MINUTES
CODE ENFORCEMENT BOARD MEETING
OCTOBER 18, 1994
The regular scheduled meeting of the Code Enforcement Board was called to order on
October 18, 1994 at 7:00 p.m. Members attending were Edward Whitehead, Donald
Burris, Jon Fortier, Martin Wright, Steve D'Amico and George Wood. Also attending
were Leonard Baird, City Attorney, Kenneth Elswick, Code Enforcement Officer and
Mimi Shaw, Code Enforcement Clerk.
MINUTES of the meeting held September 20, 1994 were approved as presented.
CASE NO. 94-16

GENERAL LOCATION: Corner of Pitt Street and Jones Lane (being a portion of Lot 2,
City Block N).
VIOLATION: City of Clermont, Code of Ordinances, Chapter 11A, Section 16 -
Prohi'bition of Storage within Residential Areas.
Mr. Elswick explained to the Board that the defendant is in violation of the Ordinance
pertaining to storage of certain materials in a residential area of the City. There was an
abandoned yellow Cadillac, along with a cement mixer and miscellaneous discarded
rubbish. These materials have been on this property for well over a year. Once the
defendant received the violation notice the Cadillac was removed, however the balance of
the rubbish still remains on the property. At this time Mr. Elswick distributed
photographs of the property.
Member Jon Fortier asked if the defendant has made any contact with the City, perhaps
he is attempting to remove the remaining debris,
Mr. Elswick noted that the only activity has been the removal of the car and the
defendant has made no attempt to contact him. We are unable to locate the defendant as
the only address we have is a post office box.
Mr. Elswick further stated that Staff recommends the defendant be given ten (10) days to
remove all debris and materials. If this violation has not been cleared by October 28,
1994, the defendant be fined $250.00 per day the violation continues to exist.
A motion was made by Jon Fortier that the defendant be given ten (10) days to remove
all debris and materials. If this violation has not been cleared by October 28, 1994, the
defendant be fined $250.00 per day the violation continues to exist, as recommended by
Staff, seconded by Steve D'Amico and approved by a unanimous vote.

LOCATION: 234 Orange Avenue
VIOLATION: City of Clermont Code of Ordinances, Chapter 4, Section 21.
Code Enforcement Officer Elswick noted that this is a continuation of a case that was
begun by the previous Code Enforcement Officer. Mr. Elswick noted that he has been
contacted on numerous occasions by the Animal Control Officer that the animals have
been running at large again. Mr. Elswick further noted that he himself witnessed the
anunals running at large on several occasions. Personal contact has been made with the
defendant to try to rectify the problem.
Mr. Elswick noted on one occasion he and the Animal Control Officer followed the dogs
to the old High School where they were harassing the construction workers. According
to the Animal Control Officer one of the dogs does appear to be vicious.
Mr. Elswick stated that Staff recommends the animals be restrained immediately and if it
is recorded by the Police Department or the Anunai Control Officer of the City that
these animals have not been restrained, an immediate fine of $250.00 per animal be
unposed.
Further discussion followed regarding previous cases involving animals at large.
A motion was made by Jon Fortier that the animals be restrained immediately and if it is
recorded by the Police Departrnent or the Animal Control Officer of the City that these
animals have not been restrained, an immediate fine of $250.00 per animal be imposed,
as recommended by Staff, seconded by Don Bums and approved by a unanimous vote.
There being no further business the meeting was adjourned.
