CITY OF CLERMONT
?lINUTES OF THE REGULAR MEETING OF THE CITY COUNCIL HELD AT
THE CITY HALL, TUESDAY, FEBRUARY 6, 1940, 7:30 P.M.
The meeting WaS called to order by president O.R. Keene,
otner Councilmen present being A.M.Johnson, F.B.Roe and R.Y<.
. Stackhouse- Absent~ R.L.Lassiter. City Attorney Geo. F.
Westbrook, Marshall B.S.Cleaver and St. Supt. R.F. Anderson
were also present.

Minutes of the meetings Jan. 2 were read and approved.
Miss Stella Thompson appeared before the Council and
asked fo~ adjustment on some paving items against her proprty.
Mr. Stackhouse made a motion, seconded by Mr. Roe, that the.
City Clerk be authorized to make proper adjustments as dis--'
cussed by the City Attorney and Council with Miss Thompson.
When put to a vote, the motion carrierr.
Mr. Roe made a motion, seconded by Mr. SWdhouse that the
Mayor and the City Clerk be authorized to sign an agreement
with the State Road Department pertaining to traffic on the
new road No. 8-A being cons tructed through the City. l~ll1en
put to a vote the motion carried unanimously. A copy of the
agreement appears in the Minute book, following these minutes.
Mr. Roe made a motion, seconded by Mr. Staekhouse, that
Paving Liens and delinquent taxes on lot 2, block 1 be cancelled,
as this lot was sold to J.W.Reed by the City of Clermont in
1930, and the taxes and liens should have been cancelled at
that time. Vfuen put to a vote, the motion carried.
Mr. Johnson made a motion, seconded by Mr. Stackhouse
that the City Clerk be authorized to sign vouchers for e~nses
incurred in the exchange of bonds, upon approval by the City
Attorney. \Vhen put to a vote, the motion carried.
In the absence of Mayor H.C.Bro\vn, the Mayors report
was read.by the City ClePk.

~"'r. Roe made a motion, seconded by Mr. Johnson, that the
Street Committee take up the matter of resurfacing damaged
streets with the District ~.P.A. office, and report back to
the Council before definite action is taken. When put to a
vote, the motion carried.
Marshall H.S. Cleaverls report was read and approved.
Mr. Roe made a motion that Marshal Cleaver have the
reserved parking signs in front of Dr. Douglas' office, and
beside Scott's Pharmacy painted out. The motion WaS seconded
by Mr. Stackhouse, and when put to a vote, the motion carried.
A letter from Er. Rorabaugh relative to cow ppstures
was read, and the Council instructed the City Clepk to write
Mr. Ror~baugh that no permits would be given for pastures in
the City limitso
Mr. Roe made a motion that all revenues from water used
in Edgewood Subdivision be paid to Mr. J.R.Sanger until he
is repaid fOD the pipe he furnished in extending the line to
Edgewood. The motion was seconded by Mr. Stackhouse, and
when put to a vote, the motion carried,

Mr. Roe made a motion, seconded by Pfr. Stackhouse that
the City Clerk order five. barrels of cut-back asphalt for
use in repairing streets. The motion carrdad.

AGREEMENT
THIS AGREEMENT, made by and between the STATE ROAD
DEPARTMENT OF FLORIDA, hereinafter called the
"Department", and the Municipality of CLERMONT,
FLORIDA, he reinafter called the "Municipality".

VffiEREAS, The Department desires to construct a
portion of State Road No. 8-A in the Municipality of
Clermont, known as project 175-G, and
WHEREAS, Certain rules and regulations governing
such projects require that the Municipality or Department
will not permit any encroachments upon the right of way
of said Highway wi thin the limits of tr,e F.~unicipali ty,
nor will the Municipality pass any laws, rules, regulations
or ordinances which will penalize traffic on said street
over and along the streets where said proposed construction work
is to be done, and favor the traffic on a ~oss or abutting
street, or will pass any rules, laws, regulations or
ordinances which will hinder or make obstruction of any kind
to the free movement of traffic and make said movement of
tra~fic secondary to traffic of abutting or cross streets.
NOW, THEREFOR, In consideration of said Department
constructing and surfacing said portion of Highway, the
Municipality agrees, obligates and binds itself to prevent
any encroachment within the right of way limits of said
Highway and furthermore, agrees not to pass any laws, rules,
regulations or ordinances which would be unreasonable.
IT IS FURTHER AGREED, That the contents of this agreement
be spread upon the official minutes of th.; City Connnission
of Clermont, Florida, and copies of this contract be filed
with the State Road Department of Florida.
