A RESOLUTION OF THE CI1Y COUNCIL OF THE CI1Y OF CLERMONT, LAKE
COUN1Y, FLORIDA GRANTING A CONDITIONAL USE PERMIT TO ALLOW THE
CONSTRUCTION OF A MULTI-FAMILY DEVELOPMENT (3 1WO-FAMILY UNITS)
IN THE R-2 MEDIUM DENSI1Y RESIDENTIAL DISTRICT.
LEGAL DESCRIPTION
Lots 18, 19, 23 and the easterly 18.12' of lot 17, the north 40'
of lots 10 and 11, the south 110' of the west 25' of lot 11,
Block 4, Sunset Heights.
The City Council deems it advisable in the interest of the general welfare of the City of
Clermont, Lake Co,unty, Florida to grant this Conditional Use Permit;
NOW THEREFORE BE IT RESOLVED by the City Council of the City of
Clermont, Lake County, Florida that:
SECTION 1.
This application for a Conditional Use Permit to allow the construction of a multi-
family development (3 two-family units) located in the R-2 Medium Density Residential
District be granted subject to the following conditions:
1. The condjtions as set forth in. this Conditional Use Permit shall be legally binding
upon any heirs" assigpsandsuc,cessors in .title or interest.
2. No further expansion of the use or açlditions to the Conditional Use Permit shall
be permitted except as approved by another Conditional Use Permit.
3. The propeI'tyshall be develo.ped in substantial accordance with an approved site
plan incorporating all conditions of this Conditio,nal Use Permit. Said plans shall be
submitted for review and approval of the Site Review Committee prior to author.ization
and issuance of a development permi,t.
4. All applicable rules, and regulations for.devëlopment within the Çityshallbe met,
including but not limited to, final'site plan approvaI,landscaþing, 'çlrainage, parking and
sign regulations, and all yard setbacks. Required landscape areas must be properly

maintained. The drainage and stormwater retention requirements of the City and the
appropriate regulatory agencies shall be met, and approved by the City Engineer. These
areas shall be property maintained.
5. The developer shall be responsible for the cost and installation of any required
on-site and off-site infrastructure improvements necessitated by impacts of the project
(i.e. Concurrency Management).
6. The developer shall construct a five (5) foot wide buffer along property lines
adjacent to existing residential uses, and adjacent to roadways in conformance with
adopted City standards; The buffer shall be provided with a low volume, permanent
source of irrigation, back~flowprevention device and rain sensor device in conformance
with City and State regulation.
7. At such time as' the City constructs sidewalks along Orange Avenue and! or Oak
Street the developer shall construct a five (5) foot wide sidewalk in conformance with
City standards. The required sidewalk shall be provided the length of the subject
property.
8. The developer shall provide solid waste collection pads between the sidewalk and
Orange Avenue as approved by the Site Review Committee.
9. Stonnwater data, calculations, and logistical configurations shall be approved by
the City prior to any const,TUction activity. Positive outfall for stormwater shall be
provided as approve,d by the City Engineer.
10. A ~,t. Johns.River Water Management,District.stormwater permit shall be
required and filed with the City prior to receipt of a development permit or any form of
construction a~tivity on the site.
11. Thispermit shall becomenu1land. void, if substaptial construction work has not
begun within .one (U'year of the date of issuance of this Conditional Use Permit.
"Substantial construction work" means thecomme~cement and continuous prosecution of
construction .of required iITlP~ovemen~s ultimately. finalized at completion.
12. The final Certificate of Occupancy shall not be issued .until each of the stated
conditions has been met.

13. If any of the stated conditions are violated, the applicant understands and agrees
the City Council may revoke this Conditional Use Permit by Resolution.
14. A side yard setback of fifteen (15) feet shall be required, which shall include a five
(5) foot wide vegetative buffer. Two story units shall be allowed.
