A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
CLERMONT, LAKE COUNTY, FLORIDA, PROVIDING FOR INTERIM
PROCEDURES FOR PRELIMINARY PLAT AND FINAL PLAT
APPROVAL; PROVIDING FOR CONFLICT, SEVERABILITY,
ADMINISTRATIVE CORRECTION OF SCRIVENERS ERROR,
PUBLICATION, AN EFFECTIVE DATE, AND FOR OTHER PURPOSES.
WHEREAS, Chapter 166, Florida Statutes, authorizes municipalities to adopt ordinances
and resolutions in the exercise of its municipal powers; and
WHEREAS, on May 20, 2024, Senate Bill 812 was signed by the Governor, creating
section 177.073, Florida Statutes, effective July 1, 2024, requiring that local governments establish
a process to expedite the issuance of building permits for residential subdivisions prior to recording
a final plat; and
WHEREAS, on June 20, 2025, Senate Bill 784 was signed by the Governor, amending
section 177.071, Florida Statutes, effective July 1, 2025. Section 177.071, Florida Statutes, was
amended to require that certain plat or replat submittals be administratively approved with no
further action by certain entities under certain circumstances and requiring the governing body of
a municipality to designate an administrative authority to receive, review, and process plat or replat
submittals; and
WHERAS, the City Council intends to amend the city code to conform with the requirements
mandated by section 177.071 and 177.073, Florida Statutes; and
WHEREAS, pending formal adoption of such amendments to the city code, the City Council
finds it necessary and appropriate to implement interim procedures to ensure consistency with the
revised state law; and
NOW, THEREFORE, be it resolved by the City Council of the City of Clermont, Lake
County, Florida, that:
SECTION 1: INTERIM PRELIMINARY PLAT AUTHORITY
Until such time as the City Council formally adopts an ordinance amending the city code to reflect
section 177.071's new requirements, the Planning and Development Director shall assume all
duties and responsibilities previously assigned to the City Manager under Sections 119-120 and
119-143 of the city code. This delegation includes all procedural functions related to the review,
processing, and administration of preliminary plats and plans.
SECTION 2: INTERIM FINAL PLAT APPROVAL AUTHORITY
Until such time as the City Council formally adopts an ordinance amending the city code to reflect
section 177.073's new requirements, the Planning and Development Director is hereby designated
as the administrative authority responsible for all final plat and replat review, approval, conditional
approval, or disapproval. This authority includes all responsibilities and procedural functions

previously delegated to the subdivision advisory committee under Sections 119-172, 119-229,
119-231, 119-310, and 119-313 of the city code.
SECTION 3: CONFLICT
All resolutions or parts of resolutions in conflict with any of the provisions of this Resolution are
hereby repealed.
SECTION 4: SEVERABILITY
If any portion of this Resolution is declared invalid, the invalidated portion shall be severed from
the remainder of the Resolution, and the remainder of the Resolution shall continue in full force
and effect as if enacted without the invalidated portion, except in cases where such continued
validity of the remainder would clearly and without doubt contradict or frustrate the intent of the
Resolution as a whole.
SECTION 5: ADMINISTRATIVE CORRECTION
This Resolution may be re -numbered or re -lettered, and/or corrected for typographical and/or
scrivener's errors which do not affect the intent of said resolution, as authorized by the City
Manager or designee, without need of public hearing, by filing a corrected copy of same with the
City Clerk.
SECTION 6: PUBLICATION AND EFFECTIVE DATE
This Resolution shall take effect immediately upon its adoption.

NOW, THEREFORE, BE IT RESOLVED, that the above said resolution of the City
Council of the City of Clermont, Lake County, Florida be adopted on this 29th day of July, 2025.
