O-356-CCity of Clermont Ordinance No. 356-C AN ORDINANCE OF THE CITY OF CLERMONT, LAKE COUNTY, FLORIDA, AMENDING CHAPTER 26, "ELECTIONS", SECTION 26-2, "NOMINATING PETITIONS; FILING", OF THE CODE OF ORDINANCES OF THE CITY OF CLERMONT, LAKE COUNTY, FLORIDA, RELATING TO THE QUALIFICATION PERIOD FOR MUNICIPAL ELECTIONS; REPEALING ALL ORDINANCES IN CONFLICT HEREWITH; PROVIDING FOR SEVERABILITY; AND PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, Florida Statute Section 100.3605, Conduct of Municipal Elections, provides that the Florida Election Code shall govern the conduct of a municipality's election in the absence of an applicable special act, charter or ordinance provisions; and WHEREAS, Florida Statute Section 99.061 of the Florida Election Code, was recently amended to provide that the qualifying period for candidates to elected offices other than municipal offices shall occur earlier than that as set forth in the City of Clermont Code of Ordinances; and WHEREAS, the City of Clermont typically contracts with the Lake County Supervisor of Elections to administer municipal elections as needed in accordance with applicable law; and WHEREAS, it is in the best interest of the City of Clermont to provide for an earlier qualifying period and to avoid confusion with inconsistency in applicable elections laws and thus amend Section 26-2 of the City Code to be consistent with Florida Statute 99.061. NOW THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CLERMONT, LAKE COUNTY, FLORIDA, as follows: SECTION 1: Section 26-2 entitled "Nominating Petitions; Filing" of the Code of Ordinances of the City of Clermont, is hereby amended to read as follows: Sec. 26-2. Nominating petitions; filing. Candidates for any elective office shall qualify by a petition signed by at least 25 qualified voters and filed with the City Clerk during a qualifying period beginning at 12:00 noon on the 71St day prior to the first primary and ending at noon the 67th day prior to the date of the first primary as prescribed in the State Statutes or by City Council. The petition shall also contain, or have affixed thereto, the candidate's acceptance of the nomination, which shall also contain a statement that, if elected, he or she will so serve. If not a part of the petition, the city shall omit his or her name from the ballot. All candidate petitions shall be preserved by the City Clerk for six months after the date of the general or special election. Page 1 City of Clermont Ordinance No. 356-C SECTION 2: All Ordinances or parts of Ordinances in conflict herewith are hereby repealed. SECTION 3: Should any section or part of a section be declared invalid by any Court of competent jurisdiction, such adjudication shall not apply to or affect any other section or provision of this Ordinance except to the extent that the entire section or part of a section may be inseparable in meaning and effect from the section to which such holding shall apply. SECTION 4: This Ordinance shall be published as provided by law and shall become law and shall take effect on the date of its Second Reading and Final Passage.
