MINUTES CODE ENFORCEMENT BOARD MARCH 16, 1993 The regular scheduled meeting of the Code Enforcement Board was called to order on March 16, 1993 at 7:30 p.m. Members attending were Edward Whitehead, Martin '" Wright, Dorothy McGriff, Jon Fortier and James Welborn, Jr. Member George Wood and Donald Bums were absent. Also attending were Leonard Baird, Ciry Attorney, Richard Bowman, Code Enforcement Officer, Lanny Hamer, Director of Planning and Mimi Shaw, Planning Technician. MINUTES of the meeting held December 15, 1992 were approved as presented. ELECTION OF OFFICERS Jon Fortier nominated Ed Whitehead for Chairman and George Wood for Vice- chairman, seconded by Dorothy McGriff and approved by a unanimous vote. OLD BUSINESS: CASE NO. 92-02 Ms. Linda Gooden and Ms. Vincenza Leonardo 606 West Avenue Clermont, FL 34711 LOCATION: 606 West Avenue VIOLATION: Conditional Use Permit granted November 26, 1991 as Resolution #741 -Condition numbers 4, 8 and 9 have not been met At this time Mr. Whitehead asked all those present who wished to speak in regard to this case to be sworn in. The following persons were sworn in: Ms. Linda Gooden, 606 West Avenue, Clermont, Florida Mr. Bowman informed the Board that the defendants had applied for a variance to eliminate paved construction of the driveway, parking and sidewalk. The City Council did grant a partial variance, allowing the parking area and driveway to be constructed 1 - - - _ __ _ __-. _ ____ _. • • of mulch. However, all other conditions of the CUP must be met (i.e. driveway aprons, sidewalks, buffer strips and an irrigation system must be installed). The defendants do appear to be making an effort to complete these requirements, however, as of this date it has not been completed. Staff is recommending the defendant be fined ~l250.00. Mr. Baird noted that the defendants have had approximately five (5) weeks since the variance was granted to complete this work. Ms. Linda Gooden, defendant, explained that they are making an effort and they do hope~to install the driveway and sidewalks in the next few days. Ms. Gooden explained that they have had some delay due to the recent bad weather. Further discussion followed regarding the delay from the time the variance was granted until present. A motion was made by Martin Wright to give the defendants thirty (30) days to complete the conditions of the Conditional Use Permit, seconded by Jon Fortier, approved by a unanimous vote. NEW BUSINESS CASE NO. 93-01 Richard Genaitis 857 E. Minnehaha Avenue Clermont, FL 34711 LOCATION: 857 E. Minnehaha Avenue ` VIOLATION: Chapter 2A, Section 27 -Regulations for erection of signs in commercial and industrial districts. Mr. Bowman informed the Board that this violation had been cleared. A motion was made by Jon Fortier to dismiss this case, seconded by Dorothy McGriff and approved by a unanimous vote. CASE NO. 93-02 Willie Mae Rhodes 535 E. Broome Street Clermont, FL 34711 2 • LOCATION: 535 East Broome Street • VIOLATION: Standard Housing Code, Chapter 3, Section 309.1 -Dangerous structures. The following persons were sworn in: ' Parcella Rhodes Warren, representative of Willie Mae Rhodes, 1021 Packwood Avenue, Groveland, Florida Mr. Bowman entered two (2) pictures of the structure as exhibit A. Mr. Bowman informed the Board that this structure was damaged by fire in mid January and is now in an unrepairable state and a dangerous structure. Staff is therefore recommending that the defendant be given fourteen days (14) to demolish the structure or at the very least to submit a contract for demolition of the structure and clean-up of the site to the Ciry, otherwise directive be provided to the City Manager that the Ciry assume responsibility for eradication of the public safety hazard. In addition, directive also to be provided to the Ciry Attorney that a lien be placed on the subject property in the amount of actual cost for the required site demolition and clean up. Ms. Warren explained to the Board that they have been trying to find someone to ' demolish the structure, however, it has been difficult to find someone to do the work and to obtain the funds necessary for the process. Ms. Warren further explained that she did not feel they could have the work completed in fourteen (14) days, however, they could get started within this time period. Further discussion followed. A motion was made by Jon Fortier that the defendant(s) be given fourteen (14) days to submit a written contract to the City for demolition of the structure and that the ensuing demolition of the structure and clean up of the site be completed no later than fourteen (14) days later, seconded by Martin Wright, and approved by a unanimous vote. CASE NO. 93-03 William R. Oleyar 734 Dunn Hill Road Orlando, FL 32825 LOCATION: 754 East Desoto Street At this time Mr. Whitehead asked all those present who wished to speak in regard to this case to be sworn in. • • VIOLATION: City of Clermont Code of Ordinances, Chapter 12, Section 1 -License tax imposed Mr. Bowman informed the Board that this violation had been cleared. -A motion was made by James Welborn to_dismiss this case, seconded by Martin Wright, and approved by a unanimous vote. CASE NO. 93-04 Jerry R. Daniels 1270 Fran Mar Court Clermont, FL 34711 LOCATION: 1270 Fran Mar Court VIOLATION: City of Clermont Code of Ordinances, Chapter 24, Section 4 -Parking and storage of recreational vehicles. Mr. Bowman stated that a subpoena was sent via registered mail to Mr. Daniels, however the return receipt has not been returned to the City, it is therefore assumed that the defendant has not picked the letter up from the Post Office. Several attempts to deliver the subpoena in person have also failed. Mr. Baird has therefore advised Staff that this case can not be heard until next month when a subpoena can be delivered. A motion was made by Dorothy McGriff to table this request until the April meeting, seconded by Jon Fortier, and approved by a unanimous vote.
