WHEREAS, the City Council of the City of Clermont, Florida approved a Utility Service Agreement for Wastewater for the subject property, dated November 8, 2022; and WHEREAS, the City Council ofthe City of Clermont, Lake County, Florida, has determined that it is in the best interest of the City and of the property herein sought to be annexed that the City annex the following described property; and - WHEREAS, the City Council has determined thatthe ama soughtto be annexed is in need of the services which the City can offer and the City has determined that such area sought to be annexed will be substantially benefited by annexation; and WHEREAS, the City Council has determined that all requirements of Section 171.044, Florida Statutes, have been met. CITY OF CLERMONT ORDINANCE NO.2025-019 SECTION 2: That the afore described property shall- be and hereby is made part and parcel of the City of Clermont, Lake County, Florida, and that said property shall be subject to all the laws, ordinances, and provisions pertaining to the City ofClermom, including Lake County PUD Ordinance 2020-03, which is incorporated by reference. To the extent of a substantive conflict between the City and Lake County Ordinance, the terms of the Ordinance shall control. SECTION 3: All property afore described shall henceforth be subject to ad valorem taxation by the City of Clermont, Lake County, Florida and any other general or special taxes or assessments. SECTION 4: CONFLICT All ordinances or parts of ordinances in conflict with any of the provisions of this Ordinance are hereby repealed. SECTIONS, SEVERABILITY Ifany portion of this Ordinance is declared invalid, the invalidated portion shall be severed from the remainder of the Ordinance, and the remainder of the Ordinance shall continue in full forces and effect as ifenacted without the invalidated portion, except in cases when such continued validity of the remainder would clearly and without doubt contradict or frustrate the intent ofthe Ordinance as a whole. SECTION 6• ADMINISTRATIVE CORRECTION This Ordinance may be re -numbered or re -lettered and the correction of typographical and/or scrivener's errors which do not affect the intent may be authorized by the City Manager or designee, without need ofpublic hearing, by filing a corrected orre-codified copy of same with the City Clerk. SECTION 7e RECORDING This Ordinance shall be recorded in the Public Records of Lake County, Florida at the expense ofthe applicant. SECTION 8: PUBLICATION AND EFFECTIVE DATE This Ordinance shall be published as provided by law and it shall become law and shall take effect immediately upon its Second Reading and Final Passage..
