CODE ENFORCEMENT BOARD OCTOBER 15, 1991 The regular scheduled meeting of the Code Enforcement Board was called to order on October 15, 1991 at 7:30 p.m. Members attending were Edward Whitehead, Martin Wright, George Wood, Dorothy McGriff, Emma Higgins and William McKinney. Member Joseph Janusiak was absent. Also attending were Leonard Baird, City Attorney, Richard Bowman,, Code Enforcement Officer, Lanny Harker, Director of Planning and Mimi Shaw, Planning Technician. MINUTES of the meeting held August 20, 1991 were approved as presented. NEW BUSINESS: CASE NO. 91-006 J. Mark Sutherland 100 West Montrose Street Clermont, Florida 34711. SITE: 100 West Montrose Street VIOLATION: Section 24-4 Clermont City Ordinance Mr. Bowman informed the Board that he had received a letter from Mr. Sutherland stating that he would be out of town and would not be able to attend the meeting. Mr. Bowman stated that the boat has been removed, however, this has been an ongoing problem that does seem to keep reoccurring. Mr. Bowman recommended that Mr. Sutherland be fined $50.00 for each violation notice that is served in the future. Mr.,Baird felt that the proper procedure would be to note in the record that the offense has been corrected but continue the case for a six month period. If the violation occurs again a fine can be levied at that time. A motion was made by Emma Higgins that the case be continued for a period of six months. If the violation reoccurs, within the six a month period the defendant be brought back before the Board for another hearing and fined $50.00 at that time. Seconded by Dorothy McGriff and approved by a vote of 5 to 1, with Mr. Wood abstaining from the vote due to a possible conflict of interest. CASE NO. 91-007 Kenneth Reau 1449 4th Street Clermont, Florida 34711 SITE: 1449 4th Street VIOLATION: Section 23-3 Clermont City Ordinance Mr. Bowman stated staff recommend that the case be continued for six months and that if the violation should reoccur, the defendant be brought back before the Board and fined $50.00. Mr. Kenneth Reau was sworn in. Mr. Reau stated that the vehicle had been removed and would not be brought back to the site. Mr. Reau then asked if it would be possible for the Board to grant an extension of time until December 31 when he would no longer be in need of the truck. • • Mr. Baird informed the defendant that the Code Enforcement Board could not grant variances or extension, but .the defendant could apply for a variance and appear before the City Council to plea his case. Further discussion followed regarding possible alternative sites for the defendant to park the vehicle. A motion was made by George Wood that the case be continued for a period of six months and if the violation reoccurs within this time period, the defendant be brought back before the Board for another hearing and fined $50.00 at that time. Seconded by Emma Higgins and approved by a unanimous vote. CASE NO. 91-008 Marian A. Bell Et Al 208 East Avenue Clermont, Florida 34711 SITE: 208 East Avenue VIOLATION: Section 24-2 Clermont City Ordinance Mr. Bowman informed the Board that he had been unable to serve the subpoena and therefore this case would have to be continued until the next meeting.
