An adjourned meeting of the City Council of the City
of Clermont was held on April 21, 1959. The meeting
was called to order at Cooper Memorial Library at 7:30
P.M. with the following Council Members present: Roe,
Middleton and Boyd. Mayor Hullinger was also present.
After receiving a financial report for the last fiscal
year and a proposed budget for next fiscal year, the
Councilmen present made a tour of inspection of the
Library and adjourned the meeting to the office of the
City Clerk. When the meeting was called to order at
the office of the City Clerk, all Council members were
present~ Other officials present were: Mayor Hullinger,
City Attorney Morse, Sup't. Sheldon and City Inspector
Snyder. Visitors present were: Messrs. McQuistion, Viti,
Nagel and McKinstry, members of the Zoning Board; Messrs.
Brown and Howell, along With their counsel, Mr. T.C.Cork;
Messrs. Pierce, Stalker, Wise, Hillary and Ralph. Repre-
sentatives of the Orlando Sentinel and the local press
were also present.
Clerk Johnson read a letter from the Zoning Board wherein
they recommended that that area in Sunset Heights and
Crestview Subdivisions recently re-zoned from an Rl area
to an R2 area, be again re-zoned back to an Rl area. This
recommendation by the Zoning Board was in connection with
a petition from property owners in that area to the Council
requesting the change and referred by the Council to the
Zoning Board. A lengthy discussion followed concerning
this matter, with both sides of the question being heard.
Motion was made by Mr. Middleton, seconded by Mr. Oswalt
and carried, that the request for re-zoning be tabled and
that the Building Committee and the Building Inspector be
instructed not to issue any Building Permits in this area
until the matter is settled.
Motion was made by Mr. Middleton, seconded by Mr. Christenson
and carried, that churches be allowed to install their re-
spective church signs provided they are no larger than 900
square inches and installed on metal posts with brackets and
set in concrete at locations approved by the Building Insp.
Clerk Johnson was so directed to advise the churches.
Minutes of the sp~cial meeting held April 6, 1959 and the
regular meeting held April 7, 1959, were read and approved.
Chairman Roe requested Inspector Snyder to report the Dollar
total of Bumlding Permits issued,at both Council meetings of
each month.

Mayor Hullinger, in reporting on the Police Department, stated
that the Department at this time was short one patrolman but
that they were in the process of obtaining another one. Mean-
while, however, they had to employ the services of the Police
Auxiliary and Mr. Alton Parker. He further stated that the
present policemen were not disgruntled with the extra long
hours which they had been working as they realized the position
of the Council and were doing the best they could.
Mr. Oswalt stated that he did not feel that Mr. Parker should
be taken from his present position in order to fill in on the
Police Department. Mayor Hullinger further reported that he
would submit a report in connection with the remodeling of the
City jail, at the next Council meeting. Motion was made by
Mr. Boyd, seconded by Mr. Oswalt and carried, that until such
time the third patrolman is employed, that his salary be divi-
ded between the present policemen and retroactive to April 15,
1959.
Building Inspector Snyder reported that the Police Dep't.
had not (to-date) served any papers on Mr. William ~ern
notifying him of un-sanitary conditions which existed in
the building owned by him and located at 743 Minneola Avenue.
He further reported that apartments owned by Mr. Kern and
located on Highway # 50 were badly in need of repairs and
extra sanitary facilities and a general cleaning, painting,
etc. of outside grounds as well as the building proper.
It was suggested by the City Clerk that the Council consider
the appointment of a City Health Officer and recommended Mr.
Ralph Snyder for this office. Motion was made by Mr. Oswalt,
seconded by Mr. Middleton and carried, that Mr. Snyder be
appointed as City Health Officer, effective at once and with
no increase in salary.
Mr. Oswalt, in reporting for the Street Co~i~ee, stated
that the Florida-Georgia Tractor Company had a~ront-end
loader for sale and that they would like to demonstrate it
to the Council in Clermont. He further stated that he had
asked them to bring it over and demonstrate it on Pitt Street.
It was generally" agreed by the Council that they would like
to see such demonstration and Mr.Middleton st,t/d he would
like for the Council to consider a machine of~~ype with rubber
... tires.
A general discussion took place relative to Center Lake
overflowing onto 8th Street. Mr. Sheldon was directed to
block off said 8th street, where it runs around Center Lake,
in order to protect the traveling public.
Mr. Oswalt offered and moved that it be passed, a RESOLUTION
ON STREET ASSESSMENTS. The motion was seconded by Mr. Boyd
and unanimously carried. Acopy of the RESOLUTION in full
appears immediately following these minutes.
Mr. Middleton offered and moved that it be passed, a
RESOLUTION SETTING FORTH THE DUTIES AND RESPONSIBILITES OF
OFFICERS EMPLOYED BY THE CITY OF CLERMONT. The motion was
seconded by Mr. Oswalt and unanimously carried.
Clerk Johnson informed the Council that the Gulf Oil Company
desired to deed to the City certain underground storage tanks
located on City property at the corner of 8th Street and
Minneola Avenue, where said Gulf Oil Co. formerly operated
a gasoline station. Motion was made by Mr. Middleton, se-
conded by Mr. Oswalt and unanimously carried, that the Gulf
Oil Company be ordered to remove said underground storage
tanks, backfill and replace cement, such being done within
a period of 60 days.
Clerk Johnson read a letter from Mrs. W. H. Moore wherein she
requested that, due to the City increasing the height of DeSoto
Street, that her driveway where it appraaches the street needed
to be lowered. Clerk Johnson was directed to advise Mrs. Moore
that the City does not feel that it is responsible to take care
of such matters, especially so inasmuch as such conditions exist
throughout the City.
Clerk Johnson read a letter from Mr. O.M.Simpson, Chr. of the
Lake County Board of Commissioners, wherein he stated that the

Clermont and the Lake County Board, would be ~ead into the
minutes of the Board's meeting.
Clerk Johnson read a letter from W.N.McKinney, principal of
the Lincoln Park Elementary School, whereby he requested per-
mission to hold a parade from downt~~ Clermont to the school.
Clerk Johnson was directed to advise McKinney that such per-
mission was granted and that the Police Department would serve
as escort.

The matter of Mr. Harold Turville's request for payment
in the amount of $120.00 for clay which he had put on
Minneola Avenue some few years back, was discussed by
the Council. It waw unanimously agreed by the Council
that this request be rejected and the Clerk directed to
so advise Mr. Turv,ille.
Clerk Johnson opened and read sealed appraisals Which he
had received on City owned property Block 100 and Fra~tional
Lots 13 and 14 in Block 99. Motion was made by Mr.
Middleton, seconded by Mr. Oswalt and unanimously carried,
that Block 100 and Fractional Lots 13 and 14 in Block 99
be offered for sale to the general public for $20,000.00
cash and that same be listed with all local licensed real
estate brokers at regular commission, and, that abstract of
title to be furn~shed by the City.
Clerk Johnson read a letter from Broleman & Rapp, architects,
with regards architectural services for the proposed Civic/
Community Building for Clermont. A general discussion took
place relative to such proposed Civic/Community Building,
with no definite action being taken and Broleman & Rapp's
letter ordered filed.
Motion by Mr. Boyd, seconded by Mr. Christenson and carried,
that meeting adjourn.

NOTICE OF ASSESSMENTS
TO ALL WHOM IT MAY CONCERN:
The City Council of the City of Clermont, Lake County,
Florida, hereby gives notice to you, and to each of you that the
lots, pieces or parcels of real property hereinafter described,
and being situate within the boundaries of the City of Clermont,
have been assessed in the amount set opposite each lot, piece
or parcel of property, as the cost of the improvement on the
respective streets hereinafter described, on a front-foot basis
and/or as the benefit and advantage of such lot, piece or par-
cel of property, beyond the general advantage of all the real
property within said City, from clearing, grading, raising,
filling, paving and installing of curbs and drains of said
streets hereinafter described, as represented on the respective
plats hereinafter referred to; such assessments, in no case
exceeding two-thirds (2/3) of the total cost of such improve-
me nt.
And Notice is hereby given that the City Council of
the City of Clermont, will meet in said City on AJ;1s: tl hlif ~ ~ I
1959, at 7:30 o'clock P.M., in the City Administration Building
and then and there hear any Complaints which the owner or any
other persons, firms or corporations having any interest of any
kind, legal or equitable, in any of the real property hereinafter
described, upon which they wish to make against the assessments
thereon.
If there be no Complaint, the assessments, as origin-
ally made, shall stand confirmed at the adjournment of said
meeting, which meeting may be adjourned, from day to day, un-
ti1 all Complaints, if any, shall be fully heard, but if any
corrections be made upon Complaint, the Assessments, as corrected,
shall then stand upon the adjournment of said meeting.

as represented on the plat of the Townsite of Clermont and/or the

WHEREAS,: the City Council of the City of Clermont,
Lake County, Florieila, have received petitions froDl the owners
of real property abutting streets hereinafter described and
being located within said City, for the improvement of said
streets, by the grading, raising, filling, clearing, paving
an4 in5tallati~n of curbs thereon and ad~qs.te drainage tor
same, and that some petitions are s!gned by ~~ners represent-
ing more than 75% of the assessed valuation of the property
abutting said streets, and on other streets not represe~ted
by petitions of owners of 75~ of the assessed valuation, it
any there be, it is the opinion of the City Couneil of 9ai4
City and in accordance with the said petitions that a
necessity exists requiring the clearing, gradinl, raisinB,
filling, drainage, paving and curbing the following described
streets in said City:

City Council and its street committee, that the City using
its own orews and equipment, supplem.ented by additional
equipment and independent contractors for paving, could make
said improvemente on said streets tor a sua of money lesS
than costs determined from independent contractors, thereby
saving the property owners and the City of Clermont as much
as 50% on the cost thereof and have now made said improve-
ments on said streets and have determined by actua1 cost
accounting, a cost of $2.25 per front foot for the abutting
property', which costs is more than 5~ less than estimated
costs thereof by independent contractors.
WHEREAS, in the opinion of said Council, the cost of
said clearing, grading, raising, filling, paving, curbing
and draining said street, will be just to the property owners
thereon and is w~ranted under'a necessity which e~ists for
said improvement and that the cost thereof, exclusive of the
intersections to be paid by the City, shall be paid by the
owners of the property abutting said street in the propor-
tions of two-third.s (2/8) (1/9 by tl)e owners of the property
ad one side of tbe street and 1/8 by the owners of the pro-
perty on the other side) and the remaining one-third (l/S)
by the city ot Clermont, out of general funds; andftbat
said owners may pay for same in cash within thirty (80) days
of the adop~ion of this Resolution or may pay same over a
period of five (5) year's, together with interest on all sums
remaining unpaid and due the City, at 6~ per annua. payable

thereby being able to replenlish their general funds so that
additional unimproved streets may be constructed, or that ex-
isting streets may be otherwise improved in said City; and,
that upon the adoption of th,is Resolution, assessing the cost
thereof on a front foot basis, that notice of said assessments
be published for at least two weeks in a local newspaper giv-
ing said property owners, or other persons, firms or corpor-
ations, interested in said property, an opportunity to file
their complaints with the City on a time and place to be de-
signated by said City in said notice and thereafter said assess-
!:lents, as made or as adjusted upon said complaints, shall then
stand confirmed upon the. adjournment of said meeting.
THEREFORE, BE IT RESOLVED by the City Council of the
city of Cleroont, that it is the opfnion of said council that
the cost of grading, raising, filling, paving and installing
curbs and drainage on said streets hereinabove described, will
be just to the property owners thereon and is warranted under
a necessity which exists for said improvement, and that the cost
of said improvc~ent shall be paid by the property owners abutting
said streets and the City of Clermont, in the proportions of
one-third (l/S) each, with the City paying the entire costs of
intersections and said costs to be charged on the front foot
plan rule and that said costs are now determined to be $2.25
per front foot, however, if, in the applicati.on of this rule,
in the opinion of said Council, same be unjust or unequal, or
result in individual cases in assessment, in excessive or spe-
cific benefits r~ceived from such improvements, then the Council
shall adopt such rule of apportionment, at the hearing to be
held on said assessments, as shall effect a substantial equal-
ity between the owners and said city, considering the benefits
received by and burdens imposed upon said owners and their re-
spective property; and, that said assessments may be paid in
cash, on or before thirty (80) days from the adoption of this
Resolution, or same may be paid on or before five (5) years

thereon at six (6%) per-cent per annum, payable annually to-

BE IT FURTHER RESOLVED that the City Council of the
City of Clermont does hereby assess and levy on and against the
several lots and parcelS of real property, the respective sums
of money set against each lot or parcel thereof for said im-
provements, based on the front foot plan and rule of $2.25 per
front foot, on each side of said street (whiCh is not in excess
of 2/8 of the total cost of said street improvements) as appears
by Schedule "An attached hereto and made a part of this Reso-
lution, as if fully and at large set forth herein; and, that
further upon the adoption of this Reso1uti.on, said Council shall
cause to be pUblished in a local newspaper, for at least two con-
secutive weeks, a Notice of Assessments, which notice shall set
forth the time and place of the meeting of the Council for the
Purp9se of hearing Complaints on said assessments, and a copy
thereof shall be mailed to each and every owner of said property
(one notice to husband and wife, being sufficient) and said
notice shall give the name of the street upon which the

scription of the property, the front footage of said property
on the respective street, the unit price per front foot and
the total of the assessment and sball further provide that if

There shall be a Department of Finance, the Di~tor of
which shall be the City Clerk, Clerk of the MW1icipal Court,
Registrar of Qualified Voters, Tax Assessor, Tax Collector,
Internal Auditor and Budget Director and who shall be appoint-
ed in accor~ance with the Charter of the City. He shall have
knowledge of municipal accounting and taxation, shall have had
experience in budgeting 'and financial controls, and shall re-
ceive a salary to be fixed by the City Council. The Director
of Finance shall have charge of the Administration of the Finan-
cial Affairs of the City, under the control of the City Council,
and to that end he shall be responsible for, and have authority
and shall be required to:

(1) Require all City Offices, Departments and Agencies
to submit a detailed written budget, in prescribed
form, by a stated date each year of their budget
requests for the coming budget year;
(2) Compile the capital estimates for the Budget for
the City Council; .
(3) Prepare for the City Council an assessment roll of
the City properties, real and personal, inside the
legal boundaries of the City as outlined in the
City Charter. The appraised valuations stated there-
in shall be those of the Tax Assessor or by appraisers
designated by the City Council. Upon the approval
of the assessment roll as to valuation, exemptions and
millage, levy and -assess the taxes so computed;
(4) Collect all taxes, special assessments, license
fees and other revenue of the City or for whose
collection the City is responsibleJ and receive
all money receivable by the City from the State or
Federal Government, or from any court, or from any
office, ~epartment or agency of the City.
(5 ) Have custody of all public funds belonging to or
under the control of the City, or any office, de-
partment or agency of the City Government, and de-
posit all funds coming into his hands in such de-
positories as shall be designated by Resolution of
the City Council, subject to the requirements of
Law as to surety and the payment of interest on
deposits, but all such interest shall be the prop-
erty of the City and shall be accounted for and
credited to the proper account;
Maintain internal control over all purchasing, re-
ceiving, warehousing"inventorying, and disbursing
of all properties;
Shall require all City offices, departments, and
agencies to conrorm to a uniform system of records
for the receipting and disbursing of all funds,
materials, supplies, equipment and services;
(14.) Submit for bid all purchases or contracts for any
materials, supplies, equipment or services which
is in excess of Three Hundred Dollars ($300.00)
and such bids being brought before the City Council
for approval;

is an unencumbered ~alance of appropriation, no

Maintain complete records of all materials, supplies,
'equipment, machinery, real estate and all other
properties owned by the City at all times or in

(15) Require reports of receipts and disbursements, from
each reeeiving and spending agency of the City
Government be made at such intervals as he may deem

(16) Shall require all organizations, clubs, groups, etc.,
receiving appropriations under any budget or grant
of the City to file complete financial and operating
statements of their organizations, clubs, groups,
etc., by a specified time not to exceed sixty
days beyond the end of the City's budget year and
to,examine such statements for compliance of the
terms of the appropriation and report such to the
City Council;
(17) Supervise and be responsible for the disbursement
of all moneys;

(18) Upon the direction of the City Council offer for
sale or sell any City owned property, declared to
be available for sale, at the price or prices
as designated by the City Council;
(19) Submit to the City Council a monthly statement
of all receipts and disbursements in sufficient
detail to show the exact financial condition of
the City;
(20) Prepare for the City Council, as of the end of each
fiscal year, a complete financial statement and
report;
(21) Compile the current expense estimates for the City
Council;
(22) Have the authority to delegate any of his duties
and responsibilities to Deputy Directors of Finance
with the same powers. to carry them out as if they
were the Director of Finance except that the Director
of Finance shall remain' solely responsible for the
Deputy Directors' acts to the City Council;
(23) Perform such other duties as may be directed by
Charter, Ordinance or the City Council.

(1) Organize and maintain the overall supervision of all
properties coming to him;
(2) Shall conform to a uniform system of records for the
receipting and disbursing of all materials, supplies, equipment,
services and funds;
(3) Shall inspect and reject all materials, supplies,
equipment and services not measuring up to the City's minimum
specification of all types;
(4) Shall compile and submit a detailed written budget,
in prescribed form, by a stated date to the Director of Finance
for inclusion in the City's entire budget request to the City
Council;

(5) Shall be in complete charge of the receiving and disbursing
of all items, including petroleum products, delivered to and
inspected at the storage and supply depots of the City;
(6) Shall maintain strict controls over all items as to
the prevention of theft, waste, deterioration and embezzlement
from the City;
(7) Shall issue receiving reports, receipts, etc., on items
received as to quantity, quality, condition and from whon1 received
daily to the Director of Finance;
(8) Shall keep an inventory record of all supplies, materials
and items by count, volume, weight or measure in order that stocks
on hand may be determined~ and accounted for at all times;
(9) Shall be subject to monthly audit by the Director of
Finance, to determine accuracy of records and inventories;

(10) Shall correct immediately all discrepancies to
the satisfaction of the City Council;
(11) Shall engage, hire and discharge employees in his
depots~ i~ accordance with rates set for such employment and
within the depot's budget;
(12) Shall prepare all time sheets and payrolls for all
employees under his supervision;
(13) Shall prepare requisitions for all items and services
requested to be stocked, rendered, obtained, issued and pro-
vided by the depots to the Director of Finance in such volume
as to meet the inventory requirements of the City's operations;
(14) Shall disburse to the requesting departments items,
upon proper receipt therefrom and within their operating budgets
as certified by the Finance Director.
(15) Shall daily remit to the Director of Finance all
records of disbursements and loaned items to the various depart-
ments properly receipted therefor;
(16) Shall maintain, to the best of his ability, an
inventory of small tools owned by the City, and upon proper author-
ity (public Works Superintendent) if hand tools or other city
owned equipment are loaned or rented obtain proper receipt therefor
and account to the Director of Finance;
(17) Shall render certain services to and charge the various

(18) Shall have the authority to delegate any of his duties
and responsibilities to assistants with the same powers to carry
them out as if they were the Supply Clerk except that the Supply
Clerk shall remain solely responsible for the Assistant's acts
to the City Council;

Charter, Ordinance or the City Council.

There shall be a department of Building Inspection the Director
of which shall have supervision over all phases of building inspection,
including the new construct ion of buildings; add it 10ns, alterat 10ns
and/or repairs to existing buildings; the moving or razing of
buildings; all Plumbing, Painting, Electrical and Gas work and/or
installations; and all other phases of the building trade. He shall
comply with and be subject to the regulations of the ~oning Ordinance
and the building, plumbing, electrical" gas and fire prevention codes
as adopted by the City Council of the City of Clermont. He shall
have a general knowledge of the Building, Plumbing, Painting and
Electrical trades. He shall be appointed by the City Council; be
under the control of the City Counc il and to that end shall be
responsible for and have authority and be required to:
DEPARrMENT OF BUIWING INSPECTION
(1) Organize and maintain the over-all superv ision of the
department;
(2) Maintain a uniform system of records, including copies of
all permits and inspection certificates issued;
(3) Maintain a supplY of application, permit and certificate
forms and all other forms necessary to the proper and
efficient operation of the department;
(4) Engage, hire and discharge employees in his department in
accordance with the rates set for such employees and
within the departments' budget;
(5) Prepare all time sheets and pay-rolls for all employees
under his supervision;
~) Compile and submit a detaimed written budget, in prescribed
form, by a stated date to the Director of Finance for
inclusion in the City's entire bud@St request to the City
Counc il ;
(7) Examine all applicat ions for permit s for Paif).t ing,
Plumbing. and Electrical work and for all Gas installations,
and if the application meets all of the requirements of
existing codes and ordinances, including the payment of the
necessary fee, issue a permit;

(8X Examine all applications for applications for permits
for minor repairs and/or alterations to existing buildings,
(not in excess of $1,000.00 in value) and if the application
meets all of the requirements of existing codes and
Ordinances, including the payment of the necessary fee,
issue a permit;
(9) Examine all applications for permits for the construction
of new buildings, additions to existing buildings and
maj oe repairs and/or alterations to exist ing buildings,
and if the application meets with all of the requirements
of existing codes and Ordinances, including the payment of
the necessary fee, certify to the Building Committee that
the applicat ion is in order and that it meet s with all of
the necessary requirements;
(10) Determine that any Contractor, Builder, Carpenter, Painter,
Plumber or Electrician making application for a permit to
do any work within the City of Clermont is properly
licensed by the City of Clermont before issuing a permit
for the work covered in the application;
(11) Make regular and thorough inspections of all new building
construction; of all additions, alterations and/or repairs
to existing buildings; the removal or razing of any building;
of all Painting, Plumbing and Electrical work, and all gas
installations, and determine that the work being done is in
accordance with existing codes and Ordinances and the permit
issued;
(12) Have full authority to order that any construction or
building work, in any and all of its phases, cease
immediatelY when such construction or building is found
to be in violation of existing codes and Ordinances, or
the permit issued;
(!b3) lrlhen making inspections determine that all professions of
the building trade required by the City of Clermont to have
occupat ional license s are properly licensed, and where any
violation is discovered he shall notify the person, or
persons, in violation and the Police Department;
(14) Determine that any electrical work is under the direct
supervision of a Master Electrician;

(15) Determine that any Plumbing work is under the direct
supervision of a Master Plumber;

(160 Make the necessary of all city owned buildings as may be
required by the City Council;
(17) Shall have the authority to delegate any of his duties ODd

the Director shall remain solely responsible for the

NOTICE OF REQUESTS FOR BIDS
TO WHOM IT MAY CONCERN:
The City Council of the City of Clermont, will at
it's adjourned regular meeting to be held in the City Ad-
accept bids
ministration Building on May 19, 1959, at 7:30 P. M.,/for
the purchase, by cash, of the one and one-half story resi-
dence owned by the City of Clermont and located on frac-
tional ~ots 17 and 19, ~lock 80, City of Clermont. The
building is to be removed by the successful bidder, on or
before sixty (60) days from date of acceptance of bid.
All bids must be accompanied by a check for ten (10%)
percent of bid and balance of bid, if accepted, must be
paid within ten (10) days.
The Council reserves the right to reject any and
all bids.
