President Haves announced that the purpose of this meeting ~as to pass an ordinance requiring property owners to clear up their groves in compliance with the inmtructions of the State Plant Boardo Councilman l:Iills intrmduced the following ordinance; AN ORDINANCE R~~UIRI~G TIIJ: REMOV~'!L AND DIT?OSITION OF ALL Ilt\TUR~ CITI:US FRUITS \!ITHIH TII3 CORPORATE LI;.IITS OF TII:!: CITY OF CL:';:RUONTg which was' read in full and numbered Ordinance Number '20 Mro Tabor moved that the rules be waived, and that Brdinance 2 be placed on its second rea dine and pas8aee; the motion was seconded by Councilman French, and upon vote beine taken the motion carried unanimouslyo Thereupon Ordinance Hoo 2 was read in full, and upon roll call the vote ITas as follows; Ayes: Uills, lfuves, French, Taboro nayes: Hone. So the 6rdinance was passed title as stated, and was signed by the President of the Council and the City Clerk and ior.'lediately certified to the l1ayor. The ~rdinance appears here if full. \"IH~R2AS, there has been found in the vicinity of the City of Cler~ont, citrus groves and property infested "./i th an insect pest knovrn as the lIedi terranean Fly, which said insect pest is kno'.ln to be and constitute a grave men~ce to the health and propperity of the community; and, \fHE:t:i:AS, 'rhe State Plant Board of the state of Florida, in conjunction r:i th the proper authorities of the GOJllernment of' tho United States, is usinR every Dossible means to exterminate this pest, and has requesten the co-operation of all citizens; and mr::2~S, it uJ.Jpt,ars that there are many 6roves and lots in the City of Clerraont, uhich have citrus fruit thereon and in r~~y instances drop)ed and desaying fl~i~ are f?u in large quantities, ana such dropped and decaY1ne fru1t is knovn to be the favorite b~eeding place of the said insect nest and it appears to the City Council the future prosperity and h~alth of the co~~unity is 'placed in Jeopardy, thereby, therefore, BE IT OHD.AIlGD :3Y THE CITY COU1'WIL OF THE CITY OF CLERMONT SSCr: ION I. That all owners of property Vii thin the City 0 Clermont are hereby required to Demove or cause to be removed from such property, all mature citrus fruit, including drop,ed and devaying fruit, whether such fruit be on the traes or upon the ground; and such removal shall be afiected not later than Saturday l~y 11, 1929. ~ ,., ll.inutes meeting l~ay 4, 19~9 Sheet No. 2 .. ,., S3C~ION 2. All such fruit as shall be removed pursuant to the provisions of the foregoing section, and ltlhich is acceptable for transportation under the regulations of the State ?lant Board, may be disposed of as may be permitted by the State Plant Board; and any and all such fruit as shall not be acceptible for transportation under the rules of said Board, and all drO)2ed and decaying fruit shall be removed to such place as may be designated by the 1~yor, and there destroyed in accordance with the rules and regulations of ihe said Florida State Plant Board. Section 3. All expenses incident tot the removal of the fruit mentioned herein shall be bourne by the owner of the property from which said fruit is taken; and in the enent any property owner shall fail to remove and dispose of any fruit upon his property, prior to the time limit herein provided for, the City shall cause such fruit to be removed and destroyed and th cost of same, together with interest at the rate of 8% per annum, shall be a lien against such property, which shall be enforced in the manner provided by law for the enforcement of liens for improvements. Section 4. Any property owner uho shall fail to comply with the provisions of this ordinance, shall upon conviction be ~unished by a fine of not less than ~lOO.OO nor more than v500.00, or by imprisonment for not less than ten days nor more than ninety daya, or by b9th such fine and imprisonment at the disc~vtion of the Mayor; and any person who shall interfere with, or obstruct, any ofricer or employe of the City, who may be engaged in the enforce~ent of this ordinance, shall be deemed upon conviction, to be giulty of obstructing an officer in t_le t.:.ischarge 01' his duty, and shall be punished " , accord~ngly. S~CTION 5. This ordinance, being an emereency ordinance, shall ~ecome effective immediately upon its pa3sage and approval by the ~.;ayor. Passed and adopted at a Special lIeeting of the City Council of the City of Clermont, held on Hay 4, 1929.
