08-06-1940 Regular Meeting ~ ~ CITY OF CLERMONT MINUTES OF THE REGULAR 1~ETING OF T~ CITY COUNCIL HELD AT THE CITY HALL, TUESDAY, AUGUST 6, 1940, 7:50 P.M. The meeting was called to order by president O.H.Heene, othe r Councilmen present being A.M.Jolmson, and R.L.Lassiter. Mayor H.C.Brown, Marshal H.S.Cleaver, Street & Water Supt. R.F.Anderson, and City Clerk R.F.House were also present. M~utes of the regular meeting July 2, and special meeting July 15 were approved as read. Mr. Horsely and Mr. Greene, as representatives of the Recreation Club asked if more shuffleboards could be provided in Kehlor Park, and if two of the boards could be repaired so too y could be played upon. Arts r some discussion, Mr. Keene agreed to look into the matt er and do wm tever is possib~le to provide additional facilities. Mayo r Brown read his report in which he nB de several recommendations. Mro Johnson rmde a motion, seconded by Mr. Lassiter, that th Cit;r Attorney draw up a resolution authorizing the Stat e Ro ad Dept. to lower too grade on Pitt Street where it is crossed by t~e new Federal Road, and providing that the Road Dept. will rep:d.r, or replace any part of the streets dama~ d or changed during construction of tl~e read, and be put back in perfect condition~ v~n put to a vote, the moti on carrie d. Mr. Johnson made a motion, seconded by Mr. Lassiter, that the City pay for $10.00 worth of material to be used in the W.P.A. sewing room here, as part of the Sponsors contribution to the Project. The motion was seconded by Mr. JOhnson, and when put to a vote, the motion carried. Mr. Lassiter then intrmduced an Ordinance entitled "AN ORDINANC-;'~ FIXING THE MANNER IN WHICH BntDING PER1d:TS SHA. LL BE ISSUED BY 'l'HE CITY OF CLERMONT; REQUIRING A PERMIT TO BE ISSUED BEFORE ANY CONSTRUCTION, ALTERATION OR REPAIR OF ANY STRUarURE IN THE CITlSHALL BE COMMENCED; AND PROVIDING PENALTIES FOR VIOLATION OF THIS ORDINANCE." Mr. Lassiter U:en moved too adoption of the Ordinance, which was seconded by Mr. Johnson, and Carried. Hr. Lassiter then moved that the rules be waived, and that the Ordinance be read the second time by its title only, Which was seconded by Mr. Johnson and carried. Mr. Lassiter then moved that the rules be further wai va d and that the OrdinacliiT be read the third time and placed upon its passage, which motion was ~ unanimously adopted. Tnereupon the Ordinance was read in full and upon passage of the same, the roll was called and the following vote taken: Ayes; Councilmen Johnson, Keene, Lassiter; Noes-none. Absent-Councilmen Roe, Stackhouse. So the Ordinance passed, title as stated, and was ordeBd n3corded in the Book of Ordinances, and nurnberd Ordinance No.49. A copy of the Ordinance in full appears in this book, following the minutes of this meeting. ~ .~ Mr. Johnson made a motion, seconded by Mr. Lassiter that the recommendation of Mayor Brown in his report July 2, in re gard to the Board of Ad jus trne nt provdldad by Zoning Ordinance No.48, be adopted, and that C. W. Bromnall, S. H. Bowman, Irving Marse, G. J. Egan andErnest Denslow, each be appointed for a three year term as a member of the Board of Adjustment. When put to a vote, the motion carrie d. Mr. Johnson ma~e a motion that the recommendation of the Street Committee in re~rd to changing the names of certain Streets in Clermont be adopted, the changes to be as listed be low: Minutes of Council meeting 8-6-40. p. 2 -1 Division Street connecting DrewJ and Disston streets south of Minnehaha Ave to De calied Adams street, to avoid confusion with Division street on the northern boundary of the City Boulevard along Lake Minnehaha to be called South Lake Shore Dri va Boulevard along Lake Minneola to be called North Lake Shore Dri ve .. .., East Avenue south of Minnehaha Ave to shore of Lake Minnehaha to be called Eden Lane, as it is not a continuation of East Ave north of Minnehaha Aveo The moti on was seconded by Mr. Lassiter, and when put to a vote, themotion carried. ORDINANCE NUMBER tf-1 AN ORDINANCE TO BE ENTITLED "AN ORDINANCE FIXING THE MANNER IN WHICH BUILDING PERMITS SHALL BE ISSUED BY THE CITY OF CLERMONT; PROVIDING FOR THE ISSUANCE OF SUCH PERMITS; REQUIRING A PERMIT TO BE ISSUED BEFORE ANY CONSTRUCTION, ALTERATION OR REPAIR OF ANY STRUCTURE IN THE CITY SHALL BE COMMENCED; AND PROVIDING PENALTIES FOR VIOLATION OF THIS ORDINANCE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CLERMONT: SECTION 1. Before any construction, alteration or repair of any structure in the City of Clermont shall be commenced, the owner or the contractor or agent of the owner shall first apply for and obtain a building permit from the City Council of the City of Clermont. SECTION 2. Applications for building permits shall be made to the City Council on forms to be provided by the City and such application shall be in duplicate and the applicant for a permit shall give fully all of the informa- tion provided for in the application. Applications shall be left with the City Clerk, who -~ . shall in turn deliver the original application to the Mayor and the Mayor will deliver the same to the Building Inspector, who shall, under the direction of the Mayor, make such investi- gation as the circumstances may require. If the application is in proper form and complies with the ordinances of the City, the Building Inspector will approve the application, return the same to the Mayo~who will deliver it to the City Clerk. After the application has been approved by the Building Inspector, it shall then be referred by the Clerk to the Fire and Building Committee of the City Council and if approved by a majority of the members of this Committee, the Clerk shall then issue unto the applicant a building permit and the applicant or his em- ployees may proceed with the construction, alteration or repairs applied for. SECTION 3. It shall be the duty of the Building ~ .. Inspector to check the work that is being done to see that the work is carried out in the manner provided for by the ordinances of the City arld in conformity with the applica- tion upon which the permit was based. SECTION 4. If the Building Inspector shall find that there is any substantial deviation from the provisions of the application or if any of the ordinances of the City are being violated, he shall immediately report the same to the Mayor who shall investigate and if it is found that -such violation has occurred or is about to occur, the Mayor is hereby vested with authority to temporarily revoke the per- mit which was issued and shall call a special meeting of the City Council and summons before it the owner or if the building is being constructed under contract, both the owner and the contractor, and the Council shall hear and determine whether or not the ordinances of the City are being violated or whether or not the building is not being constructed as the application provided for and unless the contractor and the owner shall agree to correct such violations as have occurred and pre- vent such violations in the future, the Council shall revoke the permit and no further work shall be allowed to be done until a new permit is granted. SECTION 5. Where, because of fire, storm or other emergency, any property owner or hfu agent may, with the approval of the Building Inspector, make temporary emergency repairs without waiting for the issuance of a permit, but no repairs of a permanent nature shall be made --~ . until a permit has been issued. SECTION 6. Minor repairs, the cost of which shall not exceed $10.00, may be made without a permit, and no per- mit shall be required for painting or decorating. -~ ~ .. --., SECTION 7. Any person, firm or copporation viola- ting any of the provisions of this ordinance shall, upon conviction thereof in the municipal court, be punished by a fine of not'more than $25.00 or by imprisonment for not more than 10 days or by both such fine and imprisonment in the discretion of the Mayor. The owner and the contractor shall be equally guilty if violations of this ordinance occur. \ .~ 11 ordinances and parts of ordinances in conflict rovisions of this ordinance are hereby repealed to the ex nt that such conflict exists and no further.
