01-20-1956 Regular Meeting ADJOURNED MEETING -- An adjourned meeting of the City Council of the City of Clermont was held at the city hall, Friday, January 20, 1956. The meeting was called to order at 7:00 P. M. by vice Chiarman, Harold Turville, with all council members being present with the exception of Mr. E. G. Winston. Others present were Mayor Boyd, City attorney Morse, Supt. Sheldon, Mr. D. G. Rambo, Mr. Claude Teachout and Mr. Shelb. The minutes of the meetings held January 3, 1956 were read and approved as read. Mr. Shelb requested information relative to the paving of King and certain parts of Drew street as per a previous petetion of roperty owners. Mr. Shelb was assured that the matter would have the immediate attent ion of the Street s committee and that he, and other interested property owners, would be advised of the approximate cost in the very nGar future. Mr. D. G. Rambo requested that the Council waive the usual license fee, and grant permission, for the V. F. W. to operate their annual fair from January 30 through February 4th. Motion was made by Grant, seconded by Meeker and carried that such permission be granted and that the license fee be waived. Mr. Beals reported that the Councty had completed the claying of the road to the city dump, and that the city had steeet lights installed at DeSoto and Prince Edward streets. After some discussion Mr. Sheldon was instructed to contact ~ Mr. Winston and for them to agree on a location for the altitude valves for the new water tank and to have such valves installed as soon as possible. The matter of trading certain properties with Mr. Bauerle for cemetary expansion was discussed. The cemetary committee and Mayor Boyd were appomnted to contact Mr. Bauerle and endeavor to make some sat sfactory trade. Mr. Grant offered, and moved that it be passed AN ORDINANCE AMENDING SECTION 5 OF CHAPTER XXIV OF THE REVISED GENERAL ORDINANCES OF THE CITY OF CLERMONT; PROVIDING FOR THE CONSTRUCTION AND REPAIRS OF SIDEWALKS IN THE CITY OF CLERMONT; PROVIDING FOR THE PAYMENT AND COLLECTION OF COST OF SIDEWALK REPAIRS; PROVIDING OTHER MATTERS RELATING THERETO; PROVIDING FOR EFFECTIVE DATE OF THE ORDINANCE AND PROVIDING FOR PENALTIES FOR VIOLATIONS HEREOF. -- The motion was seconded byUr. Meeker and unanamously carried. Mr. Meeker then moved that the rules be waived and that the Ordinance be read the second time by title only. The motion was seconded by Mr. Beals and unanamously carried. After the second reading of the Ordinance, by title only, Mr. Beals moved that the rules be further waived and that the Ordinance be placed upon its passage. The motion was seconded by Mr. Meeker and unanamously carried. Thereupon the Ordinance was read the third time and upon roll call vote the ayes were Turville, Grant, .Meeker and Beals. Nay: none. Absent: \oJinston. The Ordinance passed, title as stated, and was ordered recorded in the Ordinance book and numbered 145. A copy in full appears immediately following these minutes. The matter of haUling trash and the possibility of making charge s for such services was discussed. The matter was reffered to the Sanitation Committee for further study and recommendations. -- Mayo>> Boyd stated that Mr. Martin was considering the construction of a new theatre in Clermont with adjoining parking lot. Mayor :Boyd further stated that Mr. Martin Ilesired to make this parking lot available to the general public, when not in use by his customers, and that in return the city make certain concessions such as free taxes, maintenance and so forth. Members of the council did not appear to be of the opinion that Mr. Martin would be entitle to such advantages as recommended by the Mayor and that certainly they would not commit themselves until they were informed where the theatre was to be located. Mayor Boyd recommended that the city procure on a lease- purchase basis a new Street Sweeper. The matter was tabled. Mayor Boyd recommended that additional Shuffle Boards be bui18 at Kehlor park and suggested that the Parks Committee investigate the matter. No action taken. Mayor Boyd requsted that the City pay for the installation of new awnings for his office. The matter was tabled until the next Council meeting. Mayor Boyd recommended that a sidewalk be built along the East side of Eighth street from the existing sidewa lk to the entrance of South Lake Memorial Hospital. The matter was referred to the sidewalks Committee. Motion by Meeker, seconded by Beals, that inasmuch as the amount of exemption allowed for Household personal property valuations would be increased to $1,000.00 for 1956, and that inasmuch as the large majority of the returns filed were for ~>l,OOO.OO, or less, and therefore exempt, that the Tax assessor be advised that it will not be necessary for her to mail blanks for the return of Household Personal property valuations for the taxable year of 1956. Motion carried. Motion Beals, seconded by Grant that bills be paid. Clerk Johnson informed the council that the tennants of the city owned residence on Eighth street had agreed to do certain painting on the inside of the house in question, providing the city would furnish the paint. Motion was made by Grant, seconded by Beals and carried, that Su pt. Sheldon purchase the necessary paint for the foregoing reque st. Clerk Johnson read a letter from the local Chamber of Commerce wherein the Chamber stated that they were having trouble gett1.ng permission from the State Road department to locate a directional sigg at the intersection of Highways 50 and 27. Mayor Boyd was reqaested to investigate the matter. Mr. Beals requested that the Mayor request certain business fir~s to clean up and 'tbraighten up the properties in the rear of their businesses. Mayor Boyd agreed to do so. -- Notion by Beals, seconded by Grant and carried that the execution of leases for the city owned buildings on Eighth street be held up until next meeting. Motion Grant, seconded Meeker that meeting adjourn. BE IT ORDAINED AND ESTABLISHED BY THE CITY COUNCIL OF THE CITY OF CLERMONT: SECTION I: That Section 5 of Chapter XlIV of the Revised General Ordinances of the City of Clermont be amended in full to read as follows: ~ Section 5. Whenever the Street Committee shall .deem it necessary that a sidewalk be constructed in front of any property, or adjacent to any property; or whenever the Street Committee shall deem it necessary that any sidewalk be repaired, the Street Committee shall make recommendations to the City Council for the construction or repair of such side- walk or sidewalks, and the Council shall act upon such recomm- endation and order the construction or repairs or both, as recommended in the following manner: (a) SIDJ:1:JALK CONSTROCTION: In the case of original or new sidewalk construction the City Clerk shall notify in writing the owner or agent of the owner of the property affected to have the sidewalk constructed, in accord- ance with the specifications as set forth in the notice, within sixty (60) days from date of the notice. This notice shall be served by the Marshal (ehief of Police or Policeman) of the City of Clermont, who shall serve same by delivering the original to the owner or his agent, and shall certify to such service on a copy thereof, returning same to the City Clerk. If the owner, or his agent, cannot be found, or does not reside in the City, the notice shall be served by mailing -- same to the owner by Registered Mall to the last known address of tn$ owner.
