12-12-1951 Special Meeting ~ .., .~ ., ~ Minutes of Special Meeting December 12, 1951 A special meeting of the City Council of the City of Clermont sitting as a Board of Canvassers pursuant to notice given to all was held in the City Hall on Wednesday, December 12, 1951, at 7:00 . P.M. for the purpose of canvassing the returns of the genexal elect10n of the City of Clermont held on December 11, 1951. The meeting was called to order by Preisdent E. G. Winston and other councilmen present wexe T. C. Cork, Jr., and B. K. Ferguson. Also present were A. M. Johnson, city Clerk, and Irving F. Morse, City Attorney. After examining and canvassing the returns an~ the certificate of xesult of election it was declaxed by the Canvassing Board that the following officers were duly elected: H. R. Harper, Mayor for one year; Ross Cantwell, Treasurer for one year; George M. Nagel, Tax Assessor for one year; and the Canvassing Board further declared that it appeared that there was some question regarding the election of councilmen in view of the fact that one of the candidates, Arthur L. George, was not a registered voter and it was recommended to the City Council that they inquire as to the legality of the election of councilmen and if the ineligibility of one of the candidates would void the entire ballot. There being no further business to come befor~ the City Council as a Canvassing Board, it was adjourned and the meeting was called to order as the City Council by President Winston and to the members of the City Council was presented the certificate of election and the report of the City Council sitting as a Canvassing Board, and upon motion duly made and carried, it was declaxed that ~. R. Harper ~as elected Mayor, Ross Cantwell fox Treasurer, and George M. Nagel for Assessor, each to serve for a period of one year, or until their successors were duly elected and qualified. Upon further consideration of the ineligibility of one of the candidates for City Council, the advice of the City Attorney was asked and he advised the Council that in his opinion the election of the Mayor, Treasurer and Assessor was a valid election but that it was questionable as to 'the election of the members to the City' Council, they being elected at large, there was a possibility that it would be declared that ,the el~ction was a nullity as to the City Councilmen and for that reason he believed that a special election for the purpose of filling the vaoancies on the City Council should be held. Upon the opinion of the City Attorney it was decided that the Mayor be directed to call a special election as soon as possible' for the purpose of electing two councilmen to serVe from the date of their qualification and election to and including December 31 1953, or until their successors are duly elected and qualified. ' Motion duly made and seconded that the certificate of result of election as to all officers except councilmen be accepted and made a part of these minutes and that the officers duly elected, they being Mayor, Treasurer and Tax Assessor, do assume the duties of their respective offices in January, 1952.
