PLANNING & ZONING COMMISSION
MAY 1, 1990
The regular scheduled meeting of the Planning & Zoning Commission
meeting was called to order on May 1, 1990 by Chairman John N.
Sargent. Members present were Adelbert Evans, Peter Bertronaschi,
James Brown, Marilyn George and Dan Smith. Members absent were
Bonnie Kranz, Carlos Solas, and Ed Ivey. Also attending were Wayne
Saunders City Manager, Lanny Harked Director of Planning and Jane
Warren Planning Technician.

NEW BUSINESS
1. REQUEST FOR CONDITIONAL USE PERMIT
APPLICANT: David Fojo
1351 Richmond Road
Winter Park, Fla. 32789
1990 were approved as
PROPERTY: City Block 47, Lot 1, 2 and 3 less W 75' thereof
REQUEST: To extend existing Conditional Use Permit for 6 months.
Mr. Saunders informed the Commission that plans submitted by Mr.
Fojo were reviewed by the Site Review Committee. Consequently the
applicant has been requested to provide additional data and detail
concerning the topography of the site before an approval for
construction will be given.
It is unlikely that the applicant will be able to obtain the
necessary information before his expiration date of June 5, 1990,
staff therefore recommends approval of the six (6) month extension
date.
Mr. Don Smith expressed concern regarding the sensitivity of the
lake and also possibly over building on the lot.
Mr. Saunders stated protection of the lake is a major concern and
pointed out proper engineering will have to be obtained and
approved by the City Engineer before approval for construction will
be granted.
Mr. David Fojo was presented and requested an amendment of an
additional nine (9) months instead of six (6) months as stated in
his request. Mr. Fojo stated he has not been able to obtain
financial backing, and needs the additional three (3) months to do
so.
After a brief discussion a motion was made by Don Smith to
recommend to the City Council an extension of nine (.9) months be
granted, seconded by Adelbert Evans and approved by a unanimous
vote.

2. REQUEST FOR CONDITIONAL USE PERMIT
APPLICANT: Darlene Smith

Clermont, Fla. 34711
LOCATION: 1402 Emerald Lakes Street
REQUEST: To allow an existing structure to be used as a single
family residence in conjunction with the operation of a
beauty salon in the C-1 Commercial District.
Mr. Saunders pointed out that the applicant is requesting a
Conditional Use Permit for a joint use of a existing structure
located at 1402 Emerald Lake Drive in the C-2 Commercial District.
The applicant is requesting for the joint use of a single family
residence and a beauty shop which are permitted through a
Conditional Use Permit.
Mr. Saunders pointed out parking and water retention needs have
been satisfied by previous occupants of the site and recommended
approval of the this request, subject to the standard condition of
the Conditional Use Permit plus the following:
1. Standard building codes regulating the dual
occupancy of a commercial use within a residential
dwelling shall be adhered to .
2. No ground sign will be allowed. One wall sign will
be permitted with the maximum of 20' square footage.
After a brief discussion a motion was made by Marilyn George to
recommend to the City Council approval of this request as presented
by staff, second by Adelbert Evans and approved by unanimous vote.
3. REQUEST FOR CONDITIONAL USE PERMIT
APPLICANT: Florida Motel
1929 Highway 27
Clermont, Fla. 34711
GENERAL LOCATION: 1929 Highway 2?
REQUEST: To construct:
1. 10' X 14' attached linen storage area.
2. 14' X 20' family room addition.
Mr. Saunders pointed out that the applicant is requesting to
construct two additions to the motel, one to the eastern end of the
motel unit for a laundry storage facility, and the other on the
western end of the motel which would be an addition to his
residence.
Mr. Saunders stated he did not feel these minor additions would
be a major impact to the site and therefore recommend approval of
the request subject to the standard conditions of the Conditional
Use Permit.

Mr. Don Smith expressed several concerns; 1) the motel being on a
septic system and 2) the need to plan for the future water sewer
demands in this particular area.
Mr. Saunders informed the Commission that he had recently received
the master water and sewer plan for the eastern portion of the
City, from the City Engineer, which covers the land east of Highway
27 and north and south of Highway 50. Mr. Saunders also stated
that a condition of the original Conditional Use Permit for this
site required the motel to connect to the sewer system when
available in this area.
