A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
CLERMONT, FLORIDA, RELATING TO THE DRINKING WATER
STATE REVOLVING FUND LOAN PROGRAM; MAKING FINDINGS;
AUTHORIZING THE LOAN APPLICATION AND EXECUTION OF THE
LOAN AGREEMENT FOR PROJECT NO. 35141); DESIGNATING
AUTHORIZED REPRESENTATIVES; PROVIDING ASSURANCES;
PROVIDING FOR CONFLICT, SEVERABILITY, ADMINISTRATIVE
CORRECTION OF SCRIVENERS ERROR, PUBLICATION AND AN
EFFECTIVE DATE.
WHEREAS, Florida Statutes provide for loans to local government agencies to finance
the pre-construction and construction of drinking water infrastructure; and
WHEREAS, Florida Administrative Code rules require authorization to apply for loans,
to establish pledged revenues, to designate an authorized representative; to provide assurances of
compliance with loan program requirements; and to enter into a loan agreement; and
WHEREAS, the State of Florida Department of Environmental Protection (FDEP)
administers the Drinking Water State Revolving Fund (DWSRF) Program to provide financial
assistance to local government agencies for water infrastructure projects; and
WHEREAS, the City of Clermont has been identified on the State Fiscal Year 2026
DWSRF Supplemental Appropriation for Hurricanes Helene and Milton and Hawai'i Wildfires
(SAHM)Priority List for Project No. 351413; and
WHEREAS,the FDEP has determined that Project No. 3514D is eligible for a total listing
amount of$15,660,000, which includes $7,830,000 in principal forgiveness; and
WHEREAS, the City of Clermont, Florida, intends to enter into a loan agreement with
FDEP under the DWSRF program for project financing.
WHEREAS, the City of Clermont intends to utilize the funds for the Planning, Design,
and Construction phases of the project.
NOW,THEREFORE,be it resolved by the City Council of the City of Clermont,Florida,
that:
SECTION 1: RECITALS
The foregoing findings are incorporated herein by reference and made a part hereof.
SECTION 2: FINDINGS
The City Commission hereby finds that the construction and improvement of the City's drinking
water infrastructure is necessary for the public health, safety, and welfare of the citizens of
Clermont.

SECTION 3: LOAN AUTHORIZATION
The City of Clermont is hereby authorized to apply for and accept a loan through the DWSRF
Program for Project No. 3514D in the amount of $15,660,000, with the understanding that
$7,830,000 of said principal shall be forgiven pursuant to the SAHM funding requirements.
SECTION 4: AUTHORIZED REPRESENTATIVE
The City Manager is hereby designated as the authorized representative to provide the assurances
and commitments required by the loan application.
SECTIOIN 5: EXECUTION OF AGREEMENT
The Mayor is hereby designated as the authorized representative to execute the loan agreement
which will become a binding obligation in accordance with its terms when signed by both parties.
The Mayor is authorized to represent the City in carrying out the City's responsibilities under the
loan agreement. The Mayor is authorized to delegate responsibility to appropriate City staff to
carry out technical, financial, and administrative activities associated with the loan agreement.
SECTION 6: LEGAL AUTHORITY
The legal authority for borrowing moneys to construct this Project is 166.111, Florida Statutes.
SECTION 7: CONFLICT
All resolutions or parts of resolutions in conflict with any of the provisions of this Resolution are
hereby repealed.
SECTION 8: SEVERABILITY
If any portion of this Resolution is declared invalid, the invalidated portion shall be severed from
the remainder of the Resolution, and the remainder of the Resolution shall continue in full force
and effect as if enacted without the invalidated portion, except in cases where such continued
validity of the remainder would clearly and without doubt contradict or frustrate the intent of the
Resolution as a whole.
SECTION 9: ADMINISTRATIVE CORRECTION
This Resolution may be re-numbered or re-lettered, and/or corrected for typographical and/or
scrivener's errors which do not affect the intent of said resolution, as authorized by the City
Manager or designee, without need of public hearing, by filing a corrected copy of same with the
City Clerk.
SECTION 10: EFFECTIVE DATE
This Resolution shall become effective immediately upon its passage and adoption.

NOW, THEREFORE, BE IT RESOLVED, that the above said resolution of the City
Council of the City of Clermont, Florida be adopted on this 24th day of February, 2026.
