05-07-1963 Regular Meeting . . MINUTES REGULAR MEETING N~ 32 A regular meeting of the City Council of the City of Clermont was held in the City Administration Building on Tuesday, May 7, 1963. The meeting was called to order at 7:30 P. M. by Council Chairman Clarence Bishop with all other members of the Council present. Other city officiaas present were:: Mayor BonJorn, City Attorney Morse, Superintendent Sheldon, Police Chief Tyndal, Building Inspector Snyder and City Clerk Johnson. Visitors present were Messrs. Westbrook and Michaels of Michaels & Michaels engineering firm, and representatives of the local press and the Orlando Sentinel. The minutes of the adjourned meeting held on April 16, 1963 and the Special meeting held on April 18, 1963 were approved as written. Police Chief Tyndal read his monthly report which was accepted and ordered filed. Building Inspector Snyder read his monthly report which was accepted and ordered filed. Superintendent Sheldon reported that some of the streets in the Lincoln Park area were ih need of repairs and requested permission to take care of the matter. Motion was made by Councilman Hutchingson, seconded by Councilman York and carried, that work orders be issued for the repairing of the streets in the Lincoln Park area. Councilman York recommended, and moved, that two street lights be installed on Grand Highway, West of Highway 27. The motion was seconded by Councilman Hutchingson and carried. Councilman Hoskinson recommended that life guards be on duty at the Jaycee Beach on Mother's Day, and further recommended that one life guard be on duty during the weekdays and that two life guards be on duty on weekends and holidays. Councilman Hoskinson stated that this arrangement lNas possible within the limits of the budget. Motion was made by Councilman Hutchingson, seconded by Councilman Turville and carried, that Councilman Hoskinson, Chairman of the Parks Committee, be authorized to engage the necessary persons to serve as life guards at the Jaycee Beach to carry out his program as recommended. Motion was made by Councilman Hutchingson, seconded by Councilman Turville and carried, that the Mayor and City Clerk be authorized to execute the necessary sales contracts, deeds and/or agreements for the sale of the city-owned property, at the corner of DeSoto and Eighth Streets, to South Lake Memorial Hospital. Motion by Councilman Hutchingson, seconded by Councilman Turville and carried, that Clerk Johnson be authorized to pay the balance due on the purchase price of property which the City is buying from Mrs. Rolia Slone and Mr. R. P. Seaver, and that the Mayor and Clerk be authorized to execute a lease of certain property to R. P. Seaver as previously agreed upon by the Council. Clerk Johnson read a letter from Mr. Laurence Russell, wherein Mr. Russell asserted that the sprinkling system at Mr. Paxton's place on East Lake Shore Drive was throwing liater onto, and across the street, thereby causing inconvenience to the motoring public. Police Chief Tyndal was directed to make an investigation of the matter. Clerk Johnson read a letter from Mr. Dwight Tinsley, wherein requests were made for improvements of the tennis courts at Kehlor Park including the installation of a lighting system. Clerk Johnson was requested to advise Mr. Tinsley that the court in question was receiving immediate . . MINUTES N~ 33 attention insofar as a new net, conditioning and marking is concerned, and that the matter of lighting would be given consideration. Clerk Johnson read a letter from Mr. W. Paul Frisz, wherein Mr. Frisz called the Council's attention to certain conditions which he claimed existed at the Spar Filling Station in violation of City Ordinances. Clerk Johnson was requested to have a survey made of the street right-of-ways adjacent to the Spar Station in order to determine if City property was being used and that in the event that the survey discloses that City street right-of-way is being occupied by Spar Service Station they are to be notified to vacate such property immediate- ly. In further connection with this matter Police Chief Tyndal was directed to investigate to determine if a nuisance existed due to un- necessary noise and the storage of junk. Clerk Johnson distributed copies of the proposed budget of Cooper Memorial Library to Council members and read a letter pertaining to same. Motion was made by Councilman Hutchingson, seconded by Councilman Turville and carried, that the Mayor and City Clerk be authorized to execute an agreement for alley right-of-way with Mr. Fred Wolfe for an easement on the South twenty feet of Lot 340, Clermont Heights, and with Mr. John Boyett for an easement of either the South twenty feet of lots 261 and 266 or the North twenty feet of Lots 261 to 265 inclusive, all in Clermont Heights. Mr. Turville, Chairman of the Laws and Regulations Committee, pre- sented for passage a proposed ORDINANCE NO. 3M, the same being: "AN ORDINANCE .AMENDING THE ZONING UAP OF THE ZONING ORDINANCE OF THE CITY OF CLERMONT BY CHANGING THE ZONE OR DISTRICT OF SAID PROPERTY FROM R-l RESIDENTIAL ZONE OR DISTRICT, TO A C-l COMMERCIAL ZONE OR DISTRICT". and the ORDINANCE was read in full the first time and the Chairman referred same to the Laws and Regulations Committee. Mr. Turville, Chairman of the Laws and Regulations Committee, stated that this ORDINANCE \-ras prepared at the direction of the City Council by the Laws and Regulations Committee and City Attorney, and asked that same be taken up at this time. Mr. Turville moved that the rules be waived and that the ORDINANCE be read the: second time by title only. The motion was agreed to by a unanimous vote and ORDINANCE NO. M3 was read a second time by title only. Mr. Turville moved that the rules be further waived and that ORDINANCE NO. 3M be read a third time by title only and placed upon its passage. The motion was agreed to unanimously and ORDINANCE NO. 3M was read a third time by title only. When the vote was taken on thepassage of ORDINANCE 3M the result was: YEAS: YORK, TURVILLE, BISHOP, HUTCHINGSON AND HOSKINSON. Total YEAS: 5. NAYES: NONE. So ORDINANCE NO. bM passed, title as stated, and NO. 3M was assigned to it and ordered immediately placed in the Ordinance Book of the City ~~d a copy ordered posted. . . MINUTES N~ 34 Motion was made by Councilman Turville, seconded by Councilman Hoskinson and carried, that bills be paid. Motion was made by Councilman Hutchingson, seconded by Councilman Turville and carried, that the Clerk be authorized to advertise for sale the houses on the Slone property, recently purchased by the City. At the recommendation of Clerk Johnson, motion was made by Council- man Turville, seconded by Councilman York and carried, that Florida Power Corporation be notified, and authorized, to include the electrical energy bill of Cooper Memorial Library with that of the City, with the understandilo.g that said Cooper Memorial Library is to reimburse the City for the amount of their bill. Motion by Councilman York, seconded by Councilman Hutchingson and carried, that the East fifty feet of the SE}4 of Lot 5, Block "N", be named "Cooper Lane". Motion by Mr. Turville, seconded by Mr. Hoskinson and carried, that the street right-of-way described as the South fifty feet of Lot 3, Block "0" be named "Roane Road". Clerk Johnson advised the Council that the Florida Industrial Commission had notified the City that it was mandatory for them to install safety equipment on the ladder to the water tank on Highlands Avenue. Clerk Johnson further advised that the equipment could be installed for a maximum of $500.00 by Jack Sharpe of Orlando. Clerk Johnson further advised that there was every indication that extensive repairs were needed on the water tank at DeSoto Street and LakeAvenue. Motion was made by Councilman York, seconded by Councilman Hoskinson and carried, that Clerk Johnson be authorized to engage Jack Sharpe of Orlando to install the safety equipment on the water tank on Highlands Avenue, and that Michaels and Michaels be authorized to engage some competent person to make a thorough inspection of our water tanks and to make a full report and recommendations. Motion was made by Mr. Turville, seconded by Mr. York, and carried, that meeting adjourn to an executive session. EXECUTIVE SESSION Motion was made by Mr. Turville, seconded by Mr. Hoskinson and carried, that the Mayor be authorized to engage two radio operators at a salary not to exceed one dollar per hour; that the two new operators and the present operator work five twelve hour shifts each week and that the present operator's salary be increased to sixty dollars per week, or $1.00 per hour. A general discussion took place regarding a sewerage disposal system for a part of the city. Following a report by Clerk Johnson, the engineering firm of Michaels and Michaels offered to investigate the matter and determine if some feasible solution could be found. A discussion too:k'1place relative to minor changes in the Electrical Code as recommended by the Electrical Board. It was decided to amend the code in line with the Board's recommendations.
