04-06-1937 Regular Meeting MINuTES OF THE REGULAR MEETING OF THE CITY COUNCIL HELD AT THE CITY HALL TUESDAY, APRIL,6,1937, 7:30 P.M. The meetIng was called to order by Vice-president Geo. RObinson, other Councilmen present being A.M.Johnson, Roy Lassiter" and F.B.Roe. Mayor H.C.Brown and Marshall Sullins were also present. - ~ ~, Minutes of the last regular meeting and of the special meeting March 17th were read and approved. Mayor Brown handed in his report for March which included recommendations for traffic signs, repairs and some other improvements. He returned the Ordinance on Trailers and house cars passed at the last meeting, unsigned, suggesting changes which he believed neces'sary. Mr. Roe made a motion that the Ordinance on Trailers be referred to the Committee on Laws and Ordinances. Mr. Lassiter seconded the motion, and upon being put to a vote the motion carried. By motion of Johnson, seconded by Eaesiter, which carried, the Clerk was instructed to order 20 more "STOP" signs. By Motion of Roe, seconded by Lassiter, which carried, the Clerk was instructed~' to order 4 '''SCHOOL ZONE " signs By motion of Roe, seconded by Johnson, which carried, the placing of a "STOP" sign at the intersection of Eighth and Montrose Streets was referred to the Street Committee for action. Mr. Roe made a motion that the fence at the foot of Fourth Street on Crystal Lake Drive be repaired, and that a red reflector be placed on it for warning; and that a Street light be placed at the intersection of Seventh Street arid Highland Ave. Mr. Johnsonseconded the motion, and on being put to a vote, it carried unanimously. By motion of I,assiter, seconded by Roe, which carried, the ~air of the Band Stand on the Pool lot facing Montrose Street was referred to the Park Committee. By Motion of Roe, seconded KKK by Lassiter, which carrie~, the City Clerk was instructed to have 'an ordinance drafted, which would eliminate fees to offic&nsB of the City, and all costs and penalties to go into the City Treasury. By motion of Roe, seconded by Johnson, which carrier, all through truck ,traffic shall be routed on Minneola Ave. between Fifth and Twelfth Streets. The Clerk was instructen to write Mr. Chardevoyne that the fence surrounding his property be put back as placed by the State Road Dept., and if not done, all the fences around the place will be put back to the property lines. ~ ~ Couneilman Ro~.Roe made a motion that the City re- linquish to abutting property owners its rights to ground south of Minnehaha Lake Shore Drive from Fourth Street east to the City limits, excepting such property as is necessary for future street improvement. The motion was seconded by Councilman A.M.Johnson, and. on being put to a vote, carried unanimously. By motion of Lassiter, seconded by JOhnson, which carried, owners of property abutting the Park around Sparkling water lake are given permission to improve the Park grounds around the lake, with authority to prevent misuse of same. Mr. Roe introduced the following Ordinance: Ati ORDINANCE DE'CLARING THE CORPORATE AREA OF THE CITY OF CLERMONT TO BE A BIRD SANCTUARY; PROHIBITING THE KILLING OR INJURY OF BIRDS ANYWHERE WITHIN THE CORPORATE LIMITS OF THE CITY OF CLERMONT AND PROVIDING ):'ENALTIES FOR THE VIOLATION OF THIS ORDINANCE, which was read in full and ntmbered Ordinance No. 28. Mr. Roe moved its adoption, which was seconded by Mr. Johnson and carried. Mr. Roe then made a motion that the rules be waived, and that the ordinance be passed to its second reading. The motion was seconded by Mr. Johnson and on being put to a vote, carried. Thereupon the Ordinance was read in full. Mr. Roe then made a motion that the Ordinance be adopted. Mr. Lassiter seconded the motion, and upon roll call, the vote was as follows; Ayes, Johnson, Lassiter, Robinson, Roe; Noes, none. So the Ordinance passed, title as stated, and ,was signed by the President of the City Council and the City Clerk, and immediately certified to the Mayor. Mr. Lassiter made a motion, seconded by Mr. Roe, that the hous e jus t we s t of S. W . Co oper · s home be, condemned as unsafe and unfit for habitation, and that the oWner and tenant be notified in writing by the City Clerk. This house is in block 61, facing Highland Ave. The motion carried A letter from Mr. Costen concerning the recreational facilities in KBhlor Park was read, also a copy of the answer to him from Mr. F. By motion of Roe, seconded by Lassiter, which carried, the report was approved; and the City Clerk was instruote~ to have an Ordinace drafted covering same, and to advertise for bids ~or this service. Mr. Roe made a motion that the time for application for Homestead Exemption o~ City ,Taxes be extended to May 1st this year. The motion was seconded by Mr. Johnson, and on being put to a vote, carried unanimously. There being no further business, the Council adjourned to meet at the call of the Preaident. rW~ City Clerk 1/~ , REPORT OF SANITATION COMMITTEE ON GARBAGE HAULING. ~ We, the Sanitation Committee, respectfully recommend to the Mayor and Council of the City of Clennont,Florida, that a franchise for the hauling of garbage within the limits .of this City be sold to the highest bidder agreeing to abide by the rules of the contract hereinafter set forth;- RULES OF CONTRACT I. ~he City of Cle~ont agrees to fully protect contractor from competition of other garbage hauling for compensation; to furnish a dumping ground tor the disposal of garbage; and to allow the use of its streets to contractor during the hours designated in paragraph V. II. Contractor agrees that he will provide a conveyance for the hauling of garbage which will meet with the approval of the Sanitation Committee. (This being aamely, a truck, with covered body reasonably leak-proof, and with sides and tail gate sufficiently high to insure against loss of garbage while hauling.) III. Contractor agrees to haul garbage from any, or all, of the Residents and Business houses within the City Limits, provided he receives the proper compensation ,for the serviee. IV. Contractor agrees that garbage hauling serviee will be available to the Residents twice weekly (Tuesday and Friday) and to the Business Houses each day excepting Monday. . V. Contractor agrees that the hauling of garbage from Business Houses will take place between the hours of 5 A.M. and 12 O'clock Noon, and from the Residents between the hours of 7 A.M. and 12 O'clock Noon. VI Contractor agrees that the garbage will be hauled to such place, or places, as may be provided by the City and designated by the Sanitation Comm.ittee~. VII. Contractor agrees that the maximum charge for the service heretofor set forth will not exceed one dollar ($I.OO) per month for Residents and two dollars and fifty aents ($2.50) per month for Busibess, Houses. VIII. Contractor agrees that the City of Clermont is in no way _responsible for the collection of service fees or charges. IX.
