HomeMy WebLinkAboutOrdinance No. 2025-043 d' CLERWONT CITY OF CLERMONT ORDINANCE NO. 2025-043 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF CLERMONT; LAKE COUNTY, FLORIDA, AMENDING THE CITY OF CLERMONT POLICE OFFICERS'RETIREMENT PLAN AT CHAPTER 28, ARTICLE III; AMENDING SECTION 28-63, DISABILITY; PROVIDING FOR CONFLICT, SEVERABILITY, CODIFICATION, THE ADMINISTRATIVE CORRECTION OF SCRIVENERS ERROR, PUBLICATION AND AN EFFECTIVE DATE. WHEREAS, the City of Clermont Police Officers are provided pension and certain other benefits under Clermont City Code; Chapter 28,Article I1I; WHEREAS, the City Council desires to amend the provisions of the Police Officers' Retirement Plan;and NOW,THEREFORE,BE IT ORDAINED by the City Council of the City of Clermont, Lake County, Florida that(note: strikethrough indicates removed words and underlined indicates added text): SECTION 1: That Chapter 28, Pensions and Retirement, Article III, Police Officers' Retirement Plan,Section 28-63,Disability,subsection(c),Benefits not-in-line of duty,of the Code of Ordinances of the City of Clermont, is hereby amended to read as follows: (c) Benefits not-in-line of duty.Any member with ten years or more credited service who shall become totally and permanently disabled to the extent that the member is unable,by reason of a medically determinable physical or mental impairment,to render useful and efficient service as a police officer,which disability is not directly caused by the performance of the member's duties as a police officer shall,upon establishing the same to the satisfaction of the board, be entitled to a monthly pension equal to the greater of: (1) The member's accumulated contributions at five percent interest; or (2) 2'/4 percent of average final compensation times years of credited service earned prior to October 1,2002,plus three percent of average final compensation times years of credited service earned on and after October 1, 2002;.or CC CLERWONT CITY OF CLERMONT ORDINANCE NO. 2025-043 25 percent of the member's average final compensation. A member determined to be totally and permanently disabled from a non-service-connected injury or disease and who has not completed ten years of service shall receive a return of accumulated contributions with five percent interest. Eligibility requirements for disability benefits are set forth in subsection(g)of this section. SECTION 2: CODIFICATION Specific authority is hereby granted to codify and incorporate this Ordinance in the existing Code of Ordinances of the City of Clermont. SECTION 3: CONFLICT All Ordinances or parts of Ordinances in conflict herewith be and the same are hereby repealed. SECTION 4: SEVERABILITY If any section, subsection, sentence,clause,phrase of this ordinance,or the particular application thereof shall be held invalid by any court, administrative agency, or other body with appropriate jurisdiction,the remaining section,subsection,sentences,clauses,orphrases under application shall not be affected thereby. SECTION 5: ADMINISTRATIVE CORRECTION OF SCRIVENERS ERROR Regardless of whether such inclusion in the Code as described in Section 1 is accomplished,sections of the Ordinance may be re-numbered or re-lettered and the correction of typographical and/or scrivener's errors which do not affect the intent may be authorized by the City Manager or designee, without need of public hearing,by filing a corrected or re-codified copy of same with the City Clerk. SECTION 6: PUBLICATION AND EFFECTIVE DATE This Ordinance shall be published as provided by law and it shall become law and shall take effect immediately upon its Second Reading and Final Passage.
