This Task Authorization is by and between WRIGHT-PIERCE, INC., hereinafter referred to as "ENGINEER" and the CITY OF CLERMONT, hereinafter referred to as "CITY' and is to that certain agreement number 2020-104 dated December 8, 2020, and any amendments thereto, hereinafter collectively referred to as "the Agreement". The Parties, in exchange for the mutual covenants contained herein and in the Agreement, agree as follows: A. This agreement expressly modifies the Agreement, and in the event of a conflict, the terms and conditions of this Task Authorization shall prevail. B. In addition to all other terms and conditions in the Agreement, ENGINEER shall provide services as described in the Scope of Services attached hereto and incorporated herein. Upon satisfactory completion of these services, the CITY shall compensate ENGINEER in accordance with the applicable Task Authorization. C. CONTRACTOR shall complete the services outlined herein within the timeframe outlined in the applicable attachment hereto. ThisTask Order is provided in accordance with our Continuing Services Agreement No. 2020-104 For On -call Professional Civil Engineering Sarvicesdated December 8, 2020. Project Background/Understanding The City operates a solid waste program consisting of a collection program for Oty residents. The Oty's collection program gathers municipal solid waste (MSJV), recycling, and yard waste from residential and some commercial customers. In 2022, a Solid Waste Master Ran was prepared for the City by the Project Team that included a rate study and assessed the effect of instituting an impact fee. Due to the significant increase in population, customers in the Oty's collection program have been growing rapidly. To cover the costsof additional customers the Oty has expressed interest in instituting an impact fee. Task 2 of this proposal describes the scope of work to estimate an impact fee which would cover the costs of additional collection containers, collection vehicles, equipment and facilities. The final deliverable for this project is report that fulfills legal requirementsfor implementation of an impact fee by municipality, and to provide a calculation of the appropriate fee. Based on our understanding of the Oty's goalsfor this project, Wright-Rerce and ITSpropose the following Scope of Work, Schedule, and Compensation. Scope of Work ask 1: Project Initiation, Wckoff Meeting, and Data Collection The Project Team will lead a project kick-off meeting (in person) with the City. In this meeting, the Project Team will provide a list of data needed from the City for conducting an accurate impact fee assessment. This data indudesthe most recent financial data from the solid waste program, aswell as any additional relevant data collected since the initial rate study effort of 2021-2022. Klck-off meeting minutes (PDF). Task 2: Impact Ft., jevelopmen The Project Team will update the 2022 Rate Analysis calculations based on the most recent data supplied by the City. Thiswill provide an updated estimate of expected impact feesto cover new residential and commercial waste collection containers aswell as additional waste collection vehicles. The number of collection vehicleswill be calculated using the same methodology as in the Master Ran, by comparing previous utilization rates and population projections (from the City) to estimate the number of vehicles necessary to serve the Oty'sfuture population. Using the previously developed Master Ran, the Project Team will update the estimated capital and operating costsfor future facilities required to support the Cty'sgrowing collection program. Thiswill include capital equipment related to operating future facilities and hauling equipment to transport waste to a final disposal location. A proposed impact fee will be calculated that represents the cost of serving one residential unit. Adraft letter report of the updated Rate Analysis Calculations and Estimated Impact Fees will be submitted to the Cityfor review. It is assumed that the Citywill perform a single review of the draft letter and provide a single, consolidated matrix of comments to the Project Team within two (2) weeks. A virtual review meeting will be conducted to review the letter report. City commentswill be addressed under Task 3. Task 2 Deliverables: Draft letter report (PDF) of the updated Rate Analysis Calculations and Estimated Impact Fees. F;bview meeting disposition of comments (PDF). Task 3: ReporL The Project Team will develop a report to document the approach, assumptions, and results of the impact fee assessment. The Project Team will attend a virtual meeting with the City to present the analyses and results. It is assumed that the City will perform a single review of the draft report and provide a single, consolidated matrix of comments to the Project Team within two (2) weeks. This document will be revised based on feedback from the City and a final version will be provided to the City. The intention of this report will be to fulfill legal requirementsfor implementation of an impact fee by a municipality, and to provide a calculation of the appropriate fee, however, legal services are not included. Following completion of the report, the Project Team will prepare a draft Ordinance and Resolution for review by the City. The Ordinance will reference the report prepared in thistask asthe basisfor the impact fee amounts. The Ordinance and Fesolution will be revised based on one (1) review by the City prior to being placed on a City Council agenda. Task 3 Deliverables: Draft Feport (PDF). Draft Ordinance and Fbsolution (DOI) Task +. %.ity Comicil Briefing and Presentation The Project Team will attend one Oty Council Meeting and lead a presentation outlining the methodology and the results of the impact fee assessment in support of the Ordinance. Task 4 Deliverables: Presentation to the Oty Council. Schedule The Project Team will start our services immediately after the Oty's acceptance of this proposal and issuance of a Notice to Proceed and Purchase Order. We expect to submit the final Task 3 Peport within 2 months of receipt of all relevant data and conduct the Oty Council presentation within one month thereafter. This is based on the expectation that the stated review meetingswill be conducted within 14 days of our interim submittals. Compensation Wright -Pierce and ITSwiII complete the above Scope of Services for a lump sum fee of $49,000. Feeswillbe invoiced monthly in accordance with our Continuing Services Agreement based on our estimate of completion for each task, and each invoice will include a progress report describing the efforts performed for that period. If this proposal is acceptable, please provide an NTPand PO and we will work toward scheduling the initial kick-off meeting.
