04-21-1959 Regular Meeting ADJOURNED MEETINffi APRIL 21, 1959 . An adjourned meeting of the City Council of the City of Clermont was held on April 21, 1959. The meeting was called to order at Cooper Memorial Library at 7:30 P.M. with the following Council Members present: Roe, Middleton and Boyd. Mayor Hullinger was also present. After receiving a financial report for the last fiscal year and a proposed budget for next fiscal year, the Councilmen present made a tour of inspection of the Library and adjourned the meeting to the office of the City Clerk. When the meeting was called to order at the office of the City Clerk, all Council members were present~ Other officials present were: Mayor Hullinger, City Attorney Morse, Sup't. Sheldon and City Inspector Snyder. Visitors present were: Messrs. McQuistion, Viti, Nagel and McKinstry, members of the Zoning Board; Messrs. Brown and Howell, along With their counsel, Mr. T.C.Cork; Messrs. Pierce, Stalker, Wise, Hillary and Ralph. Repre- sentatives of the Orlando Sentinel and the local press were also present. Clerk Johnson read a letter from the Zoning Board wherein they recommended that that area in Sunset Heights and Crestview Subdivisions recently re-zoned from an Rl area to an R2 area, be again re-zoned back to an Rl area. This recommendation by the Zoning Board was in connection with a petition from property owners in that area to the Council requesting the change and referred by the Council to the Zoning Board. A lengthy discussion followed concerning this matter, with both sides of the question being heard. Motion was made by Mr. Middleton, seconded by Mr. Oswalt and carried, that the request for re-zoning be tabled and that the Building Committee and the Building Inspector be instructed not to issue any Building Permits in this area until the matter is settled. Motion was made by Mr. Middleton, seconded by Mr. Christenson and carried, that churches be allowed to install their re- spective church signs provided they are no larger than 900 square inches and installed on metal posts with brackets and set in concrete at locations approved by the Building Insp. Clerk Johnson was so directed to advise the churches. Minutes of the sp~cial meeting held April 6, 1959 and the regular meeting held April 7, 1959, were read and approved. Chairman Roe requested Inspector Snyder to report the Dollar total of Bumlding Permits issued,at both Council meetings of each month. . Mayor Hullinger, in reporting on the Police Department, stated that the Department at this time was short one patrolman but that they were in the process of obtaining another one. Mean- while, however, they had to employ the services of the Police Auxiliary and Mr. Alton Parker. He further stated that the present policemen were not disgruntled with the extra long hours which they had been working as they realized the position of the Council and were doing the best they could. Mr. Oswalt stated that he did not feel that Mr. Parker should be taken from his present position in order to fill in on the Police Department. Mayor Hullinger further reported that he would submit a report in connection with the remodeling of the City jail, at the next Council meeting. Motion was made by Mr. Boyd, seconded by Mr. Oswalt and carried, that until such time the third patrolman is employed, that his salary be divi- ded between the present policemen and retroactive to April 15, 1959. Building Inspector Snyder reported that the Police Dep't. had not (to-date) served any papers on Mr. William ~ern notifying him of un-sanitary conditions which existed in the building owned by him and located at 743 Minneola Avenue. He further reported that apartments owned by Mr. Kern and located on Highway # 50 were badly in need of repairs and extra sanitary facilities and a general cleaning, painting, etc. of outside grounds as well as the building proper. It was suggested by the City Clerk that the Council consider the appointment of a City Health Officer and recommended Mr. Ralph Snyder for this office. Motion was made by Mr. Oswalt, seconded by Mr. Middleton and carried, that Mr. Snyder be appointed as City Health Officer, effective at once and with no increase in salary. Mr. Oswalt, in reporting for the Street Co~i~ee, stated that the Florida-Georgia Tractor Company had a~ront-end loader for sale and that they would like to demonstrate it to the Council in Clermont. He further stated that he had asked them to bring it over and demonstrate it on Pitt Street. It was generally" agreed by the Council that they would like to see such demonstration and Mr.Middleton st,t/d he would like for the Council to consider a machine of~~ype with rubber ... tires. A general discussion took place relative to Center Lake overflowing onto 8th Street. Mr. Sheldon was directed to block off said 8th street, where it runs around Center Lake, in order to protect the traveling public. Mr. Oswalt offered and moved that it be passed, a RESOLUTION ON STREET ASSESSMENTS. The motion was seconded by Mr. Boyd and unanimously carried. Acopy of the RESOLUTION in full appears immediately following these minutes. Mr. Middleton offered and moved that it be passed, a RESOLUTION SETTING FORTH THE DUTIES AND RESPONSIBILITES OF OFFICERS EMPLOYED BY THE CITY OF CLERMONT. The motion was seconded by Mr. Oswalt and unanimously carried. Clerk Johnson informed the Council that the Gulf Oil Company desired to deed to the City certain underground storage tanks located on City property at the corner of 8th Street and Minneola Avenue, where said Gulf Oil Co. formerly operated a gasoline station. Motion was made by Mr. Middleton, se- conded by Mr. Oswalt and unanimously carried, that the Gulf Oil Company be ordered to remove said underground storage tanks, backfill and replace cement, such being done within a period of 60 days. Clerk Johnson read a letter from Mrs. W. H. Moore wherein she requested that, due to the City increasing the height of DeSoto Street, that her driveway where it appraaches the street needed to be lowered. Clerk Johnson was directed to advise Mrs. Moore that the City does not feel that it is responsible to take care of such matters, especially so inasmuch as such conditions exist throughout the City. Clerk Johnson read a letter from W.N.McKinney, principal of the Lincoln Park Elementary School, whereby he requested per- mission to hold a parade from downt~~ Clermont to the school. Clerk Johnson was directed to advise McKinney that such per- mission was granted and that the Police Department would serve as escort. ... The matter of Mr. Harold Turville's request for payment in the amount of $120.00 for clay which he had put on Minneola Avenue some few years back, was discussed by the Council. It waw unanimously agreed by the Council that this request be rejected and the Clerk directed to so advise Mr. Turv,ille. Clerk Johnson opened and read sealed appraisals Which he had received on City owned property Block 100 and Fra~tional Lots 13 and 14 in Block 99. Motion was made by Mr. Middleton, seconded by Mr. Oswalt and unanimously carried, that Block 100 and Fractional Lots 13 and 14 in Block 99 be offered for sale to the general public for $20,000.00 cash and that same be listed with all local licensed real estate brokers at regular commission, and, that abstract of title to be furn~shed by the City. Clerk Johnson read a letter from Broleman & Rapp, architects, with regards architectural services for the proposed Civic/ Community Building for Clermont. A general discussion took place relative to such proposed Civic/Community Building, with no definite action being taken and Broleman & Rapp's letter ordered filed. " "~, ' \ City Council and its street committee, that the City using its own orews and equipment, supplem.ented by additional equipment and independent contractors for paving, could make said improvemente on said streets tor a sua of money lesS than costs determined from independent contractors, thereby saving the property owners and the City of Clermont as much as 50% on the cost thereof and have now made said improve- ments on said streets and have determined by actua1 cost accounting, a cost of $2.25 per front foot for the abutting property', which costs is more than 5~ less than estimated costs thereof by independent contractors. THEREFORE, BE IT RESOLVED by the City Council of the city of Cleroont, that it is the opfnion of said council that the cost of grading, raising, filling, paving and installing curbs and drainage on said streets hereinabove described, will be just to the property owners thereon and is warranted under a necessity which exists for said improvement, and that the cost of said improvc~ent shall be paid by the property owners abutting said streets and the City of Clermont, in the proportions of one-third (l/S) each, with the City paying the entire costs of intersections and said costs to be charged on the front foot plan rule and that said costs are now determined to be $2.25 per front foot, however, if, in the applicati.on of this rule, in the opinion of said Council, same be unjust or unequal, or result in individual cases in assessment, in excessive or spe- cific benefits r~ceived from such improvements, then the Council shall adopt such rule of apportionment, at the hearing to be held on said assessments, as shall effect a substantial equal- ity between the owners and said city, considering the benefits received by and burdens imposed upon said owners and their re- spective property; and, that said assessments may be paid in cash, on or before thirty (80) days from the adoption of this Resolution, or same may be paid on or before five (5) years -8- -e -e ~ from date of this Resolution, if adjusted, together with interest thereon at six (6%) per-cent per annum, payable annually to- gether with at least one-fifth (1/5) of the total assessment due said city, with the privilege of the owners of said property. paying the whole or any amount of said unpaid assessment, at any time thereafter; and, the owners of the respective properties,. in lien of the sums of certificates of indebtedness, by said city, under its Charter au~h6rity, will give to the said City, their promissory notel payable under the same terms and condi- tions, thereby enabling' the oity to assign said notes to any person, firm or corporatioL, p8rticularly a banking corporation, . whereby said monies received therefrom can be replaced in the General Fund of said city, to be used by said city for the im- provement of othar streets or repairs of other streets in said city, but in no way wil1 the a~signment of said note, by said city, operate as an assignment of the lien, then owned by the city, and for said improvement. (3) Prepare for the City Council an assessment roll of the City properties, real and personal, inside the legal boundaries of the City as outlined in the City Charter. The appraised valuations stated there- in shall be those of the Tax Assessor or by appraisers designated by the City Council. The Supply Clerk shall be bondable and shall have charge of the City's stockpiles of materials, supplies, surplus equipment, spare equipment, parts etc. under the direct control of the Director of Finance and City Council, and to that end he shall be responsible for, and have authority and shall be re- quired to: CENTRAL STORAGE & SUPPLY DEPOT (1) Organize and maintain the overall supervision of all properties coming to him; (2) Shall conform to a uniform system of records for the receipting and disbursing of all materials, supplies, equipment, services and funds; (3) Shall inspect and reject all materials, supplies, equipment and services not measuring up to the City's minimum specification of all types; (4) Shall compile and submit a detailed written budget, in prescribed form, by a stated date to the Director of Finance for inclusion in the City's entire budget request to the City Council; . (5) Shall be in complete charge of the receiving and disbursing of all items, including petroleum products, delivered to and inspected at the storage and supply depots of the City; (6) Shall maintain strict controls over all items as to the prevention of theft, waste, deterioration and embezzlement from the City; (7) Shall issue receiving reports, receipts, etc., on items received as to quantity, quality, condition and from whon1 received daily to the Director of Finance; (8) Shall keep an inventory record of all supplies, materials and items by count, volume, weight or measure in order that stocks on hand may be determined~ and accounted for at all times; (9) Shall be subject to monthly audit by the Director of Finance, to determine accuracy of records and inventories; . (10) Shall correct immediately all discrepancies to the satisfaction of the City Council; (11) Shall engage, hire and discharge employees in his depots~ i~ accordance with rates set for such employment and within the depot's budget; (12) Shall prepare all time sheets and payrolls for all employees under his supervision; (13) Shall prepare requisitions for all items and services requested to be stocked, rendered, obtained, issued and pro- vided by the depots to the Director of Finance in such volume as to meet the inventory requirements of the City's operations; (14) Shall disburse to the requesting departments items, upon proper receipt therefrom and within their operating budgets as certified by the Finance Director. (15) Shall daily remit to the Director of Finance all records of disbursements and loaned items to the various depart- ments properly receipted therefor; (16) Shall maintain, to the best of his ability, an inventory of small tools owned by the City, and upon proper author- ity (public Works Superintendent) if hand tools or other city owned equipment are loaned or rented obtain proper receipt therefor and account to the Director of Finance; (17) Shall render certain services to and charge the various departments therefor through the Director of Finance; (b) Change oil in, and/or grease - vehicles and equipment as requested by departments; OR GY S~HGDu~F Change and/or mount tires on vehicles and equipment as requested by departments; Change fan belts, spark plugs, hatteries and other items of like nature on vehicles and equipment as requested by the departments; '(a) (c) (d) Maintain and repair water meters; . He shall be appointed by the City Council; be under the control of the City Counc il and to that end shall be responsible for and have authority and be required to: DEPARrMENT OF BUIWING INSPECTION (1) Organize and maintain the over-all superv ision of the department; (2) Maintain a uniform system of records, including copies of all permits and inspection certificates issued; (3) Maintain a supplY of application, permit and certificate forms and all other forms necessary to the proper and efficient operation of the department; (4) Engage, hire and discharge employees in his department in accordance with the rates set for such employees and within the departments' budget; (5) Prepare all time sheets and pay-rolls for all employees under his supervision; ~) Compile and submit a detaimed written budget, in prescribed form, by a stated date to the Director of Finance for inclusion in the City's entire bud@St request to the City Counc il ; (7) Examine all applicat ions for permit s for Paif).t ing, Plumbing. and Electrical work and for all Gas installations, and if the application meets all of the requirements of existing codes and ordinances, including the payment of the necessary fee, issue a permit; e (8X Examine all applications for applications for permits for minor repairs and/or alterations to existing buildings, (not in excess of $1,000.00 in value) and if the application meets all of the requirements of existing codes and Ordinances, including the payment of the necessary fee, issue a permit; (9) Examine all applications for permits for the construction of new buildings, additions to existing buildings and maj oe repairs and/or alterations to exist ing buildings, and if the application meets with all of the requirements of existing codes and Ordinances, including the payment of the necessary fee, certify to the Building Committee that the applicat ion is in order and that it meet s with all of the necessary requirements; (10) Determine that any Contractor, Builder, Carpenter, Painter, Plumber or Electrician making application for a permit to do any work within the City of Clermont is properly licensed by the City of Clermont before issuing a permit for the work covered in the application; (11) Make regular and thorough inspections of all new building construction; of all additions, alterations and/or repairs to existing buildings; the removal or razing of any building; of all Painting, Plumbing and Electrical work, and all gas installations, and determine that the work being done is in accordance with existing codes and Ordinances and the permit issued; (12) Have full authority to order that any construction or building work, in any and all of its phases, cease immediatelY when such construction or building is found to be in violation of existing codes and Ordinances, or the permit issued; (!b3) lrlhen making inspections determine that all professions of the building trade required by the City of Clermont to have occupat ional license s are properly licensed, and where any violation is discovered he shall notify the person, or persons, in violation and the Police Department; (14) Determine that any electrical work is under the direct supervision of a Master Electrician; . (15) Determine that any Plumbing work is under the direct supervision of a Master Plumber; .
