ADJOURNED MEETING
--
An adjourned meeting of the City Council of the City
of Clermont was held in the office of the City Clerk on Tuesday -
December 19, 1961. The meeting was called to order at 7:30 P.M.
by Council Chairman Bishop, with the following Council members
present: Turville, Pool and Boyd. Other officials present were: :
Mayor BonJorn, Clerk Johnson, Deputy Clerk Carroll, City Attn'y.
Morse, Sup't. Sheldon, Inspector Snyder and Chief of Police Tyndal.
Others ~resent were: A delegation re~resenting the Clermont Mer-
chants Association~ Mr. Preston Maynard, Mr. F.B.Innis, and a
representative of the local Press.
The minutes of the regular meeting held Tuesday - December 5,
1961, the special meeting held on Monday - December 11, 1961 and
the adjourned meeting held on Thursday - December 14, 1961, were
read and approved as read.
Chairman Bishop stated that the first order of business
was the hearing of any objections to the proposed permanent
closing of the following described streets: ALMOND STREET,
West of Bloxam Avenue and East of State Road 50; SCOTT and
GOBLE STREETS, South of Highland Avenue and North of State Road
50. There being no objections, Chairman Bishop declared the
Hearing closed.
Jerry Egan, representing the Clermont Merchants Assoc.,
spoke to the Council thanking them for "bagging"the parking
meters during the holiday shopping period, and, for the paving
of the municipal parking lot, located between Vincent's 5~ to
$1.00 Store and Dr.Cantwell's building.
Councilman York entered the meeting at this time.
Dick Harris, representing the Clermont Merchants Assoc.,
along with a delegation of the membership, presented the Council-
with a petition from interested business houses requesting the
immediate and permanent removal of all parking meters. Several
members of the Merchants Association spoke in behalf of the pe-
tition. During the diwcussion of this matter, it was brought to
the attention of the delegation that the anticipated revenue from
the parking meters had been taken into consideration in the pre-
paration of this years budget, and their removal would therefore
create a shortage in anticipated revenue. Motion was then made by
Mr. Pool, seconded by Mr. Turville and carried, that the Council
take the request made by the Merchants Association, under con-
sideration. Mr. Harris thanked the Council for their consideration
in the matter and requested that the Merchants Association be re-
presented when final decision was made.
Mr. Frank B. Innis, representing the Citrus Tower Restau-
rant and Bar, requested permission from the Council for the bar
to remain open on Sunday night, December 31st, from 9 P.M. to
12 Midnight. Mr. Innis was advised that local Ordinances prevented
such permission. A discussion of the matter followed, and motion
was made by Mr.Pool to dis-regard the existing ordinance and the
request be granted. The motion died for lack of a second. Mr.Pool
then moved that City Attn'y. Morse be instructed to prepare.an
amendment to the existing ordinance whereby liquor bars would be
permitted to remain open on Sundays and Holidays. The motion was
seconded by Mr. Boyd and upon roll call vote the Ayes were: Pool,
York and Boyd. Nayes: Turville and Bishop. The motion carried as
made.

Mr. Preston Maynard appeared before the Council with the
following requests:
That DeSoto Street be opened from its present termination
through to Highway # 27. Mr. Maynard advised that the rough grading
would be done at his expense, but that he was requesting that the
City clay that part of the street in question. During the discussion
which followed, City Attorney Morse advised the Council that it was
his opinion that DeSoto Street had been closed at its intersection
with Highway # 27 at the request of the State Road Department, and,
that it would therefore be necessary to obtain their permission
before opening the street. Motion was made by Mr. Turville,
seconded by Mr. Boyd and carried, that City Attorney Morse de-
termine whether or not the street had been permanently closed
and if so, if the State Road Dep't. would grant permission for
its opening, the Streets Committee be authorized to make whatever
action they deem necessary upon the ruling of City Attn'y. Morse.

That he had written a letter to the Council for their
consideration at their Board of Equalization Meeting, calling
their attention to the fact that the property owned by him
on Montrose Street, adjacent to Attorney Morse's office, was
valued by the City on their tax roll for $21,400.00, which was
actually $6,400.00 more than the purchase price, and that he was
therefore requesting a reduction. Mr. Maynard further advised,
that the Board of Equalization had not made any reduction as re-
quested, although a similiar request to Hunnicutt and Associates
had been granted on the County tax roll, and in view of this
action on the part of Hunnicutt and Associates, he felt that the
City Council should make a reduction in the valuation on their
tax roll in order that it would be more in line with the County
valuation. Mr. Maynard was advised that inasmuch as the tax roll
had been accept~d and certified by the City Council, no reductions
in valuations could now be made, but that the matter would be re-
~ferred to Hunnicutt and Associates for their consideration and
recommendation with regards to the 1962 tax roll.
Police Chief Tyndal reported that he and Bldg. Inspector
Snyder had made inspections, as requested by the Council, of pro-
fessional offices and ants and crafts businesses, being operated
in residential zones, to determine whether or not the floor area
used for their office or business was in excess of 25% of the total,
and that with the exception of two minor instances, no violations
existed.
Inspector Snyder asked for a ruling as to whether or not
Fall-Out Shelters should be included on the Tax Roll for tax
purposes. Motion was made by Mr. Turville, seconded by Mr. York
and carried, whereby Fall-Out Shelters where used only for the
specific purpose of protection, should not be taxed.
Inspector Snyder advised the Council that Mr. P.C.Alexander
had taken out a building permit for the donstruction of a resi-
dence with the stipulation that the residence would be completed
within ten months from date of permit; that while a fihal inspectio
had not been requested, the ten months construction period of the
permit had lapsed and that the house was now being offered for sale,
and, that he would like a ruling as to whether or not this house
should be included on the 1962 tax roll. Inspector Snyder was
directed to make an inspection of the property, and have it placed
on the tax roll.

Motion was made by Mr.Turville that the proposed Ordinance
pertaining to Boat Houses, Docks, etc. be read the second time
by Title only. The motion was seconded by Mr. Pool and unanimously
carried.Thereupon the Ordinance was read a second time by Title
only. Motion was made by Mr. Turville that the proposed Ordinance
be read for a third time by Title only and placed upon its passage.
Upon roll call vote of Mr. Turgllle's motion, Mr. Boyd voted Naye,
and therefore the final reading of the Ordinance w~s tabled until
the next regular meeting of the Council.
City Attorney Mprse reqested a meeting with the Laws and
Auditing Committee at their earliest possible date, in order that
the drafting of a Planning and Zoning Ordinance, might be completed.
Councilman Pool asked the Council if it would be permissable
for children to operate GO-Karts and/or Soap Box vehicles on the
new addition of Lake Sgore Drive. Mr. Pool was advised to secure
a petition from abutting property owners to the effect that they
had no objection,and the Council would grant permission.
Motion was made by Mr. Turville, seconded by Mr.. Pool and
carried, that Sup't.Sheldon be issued a work order to repair
the sea wall at the Jaycee Beach.
Councilman Boyd reported that the boat ramp at the intersect~on
of Minnehaha Avenue and the west side ,of Lake Winona was in need
of repair. A work order was authorized for the installation of
a barricade until an inspection could be made and recommendations
made to the Council for repair.

Sup't. Sheldon reported that he hoped to have the eastern end
of Pitt Street sand-sealed within a week.
~ouncilman Boyd reported that the County engineer had advised him
that a 1" asphalt top would be sufficient for Hook Street, and
that he was of the opinion that it would be permissable for the
City to advertise for bids and bill the County for one-half of
the expense, when the work was completed. Mr. Boy~ was requested
te investigate the matter further and to obtain the County's
authorization in writing.
Mr. Boyd reported that Jim Stalnaker had requested that the City
lower and repair the side-walk on the west side of 8th street and
adjacent to his property. The Streets Committee was requested to
contact Mr. Stalnaker and determine what part of the expense he
was willing to bear inasmuch as a part of the work requested was
not repairs. The Streets Committee was authorized to proceed if
a satisfactory arrangement could be agreed upon with Mr.Stalnaker.
Clerk Johnson opened bids from Konsler Steel Company and Harry P.
Leu, Inc., on a welding machine. Motion was made by Mr. Boyd,
seconded by Mr. Turville and carried, that the low bid of $531.20
submitted by Konsler Steel be accepted and a purchase order issued
for same.
Clerk Johnson opened bids on two trucks with dump bodies. Motio~
was made by Mr. Pool, seconded by Mr. Boyd and carried, that the
low bid of $5795.00 submitted by Stalnaker Chevrolet Company, be
accepted and a purchase order issued for same.
Clerk Johnson read a proposal from E. M. Reynolds Company, quoting
a price of $650.00 on a Kelly Creswell Striping Machine. This
matter was tabled as funds were not ayailable.

Clerk Johnson read a letter from the Clermont Chamber of Commerce
thanking the City Council for financial assistance.
Clerk Johnson reported that the State Road Department had reported
that the plans and specifications for the traffic lite at 5th Street
and Highway # 50 did not include a manual control for pedestrians.
Clerk Johnson further reported that the additional cost would ap-
proximate $200.00. Clerk Johnson was requ~sted to write to the
State Road Department requesting an extension of the permit for
a traffic lite installation, until July 1, 1962 in order that
further investigation and consideration might be given as to the
actual need for the signal.
Clerk Johnson advised the Council that Mr. Nidy was of the opinion
that he should not be required to take out an occupational license
for the installation of the shuffle-board courts. Motion was made
by Mr. Turville, seconded by Mr. Pool and carried, that no ex-
ception be made and that Mr. Nidy be required to obtain the neces-
sary license and permit.
Motion was made by Mr. Turville, seconded by Mr. Pool and carried,
that payment for sefving on the Election Boards be authorized as
follows: Members serving during the day, $10.00 each, Members
serving at night,. $6.00 each.
Mr. Turville, Chairman of the Laws and Audit~ng Committee, pre-
sented for passage a proposed ordinance, the same being AN ORDI-
NANCE ADOPTING AND ENACTING A NEW CODE OF ORDINANCES OF THE CITY
OF CLERMONT, FLORIDA: ESTABLISHING THE SAME: PROVIDING FOR THE

REPEAL OF CERTAIN ORDINANCES NOT INCLUDED THEREIN: THE MANNER
OF AMENDING SUCH CODE OF ORDINANCES: A PENALTY FOR THE VIOLATION
THEREOF: AND PROVIDING WHEN THIS ORDINANCE SHALL BECOME EFFECTIVE.
The Ordinance was read in full the first time, and the Chairman
referred the same to the Laws and Auditing Committee. ~~.Turville,
Chairman of the Laws and Auditing Committee, stated that the Ordi-
nance had been prepared by his Committee at the direction of the
Council and asked that same be taken up at this time. Mr.Turville
moved that the rules be waived and that the Ordinance be read the
second time by title only. Mr. Boyd voted "Naye" on the motion
and the second reading was then post-poned until the next regular
meeting of the Council.
Motion by Mr. York, seconded by Mr. Pool and carried, that
meeting adjourn.
