RESOLUTION
No. 994
A RESOLUTION OF THE CITY OF CLERMONT, LAKE COUNTY,
FLORIDA, FOR THE PURPOSE OF COMMUNICATING TO THE
LAKE COUNTY BOARD OF COUNTY COMMISSIONERS THE
POSITION OF THE LAKE COUNTY MUNICIPALITIES REGARDING
DISTRIBUTION OF THE SIX (6) CENTS OF LOCAL OPTION GAS TAX
WHICH IS CURRENTLY BEING LEVIED; AND, PROVIDING FOR AN
EFFECTIVE DATE.
WHEREAS, there is currently six (6) cents of local option gas tax levied in Lake
County which is distributed to the county and the municipalities based on three separate
• agreements, and
WHEREAS, the formulas for this distribution are based on the use of population
numbers and transportation expenditures from the years 1985, 1986, and 1994, which do not
reflect Lake County today and creates an inequitable distribution, and
WHEREAS, the cities in Lake County believe that one formula for all six (6) cents
based on current data would be more fair and equitable than the current distribution
methodology, and
WHEREAS, the cities in Lake County believe that this formula should include both
population and transportation expenditures as components for distribution, and
WHEREAS, the Cities in Lake County believe that the proposal by the Board of
County Commissioners to use the percentage of road miles and population for gas tax
distribution is inequitable because history has shown that it costs more dollars per mile to
maintain a municipal road mile than a county road mile, and
WHEREAS, the road mile formula does not provide compensation to the cities for
maintaining street lights, traffic control devices and other embellishments on state and county
roads located within their city limits, and
WHEREAS, a significant portion of transportation impact fees are generated within
municipalities and the county is the only entity by law who can expend these funds, and

WHEREAS, the cities believe that the inclusion of transportation impact fees in the
County's expenditure totals creates an inequity, therefore:
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF CLERMONT,
FLORIDA:
1. We request that the Board of County Commissioners continue to negotiate with
the League of Cities in an effort to achieve a fair and equitable distribution
methodology for all six (6) cents of gas tax currently being levied in Lake
County.
• 2. That the distribution formula should include population and transportation
expenditures utilizing data from the last five years, updated yearly, and that no
party to an interlocal agreement for gas tax distribution should include
transportation impact fees in their expenditure totals.
No new local option gas tax should be considered until a fair and equitable
distribution methodology is implemented for the current six (6) cents.
This Resolution shall take effect immediately upon its final adoption by the Clermont
City Council.
