Heights and Crestview Subdivisions recently re-zoned from an Rl area to an R2 area, remain an R2 zone. Upon roll call vote, the Ayes were: Oswalt, Boyd and Roe; Nayes: Christenson and Middleton. Motion carried. Motion was made by Mr. Middleton that the Zoning Commission be dispensed with and work of such Commission resort to the discretion of the City Council. Motion lost for lack of a second. Motion was made by Mr. Boyd, seconded by Mr. Oswalt and carried, that the Zoning Commission be required to keep official minutes of all their meetings, keep a copy of same on file with the City Clerk, and hold their meetings in the presence of the City Clerk. Mayor Hullinger presented resignation of Henry B. Lively as Chief of Police, effective June 1, 1959 and recommended that Ass't. Chief,Prentice Tyndal, be appointed as Chief effective June 1, 1959. Motion was made by Mr. Middleton, seconded by Mr. Oswalt and carried, that the resignation of Henry Lively as Police Chief and the recommendation of the Mayor for appoint- ment of Ass't. Chief Tyndal as Chief, effective June 1, 1959, be accepted& . Mayor Hullinger presented a sketch of proposed new jail for the Council's discussion and consideration. City Inspector Snyder had no report to make. After considerable discussion regards inspections, Mr. Snyder was authorized by unanimous decision of the Council, to shut off and padlock water supply, subject to his final inspection approval of plumbing installations. . Sup't. Sheldon reported that at the present time, Center Lake stood 12" lower than Lake Winona. Considerable dis- cussion followed regarding this matter and Sup't. Sheldon was then authorized to engage an engineer to make survey of this situation and make recommendations, along with est- imate of cost, as to the best method of reducing present level of Center Lake 2' and maintaining same at that level. Clerk Johnson read a letter addressed to Mr. Christenson, Chr. of the Parks Committee, from the Clermont-Minneola Dad's Club, wherein they requested an allocation of funds from the City for the proposed new athletic field. Clerk Johnson was re- quested to advise them that their request would be given full consideration at the Budget Meeting. Mr. Oswalt, Chr. of the Streets Committee, reported that several streets were ready to seal, but held up temporarily because of rain. He further reported that several complaints had been received with regards bad holes in streets caused by recent heavy rains. Chr. Roe reported to the Council about his trip to Tallahassee with regards to the proposed passage of an Enabling Act creating the Lake Apopka Gas District. He stated that everything possible was being done to assist the passage of this Act, but that he wanted it understood that he was not too optimistic. Motion was made by Mr. Boyd, seconded by Mr. Middleton and carried that, The City of Clermont sell to O.H.Keene for a price of 8,050.00 cash, Lots 1, 2, 3 and Lots 7 to 13 inclusive in Block 5 with the understanding that O.H.Keene deed back to the City the East 50' of Lots 1, 2, 3 in Block 5, with the stipulation that it be used for a parking lot and that it be further understood that DeSoto Street be paved without assess- ment against the property being sold to O.H.Keene, and further, that th~ City fill in the washout in the Western Part of the property. Motion was made by Mr. Oswalt, seconded by Mr. Boyd, and carried, that proceeds from the sale of the property to O.H.Keene be disbursed in the following manner: $1,100.00 plus interest to Ulrich Bauerle for balance due on the cemetery; and that sufficient funds be set aside to pay the City's 1/3 share of the cost of paving of DeSot Street from East Avenue to Crystal Lake; the laying of a 24" drain tile a distance of approximately 600'; the paving of the 50' X 150' parking mot, donated by O.H.Keene; the construction of driveways in the new cemetery addition; the installation of a sprinkling system in the new cemetery addition; and the remainder, if any, be paid to the Citizens Bank of Clermont to reduce the mortgage on the Admini- stration Building. Clerk Johnson read a petition from interested property owners requesting street lights at the intersections of Bloxam and Oak; Bloxam and Sunny Dell Drive; Bloxam and Hook Streets. Motion was made by Mr. Oswalt, seconded by Mr. Middleton, and carried, that street lights be installed at the intersections of Bloxam Street and Pine Lane, Bloxam Street and Oak Street, Bloxam Street and Sunny Dell Drive and Bloxam Street and Hook Street. . Clerk Johnson read a letter from Mr. William McKinney, principal of the Lincoln Park Elementary School, requesting financial assistance from the City in the amount of $150.eO to help defray expenses of summer recreational program. Motion was made by Mr. Middleton, seconded by Mr. Christenson and carried, that an amount of $150.00 be allocated to the Lincoln Park Elementary School to assist in the summer recreational program and the manner of disbursement of such funds be left to discretion of the City Clerk. . Clerk Johnson read a petition from a number of local business men requesting financial assistance from the City for purpose of converting the north portion of the Marvin Meeker property into a modern parking lot. Clerk Johnson was requested to advise such petitioners that the City was now in the process of improving the parking lot at the corner of Minneola and 8th Streets and that all available funds were being used for that purpose and therefore would not be possible to extend any financial assistance at this time. Clerk Johnson read a letter from Mr. Donald Horton protesting the condition of Bloxam Street and Palm Lane and requested that the City proceed with paving of that portion of Bloxam Street from Minnehaha Avenue to the end of the McTernan property. Clerk Johnson was instructed to advise Mr. Horton, that in the opinion of the Council, the cost of paving that portion of Bloxam Street as requested by him would be prohibitive to the property owners due to the fact that without access through the remainder of Bloxam Street there would be no means of disposing of drainage water. Mr. Horton was to be further advised, that in the opinion of the City Attorney, there was some question as to whether or not the City could proceed with any portion of the paving while enjoined by the Courts and that it was the further opinion of the City Attorney that the matter would de- finitely be settled during the month of July. Clerk Johnson submitted to all members of the Council and the Mayor, a semi-annual report on Municipal operations.
