MINUTES OF A SPECIAL MEETING OF THE CITY COUNCIL HELD AT THE
CITY HALL, THURSDAY, MARCH 22, 1945, AT 9 a.m.

A Speoial Meeting of the City Council of the City of
Clermont was held on March 22, 1945. The meeting was called
to order by President F. B. Roe, other Councilmen present being
R. M. Stackhouse, R. M. Castner, C. W. Gaines, and H. C. Brown.
W. H. McQulstion, City Clerk, and Irving F. Morse, City Attorney,
were also present.
Upon motion made by C. W. Gaines and seconded by R. M.
S~aokhouse, a Resolution was passed to close Magnolia Street
between l2th Street and Virginia Drive, a copy thereof appearing
after these Minutes.
There being no further business to oome before the
Council, the meeting was adjourned.

RESOLUTION
WHEREAS, Magnolia Street between 12th Street and "'r

Virginia Drive in the City of Clermont, according to the ot-
fi~ia1,Map thereof" as recorded in Plat Book,S, pagesl? to
23, inclusive, publio reoords of Lake County, Florida, is
designated as a Street but has never been opened to traffic

by the City of , Clermont or.l\\abutting property owners; and,
WHEREAS, said street between 12th Street and Virginia
Drive is now and has been for l5 years or more set out to
citrus trees; and the property lying North and South ot the
above described portion ,of Magnolia Street is owned by one
Charles M. Pool and has been used by him in the continued
care, cultivation and fertilization of said citrus grove;
and that a portion of said premises is now occupied by a
metal covered frame storage building used by the said Charles
M. Pool 1n oonneotion with his wine business operated in
the City of Clermont; and,
WHEREAS, there is no necessity at this time or within
the near future of opening said Magnolia Street between 12th
Street and Virginia Drive as all property abutting said
street and in the immediate vicinity thereof is owned by
the said Charles M. Pool; therefore,

BE IT RESOLVED by the City Council of the City of
Clermont that MagnOlia Street between 12th Street and Virginia
Drive, acoording to ~he above desoribed Offioial Map of the.
City ot Clermont, be, and the same is hereby, olosed to the
pUblio until suoh time in the future that it will be neoes-
sary to open said street for the traveling public and that
when suoh time does arrive, the City Counoil, by a further
Resolution, shall reopen said street upon giving, prior to
the reopening of said street, a 60 days notice in writing
thereof to the said Charles M. Pool; and,
BE IT FURTHER RESOLVED that the said Charles M. Pool

shall, from this date on, and until suoh time as this
Resolution is rescinded by the City Counoil of the City of
, '
Clermont, have the right to use, occupy, and build on said
premises as if the same were his own private property.
