02-17-1959 Regular Meeting ADJOURNED MEETING An adjourned meeting of the City Council of the City of Clermont was held at the office of the City Clerk on Tuesday, February 17, 1959. ~ ,., The meeting was called to order by Council Vice-Chairman Mr. Middleton at approximately 7:30 P.M. Mr. Charles Roe, Council Chairman, took the chair immediately prior to the reading of the minutes, thus making all Council members present. Other officials present: Mayor Hullinger, Clerk Johnson, Police Chief Dempsey, Sup't. Sheldon, City Attorney Morse, Building Inspector Snyder and Dep~ty Clerk Dolores Williams. Others present: Mrs. H. E. Young, Mr. Cecil Cassady and members of his Civics class from Clermont-Minneola High School and re- presentatives of the Orlando Sentinel and the local press. Minutes of the regular meeting held February 3, 1959 and the Special meeting held February 11, 1959, were read and approved. A special welcome was extended to the visitors from the local school by Chairman Roe and in turn was thanked for the oppor- tunity to do so by Mr. Cassady inasmuch as his Civics class was now studying Municipal Government. Mrs. Howard Young, representing the Clermont Garden Club, petitioned the Council for permission to erect signs at the various approaches to the City proclaiming "City of Clermont, Bird Sanctuary". Motion was made by Mr. Middleton, seconded by Mr. Christenson, and carried, that Clerk Johnson order such signs for the Garden Club at the Garden Club's expense. Mayor Hullinger reported that Montrose Street had been cleaned, insofar as sweeping of same, the past week by prisoners of the City, and it was the plan of the Police Department to do this twice a week in the future. Recommendation was made by Mr. Oswalt that Municipal Judge, J. K. Tryon, be asked to hold special court sessions in the future, should conditions merit same. ~ .. Police Chief Dempsey reported that various alterations had been completed at the City jail including the installations of a new radio receiver and transmittor operating on the sheriffs fre- quency making it now possible to transmit and receive direct, any town in Lame County. Building Inspector Snyder suggested the following codes be adopted: The Southern Standard Building Code for heavy construction The Federal Housing Administration minimum property requirements for properties of one or two living units The Southern Standard Building Code - Part III,Plumbing The present Electrical Code in effect with the exception of minor changes, the two main changes of those being, 60 amp switch be allowed for small residences and electrical examination be more flexible for journeyman electricians. Mr. Snyder further suggested that the'~minimum fee of building permits for minor repairs be raised from $10.00 to $100.00, this to include permits for painting, decorating and alterations. Clerk Johnson suggested that such permits for minor repairs be adopted and Mr. Snyder authorized to issue same up to $1,000.00. It was unanimously agreed that the above codes and the suggested changes thereto, be incorporated in the codification of the City ordinances. Chairman Roe of the Laws and Auditing Committee, stated that he would meet with Clerk Johnson in order to draw up draft of ordinance on occupational Imcense tax to be submitted to the Committee for approval. City Attorney Morse reported that Mr. Ross Walton has petitioned for a re-hearing with regards the courts de- cision on the paving of Disston Avenue. ~ ,., Mr. Middleton, reporting for the Street Lighting and Sanitation Committee, moved that street lights be placed at the following intersections: Pitt Street and East Avenue Woodland Drive and DeSoto Street Pitt Street and Disston Avenue Motion was seconded by Mr. Boyd, and unanimoysly carried. Mr. Middleton recommended that the City acquire that part of Block 99 lying S of Highway # 50 not already owned by the City, and, that that part of Block 99 lying S of Hwy. # 50 and all of Block 100 be offered for sale. After a general discussion it was decided that the matter be re- ferred to Messrs. Middleton and Boyd and City Attorney Morse, and they report back to the Council at a future meeting rec- commendations as to how the matter might best be handled. Motion was made by Mr. Oswalt, seconded by Mr. Middleton and unanimously carried, that the N 1/2 of Block 5 be offered for sale to the general public by the receiving of sealed bids to be in the hands of the City Council no later than 7:30 P.M. on March 17, 1959, and, that each bid must be accompanied by a check for l~~ of the bid, and, that receipts from such sale be used for retirement of new cemetery addition mortgage"and the completion of said new cemetery addition including the platting, irrigation systems, walkways and driveways" and, any other proceeds be applied on capital investment mortgages. Mr. William Boyd had nothing to report from the Water Committee. Mr. Christenson, reporting for the Parks Committee, suggested that city prisoner labor be used in the cleaning up and mowing around Center Lake. The matter was referred to Sup't. Sheldon. Mr. Christenson further reported that considerable number of complaints had been received regarding the crowded parking con- ditions at the local post office. Mr. Oswalt, reporting for the Streets Committee, stated that the work on new streets was progressing nicely and on schedule. He also stated that there were holes in several streets that were badly in need of filling and that Sup't. Sheldon had been directed to take care of these as soon as possible. He further reported that various ACL railroad crossings within the city were badly in need of repair and Clerk Johnson was requested to write the Division Sup't. of the ACL railroad with regards to fixing of same. Mr. Oswalt still further reported that there were some p~ line poles owned by Florida Telephone Corporation that needed to be moved in lieu of the new athletic field and Clerk Johnson was requested to write the Florida Telephone Corp. requesting their engineers to survey this situation and make the necessary changes. ,., Mayor Hullinger was requested to present a list of IlaIlleS, ':re- :commended~-'by him:;1Ctb serY~ as,Gmemb.erg of,~tll~ Zoning Board', 'to", ,~ the ,Co~cil at their next meeting. Clerk Johnson read a letter from Mr. George Davis requesting permissio:g 'Po 'construct,',il boat dock in Lake Minnehaha across the street from 450 East Lake Shore Drive. Clerk Johnson was requested to advise Mr. Davis to apply for a building permit and that they had no objection if his application was accepted by the building committee. Clerk Johnson read a letter from Mr. Howard E. Young, Pres. of South Lake Waterways Club, requesting permission for the Department of Water Resources of the State of Florida to locate a chemical analysis trailer on the City parking lot east of the Chamber of Commerce office. Mr. Oswalt made the motion that this request be granted. The motion was seconded by Mr. Boyd and unanimously carried. ~ ,., , Clerk Johnson read a letter from Mr. Ray Douglass, agent for Mr. Carl Bonnell, requesting an easement on that part of the Crystal Lake shoreline lying directly east of the south 20' of Lot # 1, Block # 25. Clerk Johnson was directed to advise Mr.Douglass that in the Council's opinion it would not be to the best interest of the City to grant such an easement, however, permission was granted to clean and improve that part of the lakeshore which he so desires and to use it for a bathing beach or other purposes of a like nature. The motion to grant this aforesaid permission was made by Mr. Middleton, seconded by Mr. Christenson~ and unanimously carried. Clerk Johnson read a letter from Mr. J.J.Harris,"ehr..,.o:t>::blie Zoning Board of Adjustment, with regards their roll call vote denial to allow Florida Power Corporation to erect a micro- wave transmittor tower on Lots 189,190 and 191, Clermont Hts., such location being in violation of existing zoning ordinance. It was unanimously agreed to accept the decision of the Zoning Board of Adjustment. Clerk Johnson read copies of letters between Representative Welborn Daniel and Mr. Ritchey Green of the state Road Dep't. with regards the re-suEfacing of part of State Road # 561. City Attorney Morse suggested that the Council draw up a plan of jurisdiction for the various standing committees (deffine - the committees scope of work) before the codification of our ordinances dead-line. Chr. Roe directed the Council to prepare and present suggestions and/or recommendations at the next regular meeting. Mr~ Middleton offered and moved that it be passed, AN ORDINANCE FOREVER ABANDONING, CLOSING AND VACATING A THIRTY (30) FOOT "UNNAMED" STREET LYING NORTH OF BLOCK ONE HUNDRED NINE (109) AND SOUTH OF BLOCK ONE HUNDRED TEN (110), SUNSET PARK, AS REPRESENTED ON THE OFFICIAL MAP OF THE CITY OF CLERMONT, FILED FEBRUARY 4, 1926 AND RECORDED IN PLAT BOOK EIGHT (8) PAGES SEVENTEEN TO TWENTY-THREE, INCLUSIVE (17 to 23, INCL.) , PUBLIC RECORDS, LAKE COUNTY, FLORID'K,~_PROVIDING THAT THE FEE SIl'1PLE TITLE TO THE LANDS WITHIN SAID STREET SHALL REVERT IN EQUAL PROPORTIONS TO THE OWNERS OF THE LOTS IN THE RESPECTIVE BLOCKS ADJOINING, ABUTTING AND LYING ADJACENT TO SAID "UNNAMED STREET" PROVIDING FOR THE EFFECTIVE DATE OF THIS ORDINANCE AND OTHER MATTERS RELATING THERETO. The motion was seconded by Mr. Oswalt and unanimously carried. Mr. Boyd then moved that the rules be waived and the Ordinance read a second time by title only. Motion seconded by Mr. Christ- enson and unanimously carried. After a second reading of the Ordinance by title only, Mr. Middleton moved that the rules be further waived and that the Ordinance be placed upon its passage. Motion seconded by Mr. Boyd and unanimously carried. Thereupon the Ordinance was read in full for the third time and upon a roll call vote the ayes were: Roe, Oswalt, Christenson, Boyd, Middleton; NAYES: None; ABSENT: None. The Ordinance passed, title as stated and was ordered recorded in the Ordinance Book and numbered 176.
