REGULAR MEETING

A regular meeting of the City Council of the City of
Clermont waS held at the office of the City Clerk on
Tuesday January 3, 1959 with all Council members
being present. Other City officials present were Mayor
Hullinger, Sup't. Sheldon, Building Inspector Snyder,
Police Chief Dempsey, Clerk Johnson, and Deputy Clerk
Williams. Others present were Mr. Wm. Kelly of the
Lake County Health Department, Mr. O. H. Keene, Mr.
J. J. Harris, chairman of the local Board of Adjustment,
and a representative of the local press.
The minutes of the adjourned meeting of January 20, 1959
were read and approved. Mr. J. J. Harris informed the
Council that the Zoning Board of Adjustment had been
petitioned by the Florida Power Corp. for permission
to construct a 250' micro-wave communications tower
in a nonconforming zone and that a hearing was scheduled
for February 12, 1959 at 2:00P. M. and that notice of such
meeting was being advertised in the local paper.
Mr. O. H. Keene stated that h~ had a prospective buyer
for the Short property on Lakeshore Drive, presently
zoned as RIA, to be used as a restaurant. Mr. Keene
was informed that the proper procedure would be to
present his petition to the Zoning Board of Adjustment
but that it was the opinion of the Council that there
would be considerable objection to this zone nonconfor-
mance.
J:v1r. Kelly, of the Lake County Health Department, app-
eared before the Council and called their attention to
existing unsanitary conditions at the current apart-
ment s on Juniata Street, better known as the Old Army
Barracks and recommended that the necessary steps be
taken to correct thiS situation. Clerk Johnson was
requested to, with the help of City Att'y. Morse,
officially notify the owner of the aforesaid property,
Mr. Wm. Kern and/or his agent Hr. Kenneth Mavis that
the Lake County Health Department has strongly recommen-
ded to the City that the existing unsanitary conditions
be corrected and that therefore the City of Clermont
direct s that the matter be given his olmmediate atten-
tion and that prevailing unsanitary conditions be
corrected within thirty days from date of notice.
Mr. Kelly also brought to the.attention of the Council
the fact that unsanitary conditions also existed on
property adjacent to the Miamian Motel; such property
being outside of City limits, but being serviced by
the City Water Department. A discussion followed
concerning this matter, but no definate action taken.

Chairman Roe discussed with the Council the possibility
of the City of Clermont obtaining Federal financial
assistance for the installation of a sewerage system
in the City of Clermont and suggested that the City
Clerk write to Smith & Gillespie of Jacksonville, the
engineers who prepared the original survey of the pro-
posed local sewer system and request that they submit
copies of the existing plans to Mr. DaVid Lee, of the
State Health Department; that the City Clerk also be
requested to write to Mr. DaVid Lee in an effort to
determine the amount of financial assistance, if any,
the City might expect.

Motion was made by Mr. Boyd, seconded by Mr. Oswalt
and carried, that the order of business of City Council
meetings be changed to allow the reports of the Mayor,
Sup't., Police Chief, and Building Inspector to be
made immediately following the hearing of visitors
in order that aforesaid City officials might leave
the meeting before its conclusion, if they desire to
do so.
Police Chief Dempsey's report was given, accepted,
and ordered filed.
Mayor Hullinger stated that he wished to commend
Police Chief Dempsey for his fine work and more par-
ticularly concerning the handling of jouvenile
delinquincy within the City. Mayor Hullinger further
reported that he had held a meet ing with parent s
of teenagers regarding dangerous pranks committed
by said teenagers and that in his opinion the meeting
had been benificial. The Council in its entirety
supported t his act ion and recommended that it be
continued when necessary.
Clerk Johnson read a letter from Municipal Judge
Tryon wherein Judge Tryon gave a report on the oper-
ation of his office for the past year, and thanked
the Council and other City officials for their
splendid co-operation. Clerk Johnson was requested
to reply to Judge Tryon's letter and express the
appreciat ion of the City Council and the Mayor for
his fine work.
Building Inspector Synder notified tpe Council that
in his opinion certain Sub-Contractors were operating
within the City without having obtained an occupational
license. Inspector Synder waS directed to notifY
all such Sub-Contractors that occupational licenses
were required, and that the Occupational License
Ordinance will be enforced.
Mr. Middlet on and City Att 'Y. Morse reported to the~-,3
Council on their meeting with Mr. O. T. Cook, Sr.
and stated that Mr. Cook was submitting a proposal
for the exchange of easements between the City of
Clermont and himself. After consideration of Mr.
Cook's proposal, it was decided by the Council that
it was acceptable by the City with the exception
that it would be necessary to shift the proposed
location of the 24' easement, through the parking lot,
westward a distance of 5'. Motion was made by Mr.
Oswalt, seconded by Mr. Middleton, and carried, that
Clerk Johnson was requested to advise Mr. Cook that
the City accepts his proposal with the exception
as outlined above.

City Att'y. Morse reported that a joint meeting
between the City Council and the firm codifying
our City Ordinances had been set for February 11,
1959 at 4:00 P.M. Mr. Morse further reported that
he had submitted to Mr. Welborn Daniel, our Repres-
entative, the proposed changes in the City Charter
whereby the City Treasurer would be appointed by
the City Counc il and also the appointment by the
Council of a Substitute City Judge.
Mayor Hullinger reported that it had been practiced
in the past for the City to feed State prisoners
without c ompensat ion for same from the St ate. Mayor
Hullinger was requested to write to Col. John Kirkman
of the State Road Department, and bring this matter
to his attent ion.

l\lr. Boyd, Chairman of the Water Committee, stated
that with regards to the request of the Dad's Club
that the City furnish free water to the new athletic
field and that the prevailing 2 tI water main from
East Avenue to aforesaid athletic field be replaced
with a 6 tI water main that he recommended, and move
that the City furnish water free of charge as re-
quested, and that when it becomes necessary~~t'o take
up the existing 2" water main in order to widen Pitt
Street, that a 6 tI water main be layed. The mot ion
was seconded by Mr. Christenson and carried.
After some discussion with regards to the re-regis-
tration by the City of Clermoht, it was decided
that the registration books would be open from the
hours of 7:0~ P.M. to 9:00 P.M. on each Friday
evening until the books were closed.
Mr. Christenson, Chairman of the Parks Committee,
reported that the boat ramp at J. C. Beach had
been repaired and that the sodding of the new
cemet ary would proceed in t he near future, but that
in their opinion it would be better to wait until
a little later in the season and that futhermore
~he necessary sprinkling or irrigation system should
be installed prior to the sodding.
Mr. Oswalt, Chairman of the Streets Committee,
reported that the construction of the new City
street s were progressing nicely and that at a
meeting of the Streets Committee it had been
determined that the cost of such construction
would be within our budget. Mr. Oswalt further
reported that there was a bad hole in Juniata
Street at its intersection with Tenth Street
which needed repairing.
Sup't. Sheldon was requested to repair the street
in quest,ion.
Mr. Boyd recommended that certain sidewalks be
constructed within the City. A discussion followed
with no act ion being taken.
A motion was made by Mr. Boyd,
and carried, that surity bonds

Motion by Mr. Oswalt, seconded by Mr. Middleton,
and carried, that inasmuch as the new' hospital
wing is now occupied the insurance should be
changed from t1builders risk" to regular insurance
at 80% of the value.

After some discussion it was decided that inasmuch
as Hunnicutt & Assoc. were appraisers of the City of
Clermont, that it would not be nece ssary for the
Tax assessor to send out personal property valuation
blanks to local business firms.
The Council appointed the following as members of
the Electrical Examination Board: Mr. Jack Davis
and Mr. Forrest Colgrove of the Florida Power Corp.,
Mr. Charles Holbrook, Mr. Joe Bon Jorn, with the
fifth member being the City Building Inspector, Mr.
Ralph Snyder.
A discussion took place relative to the appoint-
ment of membership to the local Zoning Board and
it was decided to table the matter unt il a later
date.

Mr. O~Talt again brought up the question of having
specific duties and the extent of authority outlined
for all City Department Heads. Clerk Johnson was
requested to again contact Mr. Wilson Shepard, Auditor
for the City, in an effort to get some help along
thiS line.
Motion was made by Mr. Oswalt, seā¬onded by Mr.
Boyd and carried, that bills be paid.
Motion was made by Mr. Boyd, seconded by Mr. Oswalt
that the meeting be adjourned.

In cannectian with the abave matter Mr. O. T. Caak, Sr.,
has autharized me to. present the fallawing prapasal, subject to. the
City af Clermant canverting and paving their praperty into. a public
parking lat, to -wit:
1. City will canvey to. him a permanent 24 faat easement acrass
Lat 13, Black 80, Clermant, as shawn an the attached drawing.
This dri4teway can be used by the public using the parking lat, but
cannat abstruct same. AlSo. thase desiring entrance to. the rear af
his adjaining praperty shall have un -restricted use af this driveway.
2. In exchange far the abave easement he and his wife will canvey
to. the City af Clermant in fee simple a 6 faat area af land running
Narth-Sauth acrass Lat 14, Black 80. This walkway to. be kept apen
by the City and allawed to be used by the pedesterians in the City
d des:i:Jfiig to. use same. (City may install undergraund any utility lines
faund n<ecessary). He will pay far the cost af paving same.
When a praposed, building is canstructed an. the lands adjaining
this walkway an the West by him he will extend the raof thereaf aver
this walkway to. the adjaining building (Kel's Stare), but the City
must, at its expense, install adequate lighting in the ceiling thereof
ar an the walls cannected to. its Street lights ar an seperalte meter
with time switch.
3. When the City paves its parking lat and his easement aver Lat 13,
Black 80 it will pave the arEflin the rear af his prapased and existing
building to. cannect with the parking area, saSt thereaf to. be paid by

4. If thw walkway is ever permanently clased ar abandaned then this

will, at its Adjourned Regular Meeting to be held in the
City Administration Building in the City of Clermont, at

passage of an Ordinance to forever abolish, abandon, close
and vacate a thirty foot (SO') unnamed street lying South
of Block 110 and North of Block 109, .Sunset Park, as
represented on the Official Map of the City of Clermont,
filed February 4, 1926 and recorded in Plat Book 8,
pages 17-23 Incl.. Public Records of Lake County, Florida.
Said Ordinance provides for, the reversion of the lands
lying within the right-of-way of said unnamed SO' street

NOTICE is hereby given that all qualified voters in the City of Clermont
must RE-REGISTER in the Registration Books of this City. The old Registra-
tion Books will no longer be used in any subsequent City elections.
New Registration Books will be open for re-registration for a period of
30 days in the City Administration Offices (corner of 7th and Montrose Streets)
during the business hours of said office, beginning Monday, January 26, 1959.
All freeholders are urged to submit your deeds to property in said City
to assist in your re-registration as a freeholder in said City.
All persons who are 21 years of age, and have been a resident of the City
of Clermont for 6 months, and of the State of Florida for 12 months are qualified
to register as an elector or voter and if you own real property in said City you
are also entitled to register as a freeholder.
IT IS NOW NECESSARY FOR ALL PERSONS WHO ARE NOW REGISTERED
IN THE REGISTRATION BOOKS OF THIS CITY TO RE-REGISTER.
Being registered in the County Registration Books does not qualify you as an
