AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF
CLERMONT, LAKE COUNTY, FLORIDA, CLOSING AND
PERMANENTLY ABANDONING A PORTION OF SHORT STREET
RIGHT OF WAY, JOHNSON'S REPLAT, ACCORDING TO THE PLAT
THEREOF RECORDED IN PLAT BOOK 8,PAGE 71,PUBLIC RECORDS
OF LAKE COUNTY, FLORIDA, AND MORE PARTICULARLY
DESCRIBED AS BELOW; THIS ORDINANCE WILL REPEAL AND
REPLACE ORDINANCE NO. 2025-016 DUE TO REVISED LEGAL
DESCRIPTION. PROVIDING FOR CONFLICT, SEVERABILITY,
ADMINISTRATIVE CORRECTION OF SCRIVENERS ERROR,
RECORDING,PUBLICATION AND EFFECTIVE DATE.
WHEREAS,the City Council of Clermont, Florida approved a petition for Right-of-Way
closure on June 10,2025; and
WHEREAS,the Property Appraiser of Lake County,Florida requested a legal description
that would give a more detailed description of the portion of Right-of-Way that was being vacated;
and
WHEREAS,the city as the applicant has requested an amendment to Ordinance No.2025-
01 E to specify the exact location of the Right-of-Way that was approved to be closed; and
WHEREAS,the City Council reviewed the amendment to the petition,and any comments,
favorable or unfavorable, from the public and surrounding property owners at a Public Hearing
duly advertised; and
NOW THEREFORE,BE IT RESOLVED AND ENACTED by the City Council of the
City of Clermont, Lake County,Florida that:
SECTION 1: LEGAL DESCRIPTION
60 FOOT RIGHT-OF-WAY SECTION OF SHORT STREET AS INDICATED ON JOHNSON'S
REPLAT,PB 8 PG 71,MORE PARTICULARLY DESCRIBED AS:
THE BOUNDED AREA OF THE 60 FOOT RIGHT-OF-WAY SECTION OF SHORT STREET
STARTING AT A POINT OF BEGINNING (POB) COMMENCING AT THE SOUTHEAST
CORNER OF LOT 14, BLK 115 AND RUNNING NORTHWEST ALONG SHORT STREET
ALONG THE SOUTHERN BOUNDARY OF LOTS 15, 16, 17, AND 18, BLK 115 TO THE
SOUTHWEST CORNER OF LOT 18; 262 FEET; TRANSVERSE ACROSS THE 60 FOOT
RIGHT-OF-WAY OF SHORT STREET TO THE NORTHEAST CORNER OF LOT 1,BLK 118
AND RUNNING SOUTHEASTERLY ALONG SHORT STREET RIGHT-OF-WAY TO THE
SOUTHEAST CORNER OF LOT 2,BLK 118; 147 FEET AND THEN TRANSVERSE ACROSS

SECTION 2:AUTHORITY
This ordinance will repeal and replace Ordinance No. 2025-016 due to the revised legal
description.The Vacated Parcel is hereby closed and vacated by the City of Clermont.The closing
is done pursuant to the authority of the Charter of the City of Clermont,Lake County,Florida and
the general laws of the State of Florida.
SECTION 3: CONFLICT
All ordinances or parts of ordinances in conflict with any of the provisions of this Ordinance are
hereby repealed
SECTION 4: SEVERABILITY
Should any Section or part of this Section be declared invalid by any court of competent
jurisdiction, such adjudications shall not apply to or affect any other provision of this Ordinance,
except to the extent that the entire Section or part of the Section may be inseparable in meaning
and effect from the Section to which such holding shall apply.

SECTION 5: ADMINISTRATIVE CORRECTION
This Ordinance may be re-numbered or re-lettered and the correction of typographical and/or
scrivener's errors which do not affect the intent may be authorized by the City Manager or
designee, without need of public hearing, by filing a corrected or re-codified copy of same with
the City Clerk.
SECTION 6: RECORDING
This Ordinance shall be recorded in the Public Records of Lake County, Florida. Recording fees
will be at the expense of the applicant.
SECTION 7: PUBLICATION AND EFFECTIVE DATE
This Ordinance shall be published as provided by law and it shall become law and shall take effect
immediately upon its Second Reading and Final Passage.
