A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
CLERMONT,FLORIDA,APPROVING ADJUSTMENTS TO THE CITY'S
INTERGOVERNMENTAL WHOLESALE RATE FOR WASTEWATER
SERVICES PURSUANT TO INTERLOCAL AGREEMENTS WITH THE
TOWN OF MONTVERDE, CITY OF MINNEOLA, AND TOWN OF
OAKLAND; PROVIDING FOR CONFLICT, SEVERABILITY,
ADMINISTRATIVE CORRECTION OF SCRIVENERS ERROR,
PUBLICATION AND AN EFFECTIVE DATE.
WHEREAS, in 2013, the City of Clermont (the "City") entered into a valid interlocal
agreement styled as the "Interlocal Agreement between the City of Clermont and the Town of
Oakland for Provision of Wastewater Services," such interlocal agreement allowing Oakland to
send some of its wastewater to the City for treatment and disposal in exchange for payment of an
amount per thousand gallons of wastewater accepted by the City described in the agreement as the
"Intergovernmental Wholesale Rate"; and
WHEREAS, in 2014, the City entered into a substantially similar valid interlocal
agreement styled as the "Interlocal Agreement between the City of Clermont and the Town of
Montverde for Provision of Wastewater Services,"such interlocal agreement allowing Montverde
to send some of its wastewater to the City for treatment and disposal in exchange for payment
calculated based on the Intergovernmental Wholesale Rate described in that agreement; and
WHEREAS, in 2017, the City and Montverde entered into the "First Amended.and
Restated Interlocal Agreement between the City of Clermont and the Town of Montverde for
Provision of Wastewater Services," which amended and replaced the prior interlocal agreement;
and
WHEREAS, in 2019, the City entered into a valid interlocal agreement styled as the
"Interlocal Agreement between the City of Clermont and the City of Minneola for Provision of
Wastewater Services," such interlocal agreement allowing Minneola to send some of its
wastewater to the City for treatment and disposal in exchange for payment calculated based on the
Intergovernmental Wholesale Rate; and
WHEREAS, in each of the three interlocal agreements,the Intergovernmental Wholesale
Rate shall increase on October 1 of each year by an annual automatic adjustment rate established
by the City Council and applicable to all City sewer utility customers; and
WHEREAS, for some years, the City adjusted the Intergovernmental Wholesale Rate by
a rate provided by the Florida Public Service Commission,which has kept the Intergovernmental
Wholesale Rate substantially below the rate intended and required by the interlocal agreements;
and

WHEREAS, this Resolution adjusts the Intergovernmental Wholesale Rate for the next
four years in a manner to comply with the City's obligations under the interlocal agreements.
NOW,THEREFORE,BE IT RESOLVED by the City Council of the City of Clermont,
Florida as follows:
SECTION 1:
The Intergovernmental Wholesale Rate shall be adjusted to $7.11 per thousand gallons of
wastewater on October 1, 2025 for the Town of Oakland, Town of Montverde, and City of
Minneola (the "Benefitted Municipalities"). The Intergovernmental Wholesale Rate shall then be
increased by eight percent (8%) on October 1, 2026 to $7.68 per thousand gallons for the
Benefitted Municipalities and then eight percent (8%) again on October 1, 2027 to $8.29 per
thousand gallons for the Benefitted Municipalities. Finally, beginning on October 1, 2028, the
Intergovernmental Wholesale Rate shall be increased pursuant to the provisions of each applicable
interlocal agreement in the manner indicated in those agreements.
SECTION 2: CONFLICT
All resolutions or parts of resolutions in conflict with any of the provisions of this Resolution are
hereby repealed.
SECTION 3: SEVERABILITY
If any portion of this Resolution is declared invalid, the invalidated portion shall be severed from
the remainder of the Resolution, and the remainder of the Resolution shall continue in full force
and effect as if enacted without the invalidated portion, except in cases where such continued
validity of the remainder would clearly and without doubt contradict or frustrate the intent of the
Resolution as a whole.
SECTION 4: ADMINISTRATIVE CORRECTION
This Resolution may be re-numbered or re-lettered, and/or corrected for typographical and/or
scrivener's errors which do not affect the intent of said resolution, as authorized by the City
Manager or designee, without need of public hearing, by filing a corrected copy of same with the
City Clerk.
SECTION 5: PUBLICATION AND EFFECTIVE DATE
This Resolution shall be effective on September 9, 2025.
