R-03-1348;, • CITY OF CLERMOIVT RESOLUTION NO. 1348 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CLERMONT, LAKE COUNTY, FLORIDA, GRANTING A CONDITIONAL USE PERMIT TO AMEND RESOLUTION NO. 660 TO ALLOW FOR THE EXPANSION OF AN EXISTING RESTAURANT. WHEREAS, the Planning and Zoning Commission of the City of Clermont, Lake County, Florida at a meeting held October 6, 2003 denied this Conditional Use Permit to amend Resolution No. 660 to allow for the expansion of an existing restaurant, at the following location: LOCATION 649 12th Street The City Council deems it advisable in the interest of the general welfare of the City of Clermont, Lake County, Florida to grant this Conditional Use Permit NOW THEREFORE BE IT RESOLVED by the City Council of the City of Clermont, Lake County, Florida that: This application for a Conditional Use Permit to amend Resolution No. 660 to allow for the expansion of an existing restaurant; be granted subject to the following conditions: CONDITIONS: 1. The property must be developed in substantial accordance with an approved site plan. If, at a future date, parking at this site proves inadequate, the applicant understands and agrees that the City may require additional parking or rescind this Conditional Use Permit. 3. No further expansion of the use or additions of this facility shall be permitted except as approved by another Conditional Use Permit. 4. All applicable rules and regulations shall be met, including final site plan approval, landscaping, drainage, parking and sign regulations, and all yard setbacks. A landscape buffer, including tree requirement, shall be provided along the east side. The buffer shall be vegetative or approved fencing with appropriate plants as required by the Landscaping Code. All required landscaping must be served with a permanent irrigation system and must be properly maintained. The drainage and stormwater retention requirements of the appropriate regulatory agencies must be met, and approved by the City Engineer. These areas must be properly maintained. 5. This property may be used as a restaurant and package store only. No other business operation may be conducted from this facility. 6. There shall be no outside sound amplification permitted and in the event there are complaints regarding noise (outdoor music} the City Council reserves the right to revisit the conditional use permit. The Council may rescind approval of the outdoor Chickee but style porch and require its removal. • n CITY OF CLERMONT RESOLUTION NO. 1348 Page - 2 - The Chickee but porch shall not be modified i.e. no electrical service to operate ceiling fans, etc. 8. Parking shall be prohibited on City right-of-way at the northwest corner of the property and a minimum ten foot wide no parking area shall be provided at the northwest corner of the property. 9. Asphalt shall be removed from the City right-of-way along Montrose Street between the dumpster and the east property line. 10. The following landscaping shall be installed within six (6) months of the execution of this Conditional Use Permit: a} provide a landscape buffer along the north property boundary; b} provide landscaping per code around the dumpster; and c} install landscape buffer per code along Montrose Street between the dumpster and the east property line. All landscaping shall be irrigated per code. 11. If any of the stated conditions are violated, the applicant understands and agrees that the City Council may revoke this Conditional Use Permit by resolution.
