01-17-1995 Regular Meeting• CITY OF CLERMONT MINUTES CODE ENFORCEMENT BOARD MEETING JANUARY 17, 1995 The regular scheduled meeting of the Code Enforcement Board was called to order on January 17, 1995 at 7:00 p.m. Members attending were Edward Whitehead, Donald Bums, Jon Fortier, Martin Wright and George Wood. Member Steve D'Amico was absent. Also attending were Leonard Baird, City Attorney, Kenneth Elswick, Code Enforcement Officer and Mimi Shaw, Code Enforcement Clerk. MINUTES of the meeting held October 18, 1994 were approved as presented. ORGANIZATIONAL MEETING: Nominations for Chairman and Vice-Chairman Edward Whitehead asked for nominations for Chairman, none were forthcoming. Mr. Baird noted that a Chairman was required, Mr. Whitehead stated if there were no nominations the present Chairman would serve again. Mr. Donald Burris nominated George Wood for Vice-Chairman. There being no other nominations the nominations were closed. Mr. Wood was unanimously elected Vice-Chairman. CASE NO. 95-O1 Abed S. and Nawal J. Nesheiwat 722 Oak Drive Clermont, FL 34711 LOCATION: 722 Oak Drive VIOLATION: City of Clermont Code of Ordinances, Chapter 4, Section 21. Chairman Whitehead asked if the defendants or a representative was present. There being no persons present to represent the defendants, Staff proceeded with their case. Mr. Elswick explained that the City has received complaints about the defendants two small dogs since September of 1994. Numerous contacts have been made with Mrs. Nesheiwat in regard to these complaints. The complaints mainly involve the dogs chasing children and elder persons as they walk on the sidewalk. They have not bitten anyone as of yet and it does appear that the problem has been rectified by the animals owners, as the dogs have not been seen roaming in quite sometime. Mr. Elswick noted for the record that Mrs. Nesheiwat was hand delivered the subpoena for this meeting, however, she did indicate that she would not be attending the meeting, not disregarding the subpoena, but that she is making every effort to contain the animals. Mr. Wood noted that the offense seems to occur about once a month. Mr. Wood asked Attorney Baird what would be the appropriate action of the Board in this situation. .. - • CITY OF CLERMONT MINUTES CODE ENFORCEMENT BOARD MEETING JANUARY 17, 1995 Page-2- Attorney Baird explained that once the Board enters an order then the next time the violation occurs the Board can fine the defendant as a repeat offender. Mr. Baird noted that the Board could enter an order that requires the defendants. to contain the animals pursuant to the City of Clermont Code of Ordinances and require proof that the dogs are properly tagged as required by City Ordinance. If the violation occurs again the Board will be in a position to take more stringent actions. A motion was made by Jon Fortier the defendants be order to restrain the animals immediately. If it is recorded by the City Police Department or the Animal Control Officer that the animals have not been restrained, an immediate fine of $250.00 per animal be imposed, and within seven (7) days (January 24, 1995) the defendant shall provide proof of City dog licenses to the City Code Enforcement Officer.
