BOARD OF EQUALIZATION AND REGULAR MFETING

The city Ceuncil ef the city of Clermont sat as a
Board ef Equalizatien on Tuesday, September 1, 1953.
The BGard of Equa1izatien was called terrerder at
7:30 P. M. with all its members present.
Admiral Perry and William Bw,yd appeared befere the
board as asked for reductiens in valuations ef certain
of their respective properties. They we informed that
their requests would be considered and that they would
be informed of the Boards action at a later date.

There being no further complaints tor the cGnsideratien
of the Beard the meeting was adjourned.
A Regular meeting of the city Ceuncil of the city et
Clermont was held at the city hall Tuesday, September 1,
1953.
The meeting was called te order by Ceuncil President
Arthur George at 8:00 P. M. with all council members
present. Others being present were Mr. Sam Sanger,
Mr. W. H. McQuistion and Mr. Hev!ard yeung as visitors
and City atterney Morse, Supt. Sheldon, Police chief
Bre.ks and Mr. Stimpsen of Bumby and Stimpson Censt.
Company.
The minutes of the regular meeting held August 18, 1953
were read by the clerk and approved as read.
Mr. Stimpson was called upon to answer certain questiens
pertaining to the propositien ef his company made to the
city fer the sand-sealing or certain city streets.
After some discussion relative to the matter motion
was made by Mr. Meeker that the city of Clermont enter
into a cGntract with Bumby-Stimpson Construc~ien company
for the sand-sealing of oity streets, in an ameunt ef
$?,500.00 and that said amount be paid from the current
budget. The metien was seconded by Mr. Winston and
when put to a vote unanamously carried.
Mr. Stimpson and the council then discussed the matter of
the paving ef Ventrose street from East avenue for a
distance of 160 reet West. This matter was referred te
the streets committee with the power to take the necess~ry
action witheut reporting back to the council.
Mr. Meeker stated that he was receiving numerous complaints
regarding the tall grass and weeds on city streets, lots
and parks and that he was of the opinion that with the
present city crews and eqUipment it would be 1mpossible
to remedy the situation. Mr. Meeker recommended, and so
moved, that the city immediately purchase a tractor and
rotary mewer at an approximate cost ef $2,200.00 and that
such amount be placed in next years budget for the payment
or same. The motion was seconded by Mr. Konsler.
Mr. Winston was epposed to the purchase and requested a
roll c 11 vote. Upon roll call the vote was as fellews:
Ayes: Meeker, Konsler and Sickler. Nay:W1nsten.
Net veting: George. The motien was carried and the
streets Cemmitte. were empowered to make the required
purchase.
In the absence of Police chier Brooks Mr. George
submitted the Pelice chief's report. The same was
accepted and ordered filed.
Clerk Bohnson informed the Council that Mayor Higby
was not feeling well and therefore CQuld not attend the
meeting. Clerk Jehnson gave a report en the securing
og ~rad1ng permits from property owners abutting
highway 50, as submitted to him by Mayor Higby.
Supt. Sheldon recommended that the six inch water main
new ending in front of Clermont Builders Supply, be
extended tG 12th street and that two additional fire
hydrants be installed between West avenue and 12th
street.

Mr. Winston moved that the recommendatiGns of Mr.
Sh€ldon be carried out and that the six inch water main
be extended to 12th street and that tw~ .ire hydrants
be installed as recommended. The motien was seconded
by Mr. Sickler and when put tG a vote unanamously carried.
Motion was. made by Meeker, seconded by Konsler and
carried that the written applicati~n ,~ Curtis H. Snair
ror a duplicate of Tax Sale Certiricate numbered 16,
ror 1947 taxes en lets 7, Bl~ck 130, Indian Hills,
be granted and that the members of the council execute
the necessary ferms.

Motien by Kensler, seconded by Sickler that the ctty
purchase a new cotten American flag. Motion carried.
Clerk Johnson read a letter from Edith Reya1, of the
Royal Dancing School, of Winter Park, wherein she
requested permission to use the community building
for dancing cl~sses again this year. Mrs. Royal
thanked the council for the use of the building in the
past and erfered to pay three dollars weekly for its
use this year.
Motien was made by Mr. Winston, secGnded by Mr. Sickler
that the Rera1 Dancing school be offered the use of
the community building for a fee of six d.llars per
day, with the definato understanding that the building
would be ava:llable to them only Friday .illy and that
the classes must be terminated not later than 6 .'clock
P. M.. Upon being put to a vote the motion carried.
Mr. McQuisti~n made a brier report .n thw work being done
by the Zoning commico ion.
Mr. Meeker ~ffered, and moved that it be passed, AN
ORDINANCE PERMANENTLY CLOSING AND VACATING HIBISCUS
STREET LYING NORTHERLY OF SUNNYSIDE
DRIVE AND SOUTHERLY OF HIGHLAND AVENUE, ALL ACCORDING
TO A MAP OR PLAT OF SUNNYSIDE UNIT, CLERMONT HEIGHTS,
FILED FOR RECORD ON 3/11/26 AND RECORDED IN PLAT BOOK
8, PAGES 66 and 67, PUBLIC RECORDS OF LAKE COUNTY, FLORIDA;
PROVIDING FOR THE REVERSION OF SAID LANDS TO THE ABUTTING
PROPERTY OWNERS; PROVIDING FOR OTHER MATTERS RELATING
THERETO.
Which Ordinance was read in full. The motion was seconded
by Mr. Sickler and upon roll call vote was unanamously
carried.
Mr. Sickler moved that the rules be waived and that the
Ordinance be read the second time by title only.
The motien was seconded by' Mr. Winston and upon roll call
vone was unanamously oarried. Af'ter the second r~ding,
by title only, Mr. Kenlser moved that the rules be
further waived and the Ordinance be placed upon its
passage. The motion was secGnded by Mr. Meeker and upon
roll call v.be unsnamously carried. Thereupon the
Ordinance was read in full and upon r 11 call was
unanamous1y carried. The Ordinanoe was passed, title
as stated and ar~e:.d recarded in the Ordinance beak

Metion was made by Meeker and seconded by Konsler
that the Chairman of the council and the city clerk
be authorized and instructed to execute the several
Grading Permits relative to abutting property owned
by the city along state Road 50. Metion carried.
Metion by Meeker, seconded by Winston that the bills
be paid.
Attorney Morse read a letter frem Mr. Vernon Brice
to the effect that he was not rinancially able to
pay the cost or the sidewalk repairs charged to him
at this time but that he would do so not later than
ninty days from this date.
:a~r. Winston moved that Mr. Brice be given an extension
of nlnty days in which to pay for the sidewalk repairs
in question. The motion was seconded by Mr. Konsler
and upon being put to a vobe unanamously carried.

WHEREAS, the State Road Department of the State of Florida,
a component agency of the State of Florida, has surveyed, located
and propo$es to construct State Road 50, Section 1107, through'
Clermont, Floxida, with said state road to be con.tructed ovex,
through and across said Hibiscus Street in an easterly to westerly
direction; and,
WHEREAS, the gxade on said Sunnyside Drive i. many feet
lower than the grade of Highland Avenue and the contour of the
land on which Hibiscus Street haa been laid out on the above des-
cl:ibed plat is such that the const:ruction of State Road 50 ove:r,
through and aCross Hibiscu. Stxeet would make it impossible fox
those entering said Hibiscus street from Highland Avenue to cross
said State Road 50 and drive on said Hibiscus Street to said Sunny-
side Drive and likewise because of the grade const:ructlon of State
Road 50 it would be impossible for cars to travel on said Hibiscus
Street from Sunnyside Drive to Highland Avenue aftex the eonetxuction
of said road; and,
WHEREAS, said Hibi8CUS Street has been paved but the:re being
no homes located on the lots abutting Sunnyside Drive or any pOrtion
of the lots 0% blocks lying inrnediately North of Lake Sunnyside Drive
and South of said Highland Avenue, and, it is found necessary by
the State Road DepeztNftt of Florida that said Hibi8CU, street be
permanently closed .nd the traveling public be restricted from
using .aid street# and afte:r due consideration by the City Council
of the City of Clermont said City Council finds the foregoing facts
to be true and that .aid st:reet should be permanently closed and
abandoned and that the property lying within the boundaxies of said
Hibiscus Street South of Highland Avenue and North of Sunnyside ~ive
should revert to and become the prope:rty, in equal portion., of the
ownex. of the property abutting said street on the easterly and
westerly bounda:ries thereof, LESS the right of way fox said State
Road 50~
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CLERMONT1 FLORIDA.

lid. Unit, ClerMont Heights, filed fox xecoxd on 3/1~26 and recorded
in Plat Book 8, pages 66 and 67, public records of Lake County, Plo~id.,
be and the s.me 1s hereby forevel: closed as a street in the City of
Clermont and that laid stxeet is hereby permanentlr vacated and can-
celled on laid plat and the general traveling publ c i8 he:reby forever
restricted f:rom the ule of said Hibiscus St:reet as a general thorough-

and become the property of the abutting property owners, to-wit:
Lots I and 38 of Block 7, according to said plat of SUnnyside Unit,
Clermont Heights, with the owner o:r owners of Lot 1 acquiring and
having reverted to them the North half of East half of said Hibiscus
Street, LESS ri9ht of way for State Road 50; and, the owner or owner.
of Lot 38 of sa1d Block 7 ahall have reverted to them and become the
owner or owners of the South half of East half of said Hibiscus
Street, LESS :right of way for State Road 50; and, that the westerly
portion of said st:reet, LESS :right of way fo:r state Hoad 50, shall
revert to and become the p:roperty of the abutting property owners,
to-wit: Lots 1 and 49 of Block 9 according to said plat of Sunny-
side Unit, Clermont Heights, with the owner or owners of Lot 1
acquiring and having reve:rted to them the North half of ~~st half
of said street LESS ::right of way fo::r state Road ~Oi and, the owner
or owners of Lot 49 of said Dlock 9 shall have reverted to them and
become the owner or owners of the South half of West half of said
Hibiscus Street, LESS right of way fo::r State Road 50; and, that from
this date on the respective owners, of the lots in the respective
blocks to which that po::rtion of the easterly and westerly halves
less the ::right of way for State Road 50 have :reverted to and become
the property of, are hereby placed in full possession, control and
ownership of sa1d property with the right to sell, mortgage, lea..
or otherwise dispose of said premises the same as if they could,
had they originally owned said lands and said lands had not been
laid out and platted on said map or plat as a street for the general
use of the traveling public and had not been so improved by paving.
~ That a certified c~y of this ordinance be filed
of re~e public records of Lake County, Florida, and that
hereaftez the tax assessor of the City of Clermont do, beginning
with January 1, 1954, assess those portions of sa1:4l Hibiscus Avenue
lying South of Highland Avenue.and North of Sunnyslde Drive,less
right of way for State Hoad 50, as hereinabove more specifieally
described, to the owner or owners and their successors in title
thereto the same as if said HibiscU8 Street had never been laid
out, platted and improved as a public street.
~ect~on 4~ This ordinance shall take effect immediately upon
its passage an approval by the A~yor in accordance with the Charter
and ordinances of the City of Clermont and the laws of the State of
Florida and that this ordinance is passed and the above and within
named street is he:reby permanentlr closed and discontinued under and
by authority of Chapter 167.09, F orida Statutes 1951 and all amend-
ments thereto. '
