R-04-1376M • CITY OF CLERMONT RESOLUTION NO. 1376 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CLERMONT, LAKE COUNTY, FLORIDA, GRANTING A CONDITIONAL USE PERMIT TO ALLOW A PROFESSIONAL OFFICE IN THE R-3 RESIDENTIAL/PROFESSIONAL ZONING DISTRICT. WHEREAS, the Planning and Zoning Commission of the City of Clermont, Lake County, Florida at a meeting held April 6, 2004 approved this Conditional Use Permit to allow a professional office in the R-3 Residential/Professional zoning district at the following location: LOCATION 953 Tenth Street The City Council deems it advisable in the interest of the general welfare of the City of Clermont, Lake County, Florida to grant this Conditional Use Permit • NOW THEREFORE BE IT RESOLVED by the City Council of the City of Clermont, Lake County, Florida that: This application for a Conditional Use Permit a professional office in the R-3 Residential/Professional zoning district; be granted subject to the following conditions: CONDITIONS: Section 1 -General Conditions: 1. The conditions as set forth in this Conditional Use Permit shall be legally binding upon any heirs, assigns and successors in title or interest. 2. No further expansion of the use or additions to the facility shall be permitted except as approved by an amendment to the Conditional Use Permit. 3. The property shall be developed in substantial accordance with the approved site plan incorporating all conditions of this Conditional Use Permit. Said plans shall be submitted for review and approval of the Site Review staff prior to authorization and issuance of a development permit. 4. No person, firm, corporation or entity shall erect, construct, enlarge, alter, repair, remove, • improve, move, convert, or demolish any building or structure, or alter the land in any manner ,. 1 CITY OF CLERMONT RESOLUTION NO. 1376 Page -2 - within the boundary of the project without first submitting necessary plans, obtaining necessary approvals, and obtaining necessary permits in accordance with the City of Clermont Land Development Regulations and those of other appropriate jurisdictional entities. 5. If any of the stated conditions are violated, the applicant understands and agrees that the City Council may revoke this Conditional Use Permit. 6. The Conditional Use Permit agreement must be executed and filed in the office of the City Clerk within 90 days of its date of grant by the City Council or the permit shall become null and void. Section 2 -Land Use and Site Development • 1. Land uses shall be limited to single family residential and professional office. Professional Office includes the following: Legal counseling, Appraisal work, Construction Company, Insurance Office, Land title Office. 2. Signage. One monument sign no larger than 4 feet in height and 12 square feet in size to be located on the Broome Street frontage. 3. No outdoor storage of any type of materials is permitted. 4. No heavy duty commercial vehicles maybe parked or stored on site. 5. A sidewalk shall be constructed as reflected on the site plan dated February 2004. 6. Landscaping shall be provided and maintained. All landscaping shall be irrigated by a permanent irrigation system with sensors and backflow preventors as required by code. 7. The Lake County Building Services Division must approve all construction for the change of use from residential to commercial. ~i 2 1 ~~ CITY OF CLERMONT RESOLUTION NO. 1376 Page -3 - Section 3 -Variances to the Code 1. A variance to Section 118-37 of the Landscaping Code, as reflected on the site plan dated February 2004 by Montverde Engineering, will be necessary to convert the use from residential to a professional office.
