05-19-1992 Regular Meeting• • MINUTES CODE ENFORCEMENT BOARD MAY 19, 1992 The regular scheduled meeting of the Code Enforcement Board was called to order on May 19, 1992 at 7:30 p.m. Members attending were Edward Whitehead, Martin Wright, George Wood and Emma I-iiggins. Members William McKinney, Dorothy McGriff and Jon Fortier were absent. Also attending were Leonard Baird, City Attorney, Richard Bowman, Code Enforcement Officer and Mimi Shaw, Planning Technician. MINUTES of the meeting held April 21, 1992 were approved as presented. OLD BUSINESS: CASE 92-01 Wilmer Pace 580 East Highland Ave Clermont, Fla. 34711 LOCATION: 580 East Highland Avenue VIOLATION: Chapter 11A-Section 16 -Prohibition of storage within residential areas. Mr. Bowman informed the Board that on May 4th Mr. Pace notified Wayne Saunders, the City Manager, and informed him that the site had been cleaned. An inspection of the site was then made by the City Manager and it was determined that all of the violations had been resolved. Staff therefore recommends that the fine be waived at this time, however, if this violation occurs again, Mr. Pace he fined 5500.00 immediately upon notice of violation. Further discussion followed regarding the defendants previous violations. Mr. Pace arrived at 7:40 p.m. and was sworn in. Mr. Baird apprised the defendant that the board was in the process of determining if a fine was appropriate in view of the fact that this is a reoccurring violation. Mr. Pace stated that he has been in the process of clearing the violations. IIowevcr, this has taken time due to the fact that he works during the day and therefore, can only work on cleaning up the site at night and on weekends. Mr. Pace further stated that other sites currently exist with the same violations as his. He feels as though he has been singled out. Mr. Baird asked the defendant if he had moved hls business to Orlando. Mr. Pace stated he did have a site, however, it would have to be prepared before he could begin business. Further discussion followed. 1 • • A motion was made by George Wood that the fine be waived at this time, however, the defendant should be apprised that if this violation occurs again, there is a possibility that the Board may determine that an immediate fine of $500.00 per day be imposed upon notice of violation, seconded by Emma Higgins.
