12-07-1993 Meeting_ ,,~ • CITY OF CLERMONT MINUTES PLANNING AND ZONING COMMISSION MEETING DECEMBER 7, 1993 The meeting of the Planning & Zoning Commission was called to order Tuesday, December 7, 1993 at 7:00 P.M. by Chairman John Sargent. Members-present were Jim Hoskinson, Joseph Janusiak, Joseph Wiebush, Don Smith, Wendell McDarmel and Marilyn George. Members absent were Bonnie Kranz and James Brown. Also attending were Lanny Harker Director of Planning and Mimi Shaw Planning Technician. MINUTES of the meeting held November 2, 1993 were approved as presented. 1. REQUEST FOR A CONDITIONAL USE PERMIT APPLICANT: Richard H. Langley LOCATION: 700 Almond Street REQUEST: A request for a Conditional Use Permit to allow the expansion of a professional office by enclosing a portion of the existing carport, located in the R-3 Residential/Professional District. Mr. Harker stated that the applicant is requesting a Conditional Use Permit to convert approximately 560 square feet of existing sheltered parking area for expansion of the existing professional office building. The subject site is located on the northeast corner of Bloxam Avenue and Almond Street. Mr. Harker further explained that the surrounding land use is residential to the north and east, commercial to the west, and commercial and professional offices to the south. The subject property is situated in the EBD-2 Future Land Use District which allows professional office uses. The CUP request is also consistent with directives of the Future Land Use Map and Zoning District designation which permit professional office uses. The parking requirement for a professional office is one space for each 200 square feet of office use thereby warranting fifteen (15) parking spaces. Impervious parking areas are also required by City Code. Request for variances to these items in relationship to the Conditional Use Permit application will be addressed by the City Council at their next scheduled meeting. Mr. Harker stated that based upon this data and criteria, the City Staff recommends approval of the CUP with the following conditions: 1. The conditions as set forth in this Conditional Use Permit shall be legally binding upon any heirs, assigns and/or successors in title or interest. The property shall be developed in substantial accordance with an approved site plan incorporating all conditions of this Conditional Use Permit. Said plans shall be submitted for review and approval of the Site Review Committee prior to authorization and issuance of a development permit. 3. All applicable rules and regulations shall be met, including but not limited to, final site plan approval, landscaping, drainage, parking and sign regulations, and all yard setbacks. All required landscaping must be served with a low volume permanent irrigation system including City approved and State mandated back- flow prevention device and rain sensor gauge. All landscaped areas must be properly maintained. The drainage and stormwater retention requirements of the City and the appropriate regulatory agencies shall be met and approved by the City Engineer. These areas shall be properly maintained. 4. The site shall be provided with a masonry dumpster enclosure with wooden gates which shall be indicated on the approved site plan. 5. The permittee shall provide a sidewalk constructed in accordance with City standards along Bloxam~ Avenue, Hampton Street and Almond Street, the length of the subject property. 6. The permittee shall provide a five foot wide landscape buffer, in accordance with City standards along the north and east property lines adjacent to the existing residential uses as well as between the professional office parking area and rights- of-way as required by City Code. 7. The subject property may only be used for legal (attorney) offices. No changes in use, expansion of the use or additions to the facility shall be permitted except as approved by another Conditional Use Permit. 8. This permit shall become null and void if substantial construction work has not begun within one (1) year of the date of issuance of this Conditional Use Permit. "Substantial construction work" means the commencement and continuous prosecution of construction of required improvements ultimatelYfinalized _at completion. 9. The final Certificate of Occupancy cannot be issued until each of the stated conditions has been met. 10. If any of the stated conditions are violated, the applicant understands and agrees that the City Council may revoke this Conditional Use Permit by Resolution. CI71' OF CLERMOtVT MINUTES FLANNING AND ZONING COMMISSION MEETING DECEMBER 7, 1993 Page - 3 - At this time Mr. Sargent asked all those present who wished to speak in regard to this case be sworn in. Persons sworn in were Mr. J. Craig Myrick, representative of the applicant, of 700 Almond Street, Clermont, Florida. Mr. Myrick stated that in reference to condition #4, that this type of business does not create enough waste to require a dumpster, the new garbage containers distributed by the City would be more than adequate for this business. In reference to condition #5, the applicant also takes exception to the requirement for sidewalks. Mr. Myrick further stated in reference to condition #6 which requires the five (5) foot wide landscape buffer, this would extend into the existing driveway and parking area on the north side of this property. Mr. Harker explained that all of these items would be considered a variance to the City Codes and would therefore be addressed by the City Council. A motion was made by Wendell McDannel to recommend approval to the City Council as presented by staff, seconded by Marilyn George, approved by a unanimous vote.
