05-01-1945 Regular Meeting CITY OF CLERI10NT MINUTES OF TFE REGULAR r'lEETING OF THE CITY COUNCIL HELD AT THE CITY FALL~ TUESDAY~ MAY l~ 1945~ AT 7:30 pom. ~ ~ The meoting was called to order by Prosident F. B. ROG, othor Councilmen present being R. M. Castner, H. C. Brown, R. Mo Stackhouse and C. W. Gaines. Mayor F. H. Higby, City Attorney Irving F. Morse, City Clerk W: H. r.'IcQ.uis ti on, Marshal C. E. sullins and Street ar:d Water Superintendent B. M. Cole were also present. The minutes of the previous meoting held on April 6~ 1945~ were read and approved 0 A motion was made by Mr. Brown, seconded by Mr. Stack- house~ that because of an error in transcribing the minutes of the last meeting of the Council wi th reference to the date of recei ving bids on City lots Which should have read June 1 instead of May 1 as published in tile Clermont Press, it is the action of Council that bids for the ~urchase of lots be received in accordance with the date of advertising. After opening of tho bids and consideration thereof~ all bids accepted far lots sh~~n in advertisir.g be eliminated from tho advertising and the remainder be advertised for two more issUGs and bids received by the Council up to JunG 1,1945. The motion carried. A motion was rrade by Mr. Castner, sGconderl by Mr. Gaines, that the City lease to the Clermont Boy Scouts of Ar.-orica, for at least five years, tho City Park at the foot of ~~elfth Stroet; . this lease to be non-transferrable and remain in for ce (up to five ye ars) as long as th e Scouts remain act ive and t'he property kept in order. Mayor Higby reported that during the month of April there were thirteen arrests, one case tried, two cases dismis sed, and bonds forfeited in the amount of $205.00. He also rec- ommended that a commit tee be ap pointed to revise the list of occupational licenses~ and a system adopted that the committee may recommend for closer check on the collection of these foes. Mayor Higby also stated t1!at he believed a license should bo adopted by the City for the .same classes of apartments as the State Hotel Commission requires, and that a license should bo required of termite exterminating f:irms. Marshal Sullins reported tl~t during the month of April ro made thirteen arrests and collected and turned OVGr to the Ci ty Clerk ~~205 000. ~ ,., Fire Chief Achord reported tha t dur ing the month of April there WGre no fires, and the fire engine was inspectGd on April 7~ 14, 21 and 28 and found in goed shape. A motion was mado by Mr. Bro'livn, secmded by Mr. Castner~ tha t a commit tee be a 1P oint cd to revise the sched:ule of occupational licenses and report back to the Council. Mr. St.ackhouse~ Mr. Brown and Mr. Castner were appointed. A motion was :rra de by Mr. Gaine s, seconded by Mr. Castner~ that the City Attorney be authorized to purChase lots in Sunnyside Unit and also lots opposite Doc Jo~es Place. Mr. Gaine s moved the adopt ion of t1l0 Ordinance, whic b was seconded by Mr. Castner, and when put to a vote, tm motion carried. Mr. Gaines then moved that the rulos be waived, and the ordinance read the second time by its title only. The motion was sec- onded by Mr. Castner and carried unanimously. After the sec- ond reading, Mr. Gaine s moved tba t too rule s be further waived, and toot tho ordinance be read the third time and placed upon its passage. The motion was seconded by ~r. castner, and carried unanimously. Thereupon the Ordinance was road in fUll, and upon passage of same, the roll was cal10d with the foll~ving results: Ayes - Castner, Brovm, Stackhouse, Gaines and Roo. Noes - None. So the Ordi- nance passed, title as stated, and was ordered recorded in the Ordi nancs Book and numbered Ordinanco No. 68. 'I ORDINANCE # ~ ~ ~ AN ORDINANCE AMENDING S$CTION 6 AND 15 OF CHAPTER IV AND SECTIONS 2 and 3 OF CHAPTER V OF THE REVISED GENERAL ORDINANCES OF THE CITY OF CLERMONT, LAKE COUNTY, FLORIDA. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CLERMONT: SECTION ONE. That Section 6 of Chapter IV of the Revised General Ordinances of the City of Clermont, Lake County, Florida, as passed by the City Council of said City on June 6, 1928, be, and the same is, hereby amended to read as follows, to-wit: Section 6. Petitions for the nominations of all candi- dates shall be filed with the City Clerk at least l~days before an~ e1ec tion. The name of no person shall be placed on the ballot who shall, not less than 10 days before the election, notify the council in v~iting that he will not accept the nomination speci- fied. SECTION TWO. That section 15 of Chapter IV of the Revised General Ordinances of the City of Clermont, Lake County, Florida-{ as passed by the City Council on June 6, 1928, be, and the same is, hereby amended to read as follows: Section 15. Thirty (30) days pr10r to the date of any and all elections the Mayor of the City shall issue his procla- mation calling said election, which call shall specify what questions are to be submitted to the voters and Which officers are to be elected, the length of time such off1cer is to serve, the date and place where such election shall be held. AND S~SET,~ASTERN STANDARD TIME. That Section 2 of Chapter V of the Revised General Ordinances of the City of Clermont, Lake County, Florida, as passed by the City Council on June 6, 1928, be, and the same is, hereby amended to read as ~ollows, to-wit: Section 2. The City Clerk shall be ex-officio Registration Officer of the City and shall, thirty (30) days before any general or special election, open the registration books of the City in his office and shall keep said books open every day for 20 days during the regular business hours of his office, and shall give notice thereof by publication in a news- paper published in the City for the period of two (2) weeks prior ~ ~ to the date of the opening of said books. Such Registration Officer shall register all persons applying to him who shall not have been previously registered in the City and who are otherwise qualified, provided, that each person applying to him for regis- tration shall take and subscribe to the following oath, t'o be administered by the Registration Officer: "I, (name), do solemnly swear pr affirm) that I am a bona fide resident of the City of Clermont, in the County of Lake, and State of Florida; that I will support, protect and defend the constitution and government of the United States and of the State of Florida; that I am over the age of ~venty- one (21) years and have been an actual resi- dent of the state of Florida for the period of One (1) year and of the City of Clermont, in'the County of Lake, for the period of Six (6) months, So Help~'me God." SECTION FOUR. That Section 3 of Chapter V of the Revised ~ General Ordinances of the City of Clermont, Lake County, Florida, as passed by the City Council on June 6, 1928, be, and the same is, hereby amended to read as follows, to-wit: Section 3. The name of each person so registered shall be entered in alphabetical order in two (2) books pre- pared and kept for that purpose, known as the Registration Books of the City of Clermont, giving also his or her age, color and occupation under appropriate headings. Within Two (2) days of the closing of the Registration Books, the City Council shall convene and prepare from such books a list in alphabetical order of all registered and qualified electors of the City prior to the date of the election 'at which the same shall be used. The names of all persons who, for any reason, are not qualified to vote in a City Election shall be omitted from such list. The City Council shall cause a notice to be mailed by Registered Mail to each person omitted from such list, except to those persons known by a majority of the Council to be deceased no notice shall be mailed. This notice shall be substantially in the following form: ~ NOTICE YOU ARE HEREBY NOTIFIED that the City Council has omitted your name from the list of regis- tered and qualified electors in the City of Clermont, which list shall be used by the elec- tion inspectors and clerk heretofore appointed by the City Council for the general election (special election) to be held in the City of Clermont, at the City Hall on , 19__, for the following reason: (here state reason) You have 4 days from date hereof to appear be- for the'Registration Officer (City Clerk) of the City to show cause why your name should not be stricken from such list. ... Dated: CITY OF CLERMONT Registration Officer Any person whose name has been omitted from such list and who shal~ within four (4) days of the date of the above notice, satisfy the Registration Officer that he or she is a qualified -~ -,., elector and his or her name should not have been so omitted, shall be immediately re-registered by the Registration Officer and his or her name shall be written in ink on the list of registered and qualified electors to be used in the election for which same was originally prepared. The registration list as prepared by the c~ty Council and revised by the Registration Officer, as set forth in the immediately preceeding paragraph; shall be certified to by the City Clerk and by him presented to the managers of the election at which the same is to be used~ and shall constitute the list of qualified electors entitled to vote at such election. Upon the order of the City Council, the Registration Officer of the City shall transfer and transcribe into two new registration books fro~ whatever registration books may be in possession of such officer, the names of all electors who ap- pear upon said old books to be properly and legally registered electors thereon at the time of such transfer to said new books. At the time that such transfer is made, the Registration Officer of the City shall cause the names of all persons so transferred to'be published for two (2) consecutive weeks (2 insertions) in a newspaper~'published in the City of Clermont, or shall post such list in four (4) prominent places in the City. This list shall be substantially in the following form: NOTICE ~ ---., The following named persons are duly regis- tered in the Registration Books of the City of Clermont, Lake County, Florida, as quali- fied electors and their names have been trans- ferred into the new registration books of the City of Clermont: (Hereinafter set forth alphabetically the names of all qualified electors.) Any person whose name does not appear herein- above and believes himself or herself to be a qualified voter has one (1) month from (date of last publication of Notice) to ap- pear before the Registration Officer (City Clerk) of the City of Clermont and present his or her qualifications as a qualified elector and be registered. - ~ CITY OF CLERMONT Published on: Registration Officer The names of all qualifed electors not appearing on such list and who shall, within one month from the date of the first publication of said list, satisfy the Regis~ration Officer that he or she is a qualified elector shall be immediately registered by said Officer, and the opening of said books for the registration of such person or persons shall not be in violation of any of the ordinances of the City of Clermont per- taining to any elections. Six (6) months after the second publication of said list>> the old registration books may be destroyed by the Regis- tration Officer before the members of the City Council at a Regular Meeting and same shall be set forth in the Minutes of said meeting. SECTION FIVE.
