CITY OF CLERMONT RESOLUTION NO. 859 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CLERMONT, LAKE COUNTY, FLORIDA ADOPTING A COMPLAINT AND GRIEVANCE PROCEDURE FOR HANDICAPPED EMPLOYEES FOR THE CITY OF CLERMONT WHEREAS, the Community Development Block grant requires the City to adopt complaint review procedures for city employees or applicants for employment who believe they have been discriminated in the terms and conditions of employment based on handicap; and WHEREAS, the City has a Personnel Policy that prohibits such discrimination and includes a grievance procedure for the resolution of such grievances; and WHEREAS, the City wishes to assure the Department of Community Affairs of the State of Florida and the public at large of its nondiscrimination policy and process for resolving any grievances. NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF CLERMONT, FLORIDA, as follows: 1. Any city employee or applicant for employment who is aggrieved by any action that effects the terms and conditions of employment where such adverse action is based on handicap discrimination shall have their complaint resolved in accordance with this Resolution, except that members of collective bargaining on it are excluded from this procedure. 2. In the event of a complaint, the following shall apply: a. Informal resolution of the grievance shall be attempted by the immediate supervisor of the employee or applicant. b. If informal resolution fails, the grievant shall file a written statement of the grievance to the immediate supervisor who may call higher levels supervision to achieve a prompt, satisfactory adjustment of the details and facts of the alleged discrimination and any supporting documents or . . . . . CITY OF CLERMONT RESOLUTION NO. 859 Page 2 information. The grievance statement shall include the action, remedy or solution requested by the employee or applicant. c. If the employee or applicant is aggrieved by the action of the immediate supervisor, the grievance shall be forwarded to the City Manager within five (5) working days of the immediate supervisor's answer. The City Manager shall schedule a meeting with the employee or applicant within five (5) working days and tender a decision within five (5) working days of the meeting.
