HomeMy WebLinkAboutContract 2021-071A 2ADocusign Envelope ID: C4187EB5-690C-40E5-9A43-4FC32058663D SECOND AMENDMENT TO AGREEMENT FOR COMMERCIAL AND RESIDENTIAL BUILDING INSPECTION & PLANS REVIEW SERVICES THIS SECOND AMENDMENT is entered into as of this 29th day of July, 2025 and is to that certain Agreement No. 2021-071 dated October 26, 2021, hereinafter "the Agreement", by and between the CITY OF CLERMONT, FLORIDA, a municipal corporation under the laws of the State of Florida whose address is: 685 W. Montrose Street, Clermont, Florida, hereinafter referred to as "CITY" and WILLDAN ENGINEERING, INC., whose address is: 2401 E. Katella Avenue, Suite 300, Anaheim, CA 92806 hereinafter referred to as "CONTRACTOR". The parties, in exchange for the mutual covenants contained herein and in the Agreement, agree as follows: A. This Amendment expressly modifies the Agreement, and in the event of a conflict, its terms and conditions shall prevail. B. The Scope of Services and Compensation Schedule referred to and incorporated into the Agreement is hereby amended to include building code administrator or building official services as more particularly described in Attachment "A" attached hereto and incorporated herein. C. All other terms and conditions outlined in the Agreement shall remain in full force and effect and unchanged as agreed to by the parties. SIGNATURE Vanessa Munoz FULL NAME President TITLE 7/30/2025 DATE SIGNED TITLE 7/30/2?- CIS DATES NED STAMP Docusign Envelope ID: C4187EB5-690C-40E5-9A43-4FC32058663D Exhibit A Exhibit A Docusign Envelope ID: C4187EB5-690C-40E5-9A43-4FC32058663D EXHIBIT "A" STATEMENT OF WORK 1 — SCOPE OF SERVICES The Building Code Administrator or Building Official is to administrate, supervise, direct, enforce, or perform the permitting and inspection of construction, alteration, repair, remodeling, or demolition of structures and the installation of building systems within the boundaries of their governmental jurisdiction, when permitting is required, to ensure compliance with the Florida Building Code and any applicable local technical amendment to the Florida Building Code. The Building Official will review construction plans to ensure compliance with all applicable sections of the code. The construction plans will be reviewed before the issuance of any building, system installation, or other construction permit. The review of construction plans shall be done by the building code administrator or Building Official or by a person having the appropriate plans examiner license issued under this chapter. The Building Official shall ensure that an inspection of each phase of construction where a building or other construction permit has been issued. The building code administrator or Building Official, or a person having the appropriate building code inspector license issued under this chapter, shall inspect the construction or installation to ensure that the work is performed in accordance with applicable sections of the code. 2 —TASKS The Building Official is responsible for enforcing the building code and related City codes and recommending any workflow efficiencies. The Building Official must communicate and work with all municipal departments, property and business owners, and construction and design professionals. The Building Official must communicate current information and educate the public on the current building code, monitor and report on evolving trends within the code. The Building Official must be capable of facilitating meetings as an effective tool to work in partnership with other divisions or departments to attain stated goals, be able to prepare and present oral and written reports, and evaluate current systems, procedures, and policies, in particular concerning the overall design and review processes. The Building Official shall identify areas of deficiency and implement necessary changes in a timely and cost-effective manner, conduct inspections on projects, and be an effective leader in resolving problems and issues related to permitting. The Building Official must perform any other duties as assigned by the Building Services Director. Docusign Envelope ID: C4187EB5-690C-40E5-9A43-4FC32058663D EXHIBIT "A" STATEMENT OF WORK 3 — COMPENSATION The City agrees to pay the successful respondent(s) the following rates: The rates above are based on a forty -hour (40) week. Overtime (over eight working hours in one day) and/or weekend rates are 1.5 times the listed rates. The Building Services Director must approve all overtime hours in advance. All travel expenses are included in the listed Standardized Service Rates. There shall be no additional charges for travel or expenses. The hourly rate shall not apply until the respondent staff arrives at the Building Services Department offices or the first inspection. The City shall not pay the hourly rate after the consultant leaves the last inspection or the City's office.
