R-98-1044• • CITY OF CLERMONT RESOLUTION No. 1044 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CLERMONT, LAKE COUNTY, FLORIDA GRANTING A CONDITIONAL USE PERMIT TO ALLOW THE OPERATION OF A CHURCH AND MULTIPLE PROFESSIONAL OFFICES, LOCATED IN THE M-1 LIGHT INDUSTRIAL DISTRICT. WHEREAS, the Planning and Zoning Commission of the City of Clermont, Lake County, Florida at a meeting held December 1, 1998 recommended approval of this Conditional Use Permit to allow the operation of a church and multiple professional offices, located in the M-1 Light Industrial District at the following location: LOCATION 260, 262, 264 and 266 Mohawk Road . LEGAL DESCRIPTION Lot 3, Clermont Commons The City Council deems it advisable in the interest of the general welfare of the City of Clermont, Lake County, Florida to grant this Conditional Use Permit; NOW THEREFORE BE IT RESOLVED by the City Council of the City of Clermont, Lake County, Florida that: SECTION 1. This application for a Conditional Use Permit to allow the operation of a church and multiple professional offices, located in the M-1 Light Industrial District be granted subject to the following conditions: 1. This Resolution shall inure to the benefit of, and shall constitute a covenant running with the land and the terms, conditions, and provisions hereof, and shall be binding upon the present owner/permittee and any successor in title or interest, and shall be subject to each and every condition herein set out. 2. Upon approval of the this resolution the aforementioned property shall only be used for the purposes described herein. Any other proposed use shall be specifically authorized by • amendment and approval of the City of Clermont City Council. • C: CITY OF CLERMONT RESOLUTION No. 1044 Page-2- • 3. The property shall be developed in substantial accordance with an approved site plan incorporating all conditions of this Conditional Use Permit. Said plans shall be submitted for review and approval of the Site Review Committee prior to authorization and issuance of a development permit. 4. All applicable rules and regulations shall be met, including but not limited to final site plan approval, landscaping, drainage, sign regulations and all yard setbacks. All required landscaping must be served with a low volume permanent irrigation system including City approved and State mandated backflow prevention device and rain sensor gauge. All landscaped areas must be properly maintained. 5. The structure shall be inspected by the Fire Marshall and Lake County Building Department for life and public safety requirements, all requirements shall be met prior to operation of any business or use, or issuance of an occupational license at this location. 6. All signage shall conform to adopted City Codes and Standards. 7. Buffering and screening shall be required from all abutting uses in accordance with adopted City Codes and in conformance with the approved site and landscaping plan. 8. All signage shall conform to adopted City Codes and Standards. 9. A site Lighting plan shall be submitted and approved for the parcel. Lighting shall be designed, installed and directed to fall upon the subject site and not adversely impact abutting properties or adjacent street traffic. 10. This permit shall become null and void if the proposed temporary Church use has not begun operation within six (6) months from formal grant by the City Council. 11. If, at a future date, parking at this site proves inadequate the applicant understands and agrees that the City may require additional parking or rescind this Conditional Use Permit. 12. The Conditional Use Permit for a temporary Church facility shall be permitted for a • period of three (3) years from the date of formal grant by the City Council. • LJ • CITY OF CLERMONT RESOLUTION No. 1044 Page - 3 - 13 . No expansion of the scope of the basic temporary Church facility, such as but not limited to provision of a day care program, private school operation and the like, shall be permitted except as approved by another Conditional Use Permit. 14. Architectural finish, building, and landscape design plans for the building shall be submitted to and approved by the Site Review Committee prior to any development activity to ensure aesthetic and public safety considerations are not adversely impacted. 15. If any of the stated conditions are violated, the applicant understands and agrees that the City Council may revoke this Conditional Use Permit by resolution.
