11-06-1951 Regular Meeting ~ -.., ~ 'WI' ...... loa ~ I ..a '" ~ 1 fj ~!: ~~~ "'t REGULAR MEETING A regular meeting of the city Council was held at the city hall, Tuesday, November 6, 1951, at 7:30 P. M. The meeting was called to order by Council President, E. G Winston with the following members present: T. C. Cork, Jr., B. K. Ferguson, W. H. McQuistion ~nd Arthur George. Also present were Mayor George Nagel, ,City attorney Irving Morse, Building Inspector and Fire Chief 'A. L. Shwldon, city foreman J. B. Fullwood, police officer Brooks, Mr. Crowe and Mr.~ of Black Laborooaies and Mr. Sheppard Sr. & Jr., city auditors. Mr. Crowe explained the proposed contract to be used in the offer for bids on the digging of a new well. He further stated that the city should make application to the State Board of Health for approval of the proposed plans. JV:otion by Ferguson, seconded by Me!1lijistfu9nthat Black Labortories proceed with such application. Motion carried. The,application was then signed by council President E. G.' Winston and Clerk A. M. Johnson, and turned over to Mr. Crowe for completion and mailing. Motion by Cork, seconded by Ferguson that Black Labortories procee~ with plans for the ~nstallation of controls on the "booster pump", installation of altitude valve on existing tank,and addition of water meter, draw-down gauge on existing wells. 'Motion carried. Mr. Sheppard stated that in going' into the matter of unpaid paving liens and delinquent taxes he had discovered that the city records were in such condition, for the years prior to 1935, that it would take so much time for his firm to do the job that the cost would be excessive. He proposed that as an alternative that he be authorized to check the county records, and the city lien records, and then to mail audit letter to the owaers of property where liens apparently existed. Motion by McQuistion, seconded by George, that Mr. Sheppard proceed as, he had outlined and suggested. Carried. ' ~ .No committee reports. Mayor Nagel recommended that the city haul some of the' broken curbing from the .roller coaster highway for various' uses around. the city and partictularly for use at the J. C. Park. No action taken. Mayor Nagel again called the Councils attention to the serious "Stray Dog" situation and told them that it was imperative that some .steps be taken to remedy this matter. Motion by Ferguson, secon~ed by Cork, that Mayor Na.gel be authorized to proceed with the erection of a dog pound at some suitable location, and that the city Ordinance regarding this matter be inforced. Carried. Mayor Nagel further recommended that the city engage a crew of men to be used on street repairs, and that an additional pqlice officer be engaged. .Motion by Cork, seconded "by George, that ~Ir. Fullwood be authorized to hire two additional men for the street department, and that these additional men be used for repairing and cleaning streets when ever practmcal. Carried! Fire chief Sheldon asked for permission to order the fire hose and fire equipment as setforth in this years budget. Motion Cork, seconded by Ferguson that Mr..Sheldons request be granted and that he be authorized to purchase fire hose and fire equipment as set forth in the budget. Motion carried. tJ ~ .., Mr. Sheldon reported that Mr. Carico had started the foundation for a house on the .comer of Montrose & tenth streets, located on lot 12, block 96, which was nearer to the street that the side yard requirements allowed under the building ordinance. He furtJ er stated that Mr. Carrico was of the opinion that the city had understood and agreed that he was to build three houses "thi's p~rt of town and that they had issued him a building permit to do so. He further called their attention to the fact that it would be impossible for him ,to set back the required footage from the street and at the same time have the required footage between his houses. Motion by George, seconded by Cork, that as Mr. Carrico had apparently been led to beleive that he could build the houses as explained and as he had been issued a building permit to do so, that he be allowed to complete the house.on the location as started. Motion carried. Motion by Cork, s,econded by Ferguson that the city clE'rk proceed with securing bids for the heating of the .city hall with the oil fired low pressue steam method. Motion carried. Motion by McQuistion, seconded by Cork that the city clerk secure bids on a fogging machine. Motion carried. Motion by Ferguson, seconded by McQuistion that the city have the Florid.a Power Corporation install a street light on Minneola Avenue, between'4th and 5th streets, Motion carried. Motion by Cork, seconded by Ferguson that the bills .be paid. Carri: Motion by George, seconded by Ferguson, that the city deliver a deed to H. K. Hooks, for lots Block. Motion .carried. Motion by McQuistion, seconded by George that the 2i inch stand pipes be replaced at Chestnut and second and in front of the Jessee Whitney property on 12th street. Motion carried. , Motion by Cork, seconded by George that Hunnicuts~ & Associates offer of an adjustment on our accou~t with them be accepted and that they be paid the balance due them. Motion carried. Motion by George, seconded Cork that Hunnicutt & Associates be informed that the city is terminating their contract with them as of November 8th., 1951. Motion carried. Mr. George 'submitted a bud.get for the fiscal year 1951-52', and moved its adoption. The motion was seconded by Mr. Ferguson and upon being put to vote was unamamously carried and ordered that a copy be placed in the Ordinance and Minute books of the city. Mr. McQuistion introduced and moved that it be passed, "AN ORDINANCE PROVIDING A TAX LEVY ON ALL PROPERTY IN THE CITY OF CLERMONT, LAKE COUNTY, FLORIDA, FOR THE YEAR 1951;. PROVIDING A BUDGET OF EXPENSES FOR THE FISCAL YEAR OF 1951-52 AND MAKING APPROPRIATIONS THEREFOR" .~ .., which Ordinance was,read in full. Motion 'seconded by Mr. Cork, and.when put to a vote carried. Mr. Ferguson then moved that the rules be waived and the Ordinance read the second time by title only. The motion was seconded by Mr. George and unanamously carried. After the second reading Mr. McQuistion moved tha.t the rules be further waived and that the Ordinance be read the third time and placed upon its passage. The motion wa.s seconded by Mr'. Cork and wh~n put to a vote unanamously carried. Thereupon the Ordinance was read in full the third time and upon its passage the roll call vote was as follows: Ayes: Winston, George, McQuistion, Cork, Ferguson. Nayes none. Absent : none. So the Ordinance was passed, title as stated, and ordered placed in the Ordinance book and numbered Ordinance 103. A copy in full appears in this book following these minutes. ~. Clerk Johnson stated that a request had been made for the, use of the Council room for a "small claims" court, once or twice monthly. No objection was expressed. Clerk Johnson sta,ted to the council that he had had a few co~plaints regarding the new garbage disposal rates. That some people did not think that the charges should be made when apartments were not in use and that others did not think, small office building should be included. It did not appear .to be the sense of the council that any changes should be made. Cberm Johnson called the councils attention to the fact that they had not approved the classification and rates for business house garbage pick up. As t~e hour was late it was decided to table this matter until the next meeting. Clerk Johnson informed the council that several firms were operating within the city without Occupational Licenses, and that the dead-line set for October 31 had been passed. The matter wEls turned over to Mayor Nagel for enforcement. Motion by Cork, seconded by McQuistion, that the meeting adjourn and that the Council go into an Executive session. Motion carried EXECUTIVE SESSION. Mr. Nage was authorized to engage the servmces of Mr. as a police radio operator. Mr. /J.e.RNliPrR, Was to be hired at once and to serve on the police force until such time as the radio room and living quarters were ready .for occupancy.
