MINUTES OF THE RIDULAR MEETING OF THE CITY COUNCIL HELD AT THE
CITY HALL ,:rnDNESDAY, OCTOBER 16, 1946, 7:30 P.M.
The meeti~g was called to order by Vice President H.C.
Brown, other Councilman present being C.W.Gainos and Albert
Johnson. Yayor McQuistion, Marshall C.E.Sullins, City Atty
Irving Morse, City Engineer A.G.Cole, Street Supt. J.B.Fullwood,
Water Supt. H.~.Cole, and City Clerk R.F.House were also present.
Minutes of the meeting Oct. 1st were approved as read.
Wm Elliot was present, and asked the Council to close
the Street north of his house in Block 118, Johnson's Replat.
Mr. Johnson made a motion, seconded by ~~. Gaines, which
carried, that Short Street north of Black 118, Johnson's Replat,
be closed, and no dirt be removed from the street, and that
the City Clerk write Mr. Wolfe not to move any of the dirt.
Marshall Sullins reported that jail cell from the County
Jail was not available.
Report of the City Engineer, A.G.Colo was read.
He stated that all matters brought up in the previous meeting
had been attended to. The Septic tank at the school has been
reapproved by the State Sanitary Board. buildings being
constructed have been checked to see that they comply with the
b~ilding code. He checked the Cell blocks in the County
jail with Chief Sullins, and found that the cost to put them
in use here would be prohibitive. He also explained the
situation whieh caused the dificulty on Carroll Street between th4
school block and Sparkling Water Lake, and the corrective
measuredqtaken. It appears that moving the City Ga~age would
be better for the City to put it near the center of town.
B. M. Cole-reported that lab.>> from the Roegains Co. had
been used in the Clean-up Campaign, amounting to $282.75, which
the City had agreed to Pay.
Attorney Morse stated that in the sale of lots, H.K.Stokes
had handled the sale to M.R.Francis, and that through error
he was not notified of the amount of Paving due, and he had
gaaranteed them clear of all liens. Mr. Johnson made a motion,
seconded by ~fcr. Gaines, and Carried, that paving lien aga.inst
the lot of Y.H. Francis, sold him by H.K.Stokes, be cancelled.
~!r. Gaines introduced an Ordinance entitled II AN
ORI! NANCE AMENDING SECTION 14 OF CHAPTER XXVI OF THE REVISED
GENERAL ORDINANC3S OF THE CITY OF CLERMON, MAKING IT A CRIME
TO RESIST ARREST BY A POLICE OFFICER OF THE CITY OF CLERMONT;
PROVIDING FOR AN INCREASE IN THE r,WCIMUM FINE TO BE n~POSED
BY THE MAYOR'S COURT FOR A VIOLATION OF THE CRIMES LISTED IN
SAID SECTION 14 AS AMENDED BY TFIS ORDINANCE."; which was
read in full. Mr. Gaines moved its adoption, which was seconded
by Mr. Johnson, and when put to a vote1f1 the motion carried.
Mr. Gaines then moved that the rules be waived, and the Ordinance
read the second time by its title only. The motion was .
seconded by Mr. Johnson, ad carried unanimously" After the
second t.~~ reading, Mr Ga nes made a motion that the rules be
further waived, and the Ordinance be read the third time and
placed upon its passage. The motion was seconded by Mr. Johnson
ann carriGd unanimously. Thereupon tbe Ordinance was rea.d in ;~
full, and upon passage of same the roll was called with the
following results: Ayes-Gaines, uohnson, Brown; NOES- none;
absent-Roe, Macdonald. So the Ordinance passed, title as
stated, and ordered placed in the Ordinace Book and numbered
Ordinance No.79. A copy of the Ordinace in full appears in
this book following these minutes.
The matter of Street lights at the intersections of
Third and Minneola, and Sixth and Chestnut Sts, was brought up,
and H.M.Cole stated that the Florida Power Corp. had been
nobified that these were wanted, also several others.
The matter of purchase of tractor with mower and sweeper
attachments was postponed until all members of the Council
were present.
A. G. Cole was instructed to get prices on Quonset Huts.

A POLICE OFFICER OF THE CITY OF CLERMONT; PROVID~
ING FOR AN INCREASE IN THE MAXIMUM Fl:NE TO BE
IMPOSED BY THE MAYOR'S COURT FORA VIOLATION OF
THE CRIMES LISTED IN SAID 8ECT,ION 14 AS AMENDED
BY THIS, ORDINANCE.
BE IT ORDAINED BY THE CITY COUNOIL OF THE CITY OF CLERMO~":
SEC~ION 1. That Seotion 14 of The Revised General
Ordinances of the City or Clermont duly passed by the City
Council Qf said city on the 6th day of June, A. D.. 1928.
and approved by the Mayor of the C1ty of Clermont on the
19th day of June. A. D., 1928 be amended to ine lude therein
the crime of resisting arrest by Q Police Offioer of the
City of Clermont; that the maximum fino to be imposed by
the Mayor's Court of the City of Clermont for violation
of any of the ~r1mes included and/or listed in said
section 14 be ~a1sed from $25.00 to $100.00; and. that
said Sect~on 14 be amended to read as follows:
Section 14. ~Vh~ever shall be ~\llty of a braaoh
0f the peace, disorderly conduot, drunkednesB,oresisting
arrest by a police offioer of the City of Clermont, or
indecent exposure of the nerson, shall be pun1shed by a
fine of not lesa than $5.00 and not exceeding $100.00
or by imprisonment at hard labor not exceeding 30 days,
or by both Buch fine and impr1sonment.
SECTION 2. That this ordinance shall take effect
immediately upon its passage.
