MINUTES OF MEETING OF THE CITY
COUNCIL HELD ON OCTOBER 19th, 1939
The City Council met at the City Hall at
4:00 p.m. on Thur,sday, October 19th, 1939, pursuant
to the call of the Mayor. Upon roll call, the fol-
lowing were found to be present: Councilman o. H.
Keene, Roy Lassiter, Albert M. Johnson and R. M.
Stackhouse; Absent: Councilman F. B. Roe. Mayor
H. C. Brown, City ,Clerk, R. F. House, and City At-
torney, Geo. F. Westbrook, were also present.
President Keene announced that the meeting
had been ~alled upon the request of the City Attorney
and requested Mr. Westbrook to explain the purpose of
the meeting. The City Attorney explained that it was
necessary for the Council to adopt the assessment roll
which had been finally equalized and approved at the
last meeting of the Council and that it was also neces-
sary to pass at this time an ordinance making a tax
levy for the year 1939. Mr. Westbrook explained at
some length the procedure which was necessary to be
carried out and there was considerable discussion with
reference to the bankruptcy suit now pending in the
Federal Court and also with reference to the financial
affairs of the City and the desire of the Council to
operate the City on a millage as low as possible for
this year.

Mr. Stackhouse introduced the following
resolution, which upon being read was put to a vote and
unan~ously adopted:
RESOLUTION CONFIRMING ASSESSMENT ROLL

WHEREAS, K. D. Chase, Tax Assessor of the City
of Clermont, has completed the assessment roll of prop-
erty within the City of Clermont for the year 1939 and
presented the same to the City Council; and
WHEREAS, pursuant to due and legal notice as
required by the Charter of the City of Clermont the
said City Council did give notice that it would sit
as an equalization board at the City Hall in Clermont,
Florida, at 7:30 p.m. on September 26th, 1939, for the
purpose of hearing complaints as to the said assessment
roll and equaliZing and confirming the same; and that
at such meeting there were more complaints to be heard
than t~e permitted and said meeting of the Council
sitting as an equalization board was adjourned until
Tuesday, October 3rd, 1939, at which time and at the
same place, the City Council sitting as an equalization

boar~,did hear all complaints and did adjust and equalize
the said tax assessment roll and the same is now equalized
and adjusted, therefore
BE IT RESOLVED by the City Council of the City of
Clermont that the assessment roll of the City of Cler-
mont for the year 1939, as prepared by K. D. Chase, Tax
Assessor of the City of Clermont, as equalized by the
City Council, be and the same is hereby ratified, ap-
proved and confirmed.

Which ordinance was read the first time in
full. M~. Stackhouse moved that the rules be waived
and that the ordinance be read the second time by its
title only, which motion was unanimously adopted. Mr.
Stackhouse then moved that the rules be further waived
and that the ordinance be read the third time and placed
upon its passage, which motion was unanimously adopted.
Thereupon the ordinance was read in full and on the pas-
sage of the same the roll was called and the following
vote was taken: Those voting Aye: Councilmen Keene,
J.ohnson, Lassiter and Stackhouse. Those voting No: None.
Those absent: Councilman Roe.
So the ordinance passed, title as stated, and
was ordered recorded in the Book of Ordinances and num-
bered Ordinance Number ~3

Mr. Westbrook reported that it was necessary
to pay Mr. Jollay $100.00 for expenses incurred by him
in connection with the bankruptcy suit now pending and
it was moved by Mr. Lassiter, seconded by Mr. Johnson,
that the City Clerk issue a warrant payable to Mr. Henry
L. Jollay for $100.00. The motion c~ried unanimously.
It was moved by Mr. Lassiter, seconded by Mr. '
Johnson, that the retainer fee of City Attorney Westbrook I
be made $30.00 for the month of October, instead of $25.~
which motion was unanimously adopted.

There being no further business, the Council
adjourned at 5~00 p.m. to meet at the call of the President.
