CODE ENFORCEMENT BOARD MEETING
MAY 18, 1993
The regular scheduled meeting of the Code Enforcement Board was called to order on
May 18, 1993 at 7:30 p.m. Members attending were Edward Whitehead, Martin Wright,
Dorothy McGriff, Jon Fortier and James Welborn, Jr. Members George Wood and
Donald Burris were absent. Also attending were Leonard Baird, City Attorney, Richard
Bc~~;~man, Code Enforcement Officer, Lanny Harker, Director of Planning ark Mimi
., Shaw, Planning Technician.
MINUTES of the meeting held April 20, 1993 were approved as presented.
CASE NO. 93-09
Thomas Speakman
220 Crestview Drive
Clermont, FL 34711
LOCATION: 220 Crestview Drive
VIOLATION: City of Clermont Code of Ordinances, Chapter 4, Section 21 (a)(b)(c).
Mr. Bowman, reminded the Board that the defendant was before this Board the previous
month, at which time the Board issued an order that the animals be restrained
immediately and that if it were recorded that the animals have not been restrained the
defendant be fined $100.00 per animal.
The animals were running at large again and the defendant was fined $200.00.
Approximately two days later the animals were again running at large, however, the
animals could not be caught.
Staff recommends that if it is recorded by the Police Department or the Animal Control
Officer that these animals have not been restrained once again, the defendant be fined
$500.00 per animal immediately.
At this time Mr. Whitehead asked all those present who wished to speak in regard to this
case to be sworn in.
The following persons were sworn in:
Mr. Gary Bowman, Animal Control Officer of 1188 West Minneola Ave., Clermont.
Mr. Gary Bowman explained that both he and Police Officer Ward were called out to
the scene on May 12 and both observed the dogs running at large.

Mr, Baird stated that the Board should levy a fine for the incident on May 12 and a fine
should be levied for any future violations.
A motion was made by Jon Fortier that a fine of $200.00 be imposed for the May 12
violation and if any future offenses occur the defendant be fined $500.00 per animal for
each occurrence, seconded by Martin Wright and approved by a unanimous vote.
CASE NO. 93-10
Marcus A. McGowan

LOCATION: 230 Overlook Drive
VIOLATION: City of Clermont Code of Ordinances, Chapter 24, Section 4 -Parking,
Storage of Recreational Vehicles and Chapter 19, Section 34 -Size and Location of
House Numbers.
Mr. Bowman informed the Board that the violation has been corrected.
A motion was made by Jon Fortier to dismiss this case, seconded by Dorothy McGriff
and approved by a unanimous vote.
CASE NO. 93-11
Salah Habib
997 W. Highway 50
Clermont, FL 34711
LOCATION: 997 W. Highway 50
VIOLATION: Conditional Use Permit granted as Resolution #658 -Conditions number
4 and City of Clermont Code of Ordinances, Chapter 26, Article XXI (8).
Mr. Bowman stated that the site is operating under a Conditional Use Permit which
specifically states that no outside storage will be allowed. The defendant presently has
three outside fire racks at the site. It has been explained to Mr. Habib that if the racks
were brought in at night they could be considered outside display, rather than storage,
however he has apparently declined this option.

Staff therefore recommends the defendant be given ten (10) days (May 28, 1993) to
remove all outside storage. If the violation continues to exist after this date, a fine of
$25.00 per day be imposed.
A motion was made by Jon Fortier that the defendant be given ten (10) days (May 28,
1993) to remove all outside storage, if the violation continues to exist after this date, a
fine of $25.00 per day be imposed, as recommended by staff, seconded by Martin Wright,
and approved by a unanimous vote.
CASE NO. 93-12

LOCATION: 295 E. Highway 50
VIOLATION: City of Clermont Code of Ordinances, Chapter 12, Section 1 -License Tax
Imposed.
Mr. Bowman informed the Board that this case has been cleared as this business is no
longer located in Clermont.
A motion was made by Dorothy McGriff to dismiss this case, seconded by Jon Fortier
and approved by a unanimous vote.
CASE NO. 93-13
J. E. Patterson
P.O. Box 302
Minneola, FL 34755
LOCATION: 532 and 534 West Desoto Street
VIOLATION: City of Clermont Code of Ordinances, Chapter 12, Section 1 -License tax
imposed.
Mr. Bowman stated that the defendant has not paid for a current occupational license.
Mr. Patterson was contacted once again today, at which time he promised that a check
would be placed in the drop box at City Hall tonight, however, he has agreed to pay on
previous contacts and failed to do so.

Staff is therefore recommending the defendant be given three (3) working days (May 21,
1993) to obtain a current occupational license. If this violation has not been cleared by
this date a fine of $25.00 per day be imposed.
Mr. Baird asked if the defendant had received his subpoena.
Mr. Bowman noted that the signed return receipt has not been received as of this date.
A motion was made by James Welborn that the defendant be given three (3) working
days (May 21, 1993) to obtain a current occupational license and if this violation has not
been cleared by this date a fine of $25.00 per day be imposed, as recommended by Staff,
subject to confirmation that Mr. Patterson did receive notice of this hearing. Seconded
by Jon Fortier and approved by a unanimous vote.

Mr. Bowman informed the Board that this case has been cleared.

approved by a unanimous vote.

CASE NO. 93-16
Betty J. Brunson

LOCATION: 752 East Broome Street
VIOLATION: Standard Housing Code, Chapter 3, Section 309.1 -Dangerous structures.
Mr. Bowman stated that he has not received a signed return receipt for the subpoena
that was sent to the defendant in this case.
Mr. Baird gave a brief history of this case and recommend that the Board adopt the Staff
recommendation subject to confirmation that the defendant received a notice of the
hearing.
Mr. Bowman stated that Staff recommends the defendant be required to demolish the
structure within sixty (60) days and that the structure be secured immediately until said
demolition takes place. If the structure is not demolished by July 16, 1993 (60 days) a
directive be provided to the City Manager that the City assume responsibility for
eradication of the public safety hazard. In addition, directive also to be provided to the
City Attorney that a lien be placed on the subject property in the amount of actual cost
for the required site demolition and clean up.
A motion was made by Jon Fortier that the building be secured within fourteen (14) days
or the City will secure it with all costs being born to the defendant. The structure be
demolished within sixty (60) days. If the structure is not demolished by July 16, 1993 (60
days) a directive be provided to the City Manager that the City assume responsibility for
eradication of the public safety hazard. In addition, directive also to be provided to the
City Attorney that a lien be placed on the subject propert}~ in the amount of actual cost
for the required site demolition and clean up. Seconded by James Welborn and
approved by a unanimous vote.
