RESOLUTION CONFIRMING ASSESSMENT ROLL
WHEREAS, R. F. House, Tax Assessor of the City of
Clermont, has completed the Assessment Roll of all real and
personal property within the City of CleDnont forthe year 1949
and presented same to the City Council; and,
WHEREAS, pursuant to a due and legal notice as :reo.
quired by the charter and ordinances of the City of Clermont,
the said City Council did give notice that it would sit as an
Equalization Board at the City Hall in Clermont, Florida, at
8:00 P.M. on August 16, 1949, for the purpose of hearing com-
plaints as to the said assessment roll and equalizing and con-
firming the same, and at such meeting the said City Council,
sitting as a Board of E~ualization, did hear all complaints,
and did adjust and equalize the said Tax Assessment Roll and
the same is now equalized and adjusted, therefore,
BE IT RESOLVED by the City Council of the City of
Clermont that the Assessment Roll of the City of Clermont, for
the year of 1949, as prepared by R. F. House, ,Tax Assessor of
the City of Clermont, and as equalized by the-City Council sit-
ting as a Board of Eaualization, be, and the same is, hereby
ratified, approved, and confirmed.

AN ORDINANCE AMENDING SECTIONS 2, 5 and 7 OF
CHAPTER XI OF THE REVISED GENERAL ORDINANCES
OF THE CITY OF CL[R'JIONT BEIATING TO OC(,1)PATIC>>JAL
LICENSE TAXES OF THE CITY OF CLEaMONTi PROVIDING
FOR THE PAyr.~ENT ('F PERSONAL PROPERTY TAXES PRIOR
TO THE PAYMENT OF OOCUPATIONAL LICENSES i AND
OTHER MATTERS RELA 1ING THERETO.

SECTION I. Thai Section 2 of Chapter XI of the Re-
vised General Ordinances or the City of Clermont passed by the
City Council on 6 June 1928 and approved by the Mayor of the
City of Cle:rmont on 19 June 1928 shal.l be amended to read as
follows I
Section 2: No person, firm or corporation
~hall engage in or manage any business, profession or occupation
mentioned in this act within the City until after a license shall
be issued to each person, firm or corporation on receipt of the
amount hereinafter provided paid to the City Tax Collector, who
shall issue all licenses, nnd shall have pa.ssed any qualification
exarndnation which shalJ be prescribed by the City Council of the
City of Clerrront.
fvery person engaged in the business of
contracting in any of its branches shall pay an occupational
license as provided in Section 7 hereafter. A person who does
all the work himself wi,th no efllJloyees, helpers, or partners shall
not be required to obtain an occupational license, except th~se
specific occupations or trade$ for which an occupational license
shall be ~quired under Section 7 hereafter.
Contractor, as used in this ordinance and in
Sections '2 and 7 hereof, shall embrace any person, firm or Curp-
oration, who I for a fixed price" corrmission, fee or wage fl offers or
bids to alterl construct, install, or repair or otherwise work on
any building, foundation,; pavement, sidewalk, sanitary disposal
or drainage system, grading, bridge, culvert, wa~er systems, water
tanks or towers, docks, d~ms, power (electric or g&s) plants in-
, eluding transmission lines, or any part of those spe<:ifically
listed herein.

Anyone exercising independent employm<<ent
shall be termed an independent cont..cactor~ but under this ordi-
nance the test to determine ~hether one ~no renders service to

another does so as a contractor or not is to ascertain whether.
he renders the service in the course of an independent occupation
representing the will of his errployer only as to th~ result of
hie. work and not as to tile means by which it was accurnplished~
SECTIC!II II. That Section 5 of Chapter XI of the RI!o.
vi&ed General Ordinances of the City of Clermont as passed by the
Ci ty Council of the City of CIennone on 6 June 1928 and approved
by the Mayor of said city on 19 June 1928 shall be amended 8$

Section 5t No occupational license shall be
is~ued to any person, firm or corporation to engage in or manage
a~y business, profession or occupation within the City of Clermont
unless all perscne-.l pro~)erty taxes levied and assessed by the City
of Clermont against all personal property pertaining to or used in
connection with said business, profession or occupation,. sf!all have
b&en paid in full.
Said personal property taxes to be paid by
s.id person, firm or corporation shall be such pcrsor.al property
I taxes as aJ:e due and payable to the City of Clermont by said
person, firm or corporatIon as of the dute of the issuance of
s~id occupational license.
When more than one classified business i$

operated by one person, firm or corporation and within the bound...
aries of one establishment or place of business, then a license
tax provided for in Section 7 hereaftor for only the higher classi-
fication shall be required, provided the higher classifieation
shall provide a minimum license of $20.00.
That all confirmed cripplos, deaf and dumb,
invalids and those being 65 years of age and over with not more
than $500.00 of their own capital invested in a business and
haviJtlg no more than one employee shall not be required to pay a
licen.. in the City of Clennont except they be engagoo in or shall

apply for a license i~ one of the following: fortune teller,
clairvoyant, palrndst, astrologer, phrenologist, character reader,
spirit medium, absent treatment healer, or mental healer, 3nd
every person engaged in any occupation of a sir.1ilar nature shall
pay a license tax of $100.00 unless said license shall be in a
l€ss amount as set forth in Section 7 hereafter.

A'11orican and World Viars I and II <lnd being bona fide pennanent
resident electors of t}'le City of Cle:rr:lon"l:: and who was honorably
di~charged from any of the armed services of the Un~ted states of
America and who shall be disabled from performing manual labor,
shall, upon sufficient identification and proof of being a per-
manent resident elector in said City, product!0n of an honorable
discharge from any of the armed sel'vices of the Un! ted States of
'America during said wars shall be granted a license to engage in

a business or occupation in the City of Clexmont without cost
provided said license does not exceed the sum of $50.00; that
if the license so applied for shall exceed the sum of $50.00,
the remainder of such license tax in excess of $50.00 shall be
paid in ca~h by the applicant.
SECTION III. That Section 7 of Chapter XI of the Re-
vised General Ordinances ~f the City of Clermont duly passed by
the City Council of the City of Clermont on the 6th day of june,
A.D., 1928,and approved by the Mayor of said City on th~ 19th day
of June, A.D., 1928, and heretofore repealed, is hereby re~
established to read as follows:

AN ORDINANCE TO REPEAL SECTION 7 of CHAPTER
XI OF THE REVISED GENERAL ORDINANCES OF THE
CITY OF 'CLERMONT, AND TO REPEAL ORDINANCES
NOS. 15, 22., 24, 25, 31, 33, 64, 73 and 83
OF THE CITY OF CLERMCNT. ALL RELATING TO
OCCUPATIONAL LICE~SE TAXES IN THE CITY OP

SECTION I. That Section 7 of Chapter XI of the
Revised Genaral Orciinances of the Gl.ty of C1ennont duly passed
by the City Council of the City of Clermont on the 6th day of
June, A.D., 1928 and approved by the Mayor of said city on the
19th day of June, A.D., 1928 is hereby repealed.
SECTION II~ That all the following numbered ordinances
of the City of Clermont duly pas~;ed by the City Council of said
city and duly approved by the Mayor on the respective dates as
hereinafter set forth are hereby repealed:
(~) Ordinance No. 15 passed on 6 June, 1933 and ap-
proved by the Mayor of the City of Clermont on the same date.
(b) Ordinance No, 22 passed by the City Council of
the City of Clermont on 6 August 1935 and approved by the Mayor of
the City of Clermont cn the same date.
(c) Ordinance No. 24 passed on September 10, 1935, and
approved by the Mayor of the City of Clermont on the same date.
(d) Ordinance No. 25 passed on November 13, 1935, and
approved by the Mayor of the City of Clermont on November 14, 1935.
(e) Ordinance No. 31 passed on Sept~nber 7, 1937, and
ap":roved by the Mayor of the City of Clermont on the same date.
(f) Ordinance No. 33 passed on November 2, 1937, and
approved bj the Mayor on November 3, 1937.
(g) Ordinance No. 64 passed on Sept~mber. 7, 1943, and
approved by the Mvor of the City of Clermont on the same date.
(h) Ordinance No. 73 passed on September 18, 1945, and
approved by the Mayor of the City ~f Clermont on the same date.

SECTION III. This ordinance shall take effect immed-
iately upon its passage.
