MINUTES OF THE REGULAR ADJOURNE D MEETING OF THE CITY COUNCIL
HELD AT THE CITY HALL TUESDAY, FEBRUARY 11, 1941, 2:30 P.M.

The meeting was called to order by president O.H.Keene,
other Councilmen present being G.J.Egan, C?7.Gains, H.R.Harper,
and R.V.Miller. Mayor H.C.Brown, City Attorney Geo. F.
Westbrook, and City Clerk R.F.House were present.
Mrs. Minnie JOhnson, F~s. S.C.Perry, Mr. Fred Anderson,and
Mr. Miner H. Hoag, who own property ne~ the proposed changes
in zones were present and asked some questions in regard to the
changes.
Councilman Harper expressed himself in favor of leaving
the Zoning Ordinance as it is.
Councilman Gaines favored an extension of the present
C-I Zone along Montrose Street from West Ave. to the western
Ci ty boundary, En d Mr. MilleY"' agreed with him.
Mr. Ha rper asked Mr. Westbrook cp. estions about changes
in rhe Ordinance; and Mr W stbrook explaned several points
of the Zoning Ordinance an~ the general attitude of the Courts
in upholding Zoning laws; als 0 the rights of property owners
ans businesses operating under these laws. General discussion
followed and Mayor Brown x:taII:xali explained how some of the
diffirnlties whddh'prevent a satisfactory settlement to all con-
cerned had arisen.
Mr. Gaines made a motion that further consideration be
given the proposed change in the Zoning Ordinance at the next
regular meeting of the City Council, March 4th. 'The motion
was seconded by Mr. Miller, and when put to a vote~ tha motion
carried.
Mr. Harper asked what action, if any, had been taken
on the petition of a bout forty residents' of Clermont which
was submitted to the Council October 8, 1940. The petition
asked that some action be taken by the City to abate the loud
noises at late hours of th; night,orinating at the meetings
of the Colored Church of God on Fifth Street.
. Mr. Harper made a motion that the Mayor give the leaders
of the Church written notice th~ must close their meetings
at a reasonable hour and disconttre unnecessary noises, er
it would be declared a nuisance, and the leaders would be
arrested and tried for conducting or operating a nuisance.
The motion was seconded by Mr. Miller, and when put to a vote,
the motion carried.
