Members present were Bill Banzhaf, Robert Boyatt, Nick Jones, and Cuqui Whitehead. Also in attendance were Jim Hitt, Planning Director, Dan Mantzaris, City Attorney, and Rae Chidlow, Administrative Assistant. MINUTES of the Planning and Zoning Commission meeting held April 1, 2008 were approved as written. REPORTS There were no reports. 1. REQUEST FOR CONDITIONAL USE PERMIT PROJECT NAME: Giorgio Vlassiou Salon and Medspa /Permanent Makeup OWNER: Clermont Hillside Terrace LLC APPLICANT: Dimitrios Hatzivlassiou REQUESTED ACTION: Request for a Conditional Use Permit (CUP) to allow Permanent Makeup within the C-2 General Commercial District. LOCATION: 2400 S. Hwy. 27 EXISTING ZONING: C-2 General Commercial EXISTING LAND USE: Mixed Retail FUTURE LAND USE DISTRICT: Undeveloped District 8 (UD-8) FUTURE LAND USE CLASSIFICATION: Commercial Planning Director Jim Hitt stated that the applicant is requesting a conditional use permit (CUP) to allow for a Permanent Makeup service as part of an existing Day Spa (located within the Clermont Hillside Terrace development.). He stated that this makeup application, while similar to a tattoo, will be applied only on the face for eyeliner, eyebrow and lip liner definition and will last for approximately 6 months. He stated that because this makeup procedure is part of an existing day spa and is considered to be for cosmetic purposes on the face area only, staff recommends approval of this Conditional Use Permit request to allow for a Permanent Makeup service. City of Clermont MINUTES PLANNING AND ZONING COMMISSION May 6, 2008 Page 2 Michelle Cortes, 1393 Willow Wind Dr., stated that she has been doing permanent makeup for ten years. She stated that it is not like tattoos. She stated she does mostly eye brows. Commissioner Whitehead asked if the applicant has to be licensed by the state to do permanent makeup. Ms. Cortes stated that she does have to have a license. Commissioner Whitehead stated that it is a medical procedure and wanted to know if someone on staff was available at the facility. Ms. Cortes stated that she is licensed in the State of Florida, Texas and also in Reno, Nevada. Commissioner Whitehead asked that as a medical procedure, does she have someone else who helps her. Ms. Cortes stated that there is a doctor that works at the facility that sponsors her. Commissioner Whitehead moved to approve the request, seconded by Commissioner Boyatt. The vote was unanimous to recommend for approval to City Council. 2. REQUEST FOR CONDITIONAL USE PERMIT PROJECT NAME: Hertz Car Rental Office OWNER: Glenn Winn APPLICANT: Hertz Corporation /Wesley Richters REQUESTED ACTION: A request for a CUP to allow the use of an auto rental business in a C-2 General Commercial District EXISTING ZONING: C-2, General Commercial District GENERAL LOCATION: 2205 Cluster Oaks Drive, Suites A & B EXISTING LAND USE: Vacant commercial/office building (4 suites) FUTURE LAND USE DISTRICT: Undeveloped District 8 (UD-8) FUTURE LAND USE CLASSIFICATION: Commercial City of Clermont MINUTES PLANNING AND ZONING COMMISSION May 6, 2008 Page 3 The applicant has requested to operate an auto rental business within the Cluster Oaks Office Park, Lot 1, which has a 4-suite building. There are 25 parking spaces (including 2 HC), and the applicant is proposing to utilize 12 spaces for their auto rental business. This use is not covered under the permitted uses within the C-2 General Commercial District, and therefore requires a Conditional Use Permit. The auto rental business is proposed for the last two suites (suites A & B) on the northeast side of the building which total 1,925 sq. ft. The applicant will not be washing any cars on site. Because of the proposed location, staff believes there is ample parking available for the allocation of 12 parking spaces (including 1 HC) for the business. Staff also believes this use, while more intense than normal businesses due to the increased parking needs, is located at the best possible portion of the site. This automotive rental business would be limited strictly to cars, SUVs, vans, etc., that can park in a normal 10' x 20' parking space. No large truck rental shall be permitted. In addition, staff is also recommending that there should be no exterior washing or detailing of any rental automotives occurring on the site. Any such cleaning and/or mechanical maintenance must be done off site at a proper facility. Staff recommends ~ rp oval of the requested CUP for an automotive rental business at 2205 Cluster Oaks Drive, Suites A & B, as outlined in the CUP Conditions below. Westley Richters, 3703 W. Colonial Drive, Orlando, stated that he is an area manager with Hertz. He stated that he oversees several locations in the Central Florida area. He stated they desire this space for their use. Commissioner Banzhaf asked about having enough for parking at this location and still have enough parking for the other tenants that might come into the plaza. Mr. Richters stated that most of their locations are located in plazas. He stated that they transport most of the vehicles back to the airport locations and to other locations. He said they try to limit the number of cars that sit idle at one time. Commissioner Whitehead stated that she has worked for car rentals before. She is concerned about the drivers who will be transporting the vehicles from one place to another. She worries that they will be rushing cars from one location to another in such a hurry that they will ignore the traffic laws. Mr. Richters stated that the drivers they have working for them do work for Hertz and are not outsourced. He stated that most of the people who will be transporting vehicles from one location to another are in a management role. He stated that they do understand their City of Clermont MINUTES PLANNING AND ZONING COMMISSION May 6, 2008 Page 4 responsibility to the City, the people in the general community and also to the people they share the general space with. Commissioner Jones expressed his concerns with the width of the entrance and would like the Planning Department to consider safety. He said he sees the possibility of a conflict when a couple of cars are coming into the plaza at the same time. Commissioner Banzhaf moved to approve the request, seconded by Commissioner Whitehead.
