MINUTES OF THE REGULAR MEETING OF THE CITY COUNCIL HELD AT THE
CITY HALL TUESDAY, JULY 2, 1946, 7.:30 P.M. .
The meeting was called to order by Vice President H.C.
Brown, other Counoilmen present being C.W.Gaines, A.M.Johnson,
and J.F.Macdonald. Councilman F.B.Roe was out of the city.
Mayor W.H.McQuistion, ~~rshall C.E.Sullins, City Attorney Irving
Morse, Tax Assessor G.A.Nash, City Engineer Alfred G. Cole,
Street & Water Supt. H.M.Cole, and City Clerk House were present.
Minutes of the meetings June 4, June 17, and ~une 19 were
read and approved.
Engineer Cole reported that there was a little difficulty
in getting survey through blocks 80, 81, 9m and 92 for an
aller, as ~here were some buildings right on the center line of
the blocks.
Earl Fain had reported that the City truck was damaging
the drain tile to his septic tank in block ~l. Mr. Johnson
made a motion, seconded by Mr. Macdonald, (tha t the City put in
six loads of clay to protect the drainage system, where it is
necessary to cross it in garbage collection. When put to a vote
the motion carried.

Mr. Macdonald reported that Coach Stack was working on
a recreation program, and expected to have a plan ready for the
next meeting of the, Council.
Mayor McQulstion's Report stated there were 19 arrests
and $442.00 in finos & Forfeitures turned over to the City
Clerk, in the month of June
Marshall Sullin's report stated the Same as the Mayor's.
Fire Chief Cole reported there were no Fire calls in
the month of June, and no fire drills held.
Water Supt. Cole reported about 2400 ft of 6" water main
on the ground for the line to the Pomona Products Co., and the
balance needed to come out of the next car coming into Brlando.
He stated that the ditch was opened from Osceola St to Oak St.
along Second St. for this line.
The Ci~ Clerk had received a check from the B.S.Fidelity
and Guarantp Co., to repair the sidewalk damaged when a canopy
on the Fain Huilding fell some time ago. A.W.Smith & Son,
who were putting up the building, have repaired the walk, and
on motion of Mr. Macdonald, seconded by Mr. Johnson, and
carried, the City Clerk was instructed to indorse the check
and give it to A. W. Smith & Son.
An application for permit to. construct pipe line accross
right of way of the Tavares & Gulf Railroad was referred to
the City Engtneer for action.
The City ~lerk reported that at the City Tax Sale July
1st, all the 1945 roll not already paid, CertifiCates were SOld,
making the taxes 100% paid, on the current roll.
Attorney Morse reported that W.P.Frisz had filed a
Mandamus with the Circuit Court to require the City to issue
him a building permit on the west end of block 121; and that
Judge Koonce had ruled in his favor. Mr. Macdonald stated
he was in favor of issuing the permit unless the case was
appealed. Mr. Johnson moved that the Case be appealed to the
state Supreme Court, which was seconded by Mr. Gaines. ~On
roll call, the vote was as follows: Ayes- Brown, Gaines,
Johnson; Noes-Macdonald'. so the motion carried, and the
City Attorney was instructed to file the Appeal.
Assessor Nash submitted the Tax roll for 1946, saying he
had made certain changes as recommended by CounCil, and had
increased all 1945 assessments approximately 20%. 1~.
Macdonald moved that the Tax roll be accepted, and that a
meeting ~~ be Bold Thursday, August 8, 1946, 7:30 P.M. at
the City Hall, t e Council sitt~ng as a Board of Equalization.
The motion was seconded by Mr. Johnson and when put to a vote
the motion carried. ' ,

Atty Morse brought to the attention of the Council that'
a resolution requesting the State Road Dept. to f~t~tit~/~~
f~~~itg~~~ change the designation and location of Roads 22 and
55 from Montrose Street to Minneola Ave between Eighth and.
Twelfth Streets, had~been passed at *he regular meeting March
5th, but not recordeI7\ in the minutes. Mr. Johnson made a
motion that the minutes of the meeting March 5th be anended
to show the passage of this resolution. The motion was seconded
by Mr. Macdonald, and carrie d unanimously.

The Trustees for the Colored School on Highland Ave.
asked permission to put in a retaining wall to hold the clay
shoulder of the street in front of the schoolhouse from washing
away. Mr. Johnson made a motion, seconded by Mr. Gaines and
carried, that the Trustees be permitted to do this under the
direction of the Ci~ Engineer.
Mr. Macdonald made a motion, seconded by Mr. Johnson, th~
City Employees by given vacations as usual. The motion carried.
Mr. Sullins asked to get his July 15th to 30th. Mr. Cole to
get his later. The City Clerk to get his after the tax roll
and budget are settled.
Mr. Gaines made a motion that the following list of bills
be approved and paid when money is available. The motion was
seconded by Mr. Macdonald, and when put to a vote, the motion
carried.
