MINUTES OF '!HE REGUL'AR MEETING OF THE CITY CO UNCI L BE ID
AT THE CITY HALT, TUESDAY, MARCH 6, 1945, at 7:30 p.m.

The meeting was called to order by President F. B.
Roo at 7:45 perno, other Councilmen present being R. M.
Castner, Ro M. Stackhouse, H. C. Brown and C. Wo Gaines.
Mayor F. He Higby, City Clerk w. H. McQ,uistion, Attorney
Irving F. Morse, Marshal Co E. Sullins and Stroet and Water
Superintendent Ho Mo Colo were also present.
The minutes of tho preVi ou s meeting held on February
6th, 194 5, were read a nd a pprov ed.
Fire Chie f Achord reported two fire ca lls, one on Febru-
ary 1 tho other on February 11, to extinguish grass fires.
In attendance at the fir st fire call were H. M. Cole, Bill
Kie and Clarence Bishop. At the socorn. fire were J. W 0 Hinson,
J. Bo Fullwocd, A. L. Sheldon, Ed Nolen, Bill Kie and H. M.
Co 10 .
Police Chief Sullins reported tireuarrests made and fines
of $77.50 were paid.
Mayor Fe Ho Higby made t be follow ing report:
"During the month of February there wore three
cases tho polic e Court with fi ns sand c os ts of $77.50,
$11050 of Which was a deferred payment. There were two
two borrl s forfeit ed becau se of non-appearance.
Your Commit tee appointed to pJa ce a sale value on
lots recently pUl:'chased from the State bas been waiting
for the fUl"ther instructions from Leedy, 1iVheeler Company
regarding cancellation of interest on paving and 1930
and prior taxes. Their report will be ready before the
April 1 date when tho option of fo rIl13r owners of the
lots expires according to the Council's action.
In a previOUS report, I recommended that' the City
soIl all lots not ne eded far City use. I tm s t that th is

sale value on lots secured from the State be instructed

Sonat<r Johnson and Represcmtativc Sellars held two
sessions in C1emont today to learn the needs w:n.d receive
,suggestions for legislative action. I met tlJ.ese gentlerren
after tho meeting and e xoressod the wish of till Council that

A motion was made by Mr. castner, seconded by Mr. Stack-
hou se tha t Chief Sullins bo ins tructed by tbe Mayor to collect
money from Isreal Cooper for fruit on trees in Cooper's Lane
at $2.25 per box 0 The mot ion c arri ed.

A motion was made by Mr. Stackhouse, seconded by Mr.
Brown tha t ~~500. 00 be paid the Amy for pipe in Amy Camp.
Tho motion carried. Resolution adopting same is attached hereto.
. A motion was made by Mr. Stackhouse, seconded by Mr.
Castner, that all bills be paid when the mon~ is available.

RESOLUTION
VrnERE1~ the City of Clermont granted a license to the
United states Government on ~une 22, 1943 to construct, operate,
~

maintain, renew, and remove pipe lines along, across, beneath,
and over the right-of-way of certain streets in the City of
Clermont, Florida, described as follows, to-wit:
A strip of land 6 feet wide, more or less, the center
line of which is more particularly described as follows:
Commence at a point approximately 3 feet \kst of the
Westerly curb on West Street and approximately 3 feet
North of the Northerly curb on Montrose Street, thence
run West parallel to an approximately 3 feet North of
the North curb on Montrose Street a distance of 559 feet,
more or less; thence run South parallel to and approxi-
mately 3 feet iVest to the Westerly curb on Tenth Street,
a distance of 538 feet, more or less, thence run West
to the West boundary of Tenth Street, in the City of
Clermont, County of Lake, State of Florida.
WHEREAS, the United States Government by and through its
component agency, the War Department; did construct, operate,
maintain, and lay a pipe line c~mposing 1902 feet of 6 inch
Cast Iron pipe; 370 feet of 4 inch Cast Iron pipe; and, 4 fire
plugs along said above described strip of land; and,
VffiEREAS, it is the desire of the City of Clermont and the
United States Government to release each other under said license
as of March 5, 1945; and the said Government desires to relinquish,
transfer and deliver to the City of Clermont the above described ~
pipe and fire plugs for the sum of ~500.00 which represents the
difference between the value of said improvements and the estimated
cost of the ~estoration required by said license; the City of
Clermont, Licensor, desires to pay said sum of ~500.00 and accept
the transfer of said improvements, therefore,
BE IT RESOLVED that the City Council of the City of Clermont

do pay to the United States Government or its component agency,
the \iar Department, the sum of :fp500.00 for said improvements, and,
BE IT FURTHER RESOLVED that the Mayor of said City and its
City Clerk be authorized to enter into immediate negotiations and/or
agreements to affect said transfer upon the payment of said money
and to release the United States Government , its officers, agents,
and employees from any and all actions, liabilities, and claims that
