COUNCIL; PROVIDING FOR CONFLICT, SEVERABILITY,ADMINISTRATIVE CORRRCTION OF SCRIVENER'S ERRORS,PUBLICATION AND EFFECTIVE DATE_ WHEREAS, Section 31(a) of the Charter of the City of Clermont (hereinafter, the "Charter")o provides that the City Council shall appoint a City Manager who"shall have the powers and perform the duties provided in"the Charter; and WHEREAS, on August 26, 2025, the City Council approved the City Manager Employment Agreement, by which the City Council fulfilled its responsibility under the Charter to appoint a City Manager; and WHEREAS,pursuant to Section 5 of the City Manager Employment Agreement, as well as its power and authority under the Charter, the City Council reserved for itselF the ability to "evaluate/review the performance of[the City Manager] in a public meeting, subject to a]Process, form,criteria, and format of its choosing";and WHEREAS, after public deliberation regarding the criteria and manner for such an evaluation,as well as its process,form,criteria,and Format,the City Council desires memorializing and approving the criteria and process described herein; and WHEREAS, the City of Clermont finds that this Resolution is in the best interest and welfare of the residents of the city. NOW,THEREFORE,be it resolved by the City Council of the City of Clermont, Lake County,Florida,that: SECTION 1: CRITERIA The City Council hereby adopts the criteria and questions in Exhibit A attached to this Resolution, as the criteria and questions by which the City Council shall evaluate the City Manager on at least an annual basis pursuant to its reserved power and authority under both the City Manager Employment Agreement and the City Charter. SECTION 2: PROCESS 77he City Clerk shall provide the form attached as Exhibit A to the City Council members no later than August 1 of each year_ The Council members may return the form with their evaluation and responses no later than August 15 of the applicable year_ The City Clerk shall review the returned forms, providing the individual scores in addition to the average scores for each category, compiling the comments from the three(3)o questions,and maintaining possession of the compiled CITY OF CLERMONT Aa(ChwpKNMIRESOLUTION NO.2026-015R responses.The City Clerk shall place the City Manager Evaluation on the agenda no later than the first regularly scheduled City Council meeting in September for discussion. In the staff report for the City Manager Evaluation item,the City Clerk shall include,at a minimum,"The City Council shall discuss their evaluation of the City Manager based on the required criteria and questions.The City Council shall determine and vote on any merit salary increase based on the results of the evaluation and establish any priorities,expectations,goals,or objectives to be included in the next year's reporting period." SECTION 3: CONFLICT All resolutions or parts of resolutions in conflict with any of the provisions of this Resolution are hereby repealed. SECTION 4: SEVERABILITY If any portion of this Resolution is declared invalid,the invalidated portion shall be severed from the remainder of the Resolution, and the remainder of the Resolution shall continue in full force and effect as if enacted without the invalidated portion, except in cases where such continued validity of the remainder would clearly and without doubt contradict or frustrate the intent of the Resolution as a whole. SECTION 5: ADMINISTRATIVE CORRECTION This Resolution may be re-numbered or re-lettered, and/or corrected for typographical and/or scrivener's errors which do not affect the intent of said resolution, as authorized by the City Manager or designee,without need of public hearing, by filing a corrected copy of same with the City Clerk. SECTION 6: EFFECTIVE DATE This Resolution shall take effect immediately upon its adoption. W h, City Attorney EXHIBIT A Performance Evaluation Tally Form-City Manager All categories should berated on a 1 to 5 point scale,where 1 in"Unnaceptable",2 is"Below Expectations".3 is"Meets Expectations",4 is"Exceeds Expectations"and 5 is"Exceptional". Section 1. Charter Criteria Staffing&Supervision 1) Appoints and,when necessary for the good of the City,removes all officers and employees of the City,and appoint and remove subordinates in such department or office. To that end,develops and maintains a friendly and informal relationship with staff and workforce in general,yet maintains the professional dignity of the manager's office;sustains or improves staff performance by evaluating the performance of staff members at least annually,setting goals and objectives with them,periodically assessing their progress,and providing appropriate feedback. Fiscal Management 2) Prepares the budget annually and submits it to the council and is responsible for its administration after adoption. The budget is balanced to provide services at a level directed by Council;makes the best possible use of available funds,is conscious of the need to operate the local government efficiently and effectively;prepares a budget and budgetary recommendations in an intelligent and accessible format. 3) Prepares and submits to the council,as of the end of the fiscal year,a complete report on the finances and administrative activities of the city for the preceding year. 4) Keeps the council advised of the financial condition and future needs of the city and make such recommendations as may seem to him desirable. Meeting Attendance&Reporting 5) Attends all meetings of the City Council and of its committees and keeps the council advised of the activities of his office, with the right to take part in the discussions but without having a vote. Provides regular information and reports to the elected body concerning matters of importance to the local government;responds in a timely manner to requests from the elected body for special reports;takes the initiative to provide information,advice,and recommendations to the elected body on matters that are nonroutine and not administrative in nature;produces reports that are accurate,comprehensive, concise,and written to their intended audience;and produces and handles reports so as to convey the message that affairs of the organization are open to public scrutiny. Policy Execution (6) Performs such other duties as may be prescribed under this Charter or as may be required by him by ordinance or resolution of the City Council. Implements Council's actions in accordance with the intent of council as publicly communicated by the majority of Council;supports the actions of the elected body,both inside and outside the organization after a decision has been reached; understands,supports,and enforces local government's laws,policies,and ordinances;reviews ordinance and policy procedures periodically to suggest improvements to their effectiveness;and offers workable alternatives to the elected body for changes in law or policy when an existing policy or ordinance is no longer practical. Performance Evaluation Tally Form -City Manager (7) The City Manager may appoint a qualified person as purchasing agent,subject to approval of the Council,by whom all purchases of supplies shall be made subject to the rules and regulations to be prescribed by the Council and he shall approve all vouchers for the payment of same.In the capacity of purchasing agent,he shall also conduct all sales of personal property which the Council may authorize to be sold as having become unnecessary or unfit for the city's use.All purchases,sales and contracts shall conform to such regulations as the City Council may from time to time prescribe. RFP, RFQ,and RFB's are on time;contracts rarely need corrections;and internal purchasing procedures and Florida Statutes are followed. (8) Fix the salary of officers and employees according to the wage schedule approved by the City Council. Employees are paid fair wages and within the approved pay ranges. 9) City Manager shall be charged with the management and operation of all public works, charitable and correctional institutions and agencies of the City;subject to regulations prescribed by ordinance, and regulations relative to the preservation and promotion of public health;and manage or inspect water,lighting,power and transportation enterprises of the City;shall manage and control the use, construction,improvement,repair and maintenance facilities of the City,including parks,playgrounds and public gymnasiums,and social centers.He shall manage and supervise all public improvements, works and undertakings of the City except as otherwise provided in this Charter. Streets and city- owned facilities are clean,well maintained,and repaired efficiently.Capital Projects are appropriately budgeted and included in the Capital Improvement Plan. Effectively collaborates with Duke regarding Lighting. Section 2. Interactive Skills Individual Characteristics 10)Diligent and thorough in the discharge of duties;self-starter;exercises good judgement;displays enthusiasm,cooperation and willingness to adapt;exhibits the skills and talent for the position;and exhibits composure,appearance,and attitude appropriate for executive position. Professional Skill and Status 11)Maintains knowledge of current developments affecting the practice of local government management;demonstrates a capacity for innovation and creativity;anticipates and analyzes problems to develop effective approaches for solving them;willing to try new ideas proposed by elected body members and/or staff;and sets a professional example by handling affairs of the public office in a fair and impartial manner. Relationship with the City Council 12)Carries out directives of the Council as a whole as opposed to those of any one member;sets meeting agendas that reflect the guidance of the Council and avoids unnecessary involvement in administrative actions;disseminates complete and accurate information equally to all members in a timely manner;assists by facilitating decision making without usurping authority;and responds well to requests,advice,and constructive criticism. Performance Evaluation Tally Form - City Manager Intergovernmental Relationships 13)Cooperates with neighboring communities and the county; maintains a good working relationship with adjacent cities and County to accomplish regional issues or projects;cooperates with other regional,state,and federal government agencies to ensure legislative and funding priorities of the City are heard. Citizen Relations 14) Is responsive to requests from citizens;demonstrates a dedication to service to the community and its citizens; maintains a nonpartisan approach in dealing with the news media; meets with and listens to members of the community to discuss their concerns,and strives to understand their interests;and makes an appropriate effort to maintain citizen satisfaction with services. Community 15)Shares responsibility for addressing the difficult issues facing the community;avoids unnecessary controversy;helps the council address future needs and develop adequate plans to address long-term trends.
